Hi Mr. Blackwood,
There are several issues that have arisen about your property at 2401 Washington Court, as listed below:
01. There is no encroachment agreement on file making it legal for your retaining wall to be on the stormwater
easement. It also appears that your retaining wall crosses over your property onto the neighbor's property, which is
illegal. Retaining walls are renuired to be fully installed on one's own property.
2. The 2013 permit expired and will need to be renewed before we can do�'final inspection and issue a Certificate of
Occupancy.
3. It is illegal to have anyone occupy or sleep in the home without a Certificate of Occupancy.

COVE ESTATES
Encroachment Description: Proposed encroachment is for a retaining wall below
neighbor's concrete wall, see attached site plan for location.
Dear Thomas,
1 am pleased to inform you that your bi,ncroachment Request has been approved
according to the following provisions:
1. The Owners) agree to comply with all applicable ordinances, laws and codes in
constructing the encroachment and further agree to remove the said encroachment
within a reasonable time upon request by the City of Anacortes or a duly franchised
public utility. The Owner(s) understand and agree that all costs incurred in removing
and replacing said improvements shall be at the Owner's sole expense.
2. The Owner(s) agree to indemnify and hold the City harmless from any claims for
damages resulting from construction, maintenance or existence of those
improvements encroaching into said right-of-way.
3. The Owner(s) shall not obstruct water meters or other public or private facilities
except as approved in this agreement.

4. The Owner(s) shall ensure that any public or private utilities are not impacted or
damaged by construction or use. Call for locates before you dig. Dial 811 at least
two full business days (not including the day you call) before you plan to dig, no

5. The construction and use shall not create clear view obstructions at intersections or
private property access.
6. 1-4;nclosed is our Fences, Walls, and Hedges ordinance to follow as well.
I have enclosed --Two copies of this approval letter, please sign below and return one copy
to Russ Pittis at City Hall to agreeing to the provisions in this letter and completing the
encroachment process. Please keep this letter as a record of your encroachment.
