The following comments are provided: PLANNING, COMMUNITY & ECONOMIC DEVELOPMENT: General 1. The proposed cleanup action will be conducted under Agreed Order (No. DE11346) with the Department of Ecology within the authority of the state Model Toxics Co ntrol Act. The proposed action is exempt from procedural requirements of state and local permits that would otherwise be required under RCW 70.105D.090. Zoning Designation 2. The property is split zoned MS and LM; the Land Use designation in the Comprehensive Plan is Manufacturing and Shipping and Light Manufacturing. Per AMC 19.76.050, the applicant must locate and design all buildings, streets and pathways, parking areas, and utilities easements to promote public safety, ensure compatibility of uses, minimize effective impervious surface, preserve native vegetation, and complement predevelopment site characteristics such as topography, soils, hydrology, and other natural features. Please review this and integrate applicable items into your plans. 4. Please review AMC 19.76.060 regarding stormwater facility location, dedication, modification during construction, maintenance plans, and plat notes. There are applicable standards that will need to be integrated into plans. 5. Please review AMC 19.76.070 regarding general conveyance requirements, easements, tracts, covenants and integrate applicable items into your plans. SANITATION DEPARTMENT: 6. All good from Solid Waste. WATER DEPARTMENT: 7. No concerns. FIRE DEPARTMENT: 8. No fire issues. PARKS DEPARTMENT: 9. No concerns. PUBLIC WORKS DEPARTMENT: 10. See attached comments from Steve Lange Review Process & Submittal Requirements 11. Based on the project description and information provided, the following application types/processes appear to be required (see AMC Table 19.20.030-1): Shoreline Substantial Development Grade & Fill w/ Stormwater Review Demolitions Permit ROW Permit SEPA Determination 12. The proposed action is exempt from procedural requirements of state and local permits that would otherwise be required under RCW 70.105D.090. Therefore the City is waiving all permits except that, for project tracking and fee invoicing purposes by the City, the Port shall submit the master land use and clear and grade application forms but there will be no review time or approvals necessary. 13. Conditions required: Page 3 of 3 o There shall be an onsite preconstruction meeting prior to the start of work. o All Right of Way work, sidewalk closures, and traffic revisions, and inspections shall be coordinated with Justin Symonds, Public Works. o Contamination in the 2nd Street Right of Way shall be addressed with application of bioremediation material at the time of back fill, or a written commitment to remedial action of remaining contamination in the future. o The site including sidewalk, curb, parking strip, plantings and City Right of Way shall be fully restored to preconstruction conditions. o Lighting, dust control, and all erosion control measures shall be implemented during the project. o Noise escapement shall be controlled. Construction should occur during normal working hours (Monday through Friday, 8AM to 5PM). The project shall comply with environmental noise standards set by the State of Washington, WAC 173-60. Fees 14. Land use permit application fees will be exempt. Based on the information provided in the pre- application submittal, the following fees are applicable: Engineering Plan Review and Construction Inspection Fees (2% + $500) Please note that these comments are preliminary in nature and subject to change based on information that is more detailed and future changes to the development regulations. Below are the findings and recommendations: Applicant Questions: 1. Does the list of anticipated City of Anacortes permits appear to be complete? Response: s Verify with the Planning Department. a Public Works will required Engineering Plan Review and Construction Inspection Fees to be paid (2%+$500.00). • Right -of -Way Permit. Contact Justin Symonds (PW Inspector). 2 Does the City of Anacortes plan to install\repair\inspect any utilities or other infrastructure while the construction phase of the project is underway? Response: Anticipate inspection of proposed new utilities being installed by this project. No inspection planned for any existing facilities. Unless exposed by this project. 3. The current plan calls for partial closure City sidewalks and one lane of 0 Avenue, will it be necessary to post these closures in advance? Response: Project will submit a Traffic Control Plan and Pedestrian Route Plan prior to construction start for acceptance by the City of Anacortes City Engineer. 4. Are there an additional conditions that City design team anticipates for this project? Response: ® Project will need to submit a Storm Drainage Report. Utilize the Applicability Flow -Chart for Redevelopment to determine what Minimum Requirements are triggered. Projects that trigger Minimum Requirements I through 9 are subject to 3rd Party review and paid for by the applicant. ® Public Works anticipates the clean up to extend into 2nd Street since the site contamination extends into the Public Right -of -Way.
