B. Coen for a variance for a proposed non-commercial dock at Skyline. Coen • Date 5/25/78 Mr. Coen ' s variance request for locating his pro- posed dock seaward, according to Mr. Coen, is necessary due to the shallow water depth closer to the shoreline. Mr. Coen ' s application, however, does not furnish any evidence which supports his allegation and the net result is that Mr. Coen ' s proposal results in 4 moorage sides and is contrary to the existing ordinance. The Skyline Beach Club initially recommended denial of the request and furtherance of their enforcement of the restrictive covenants. The City, however, does not enforce restrictive covenants which are imposed on private property. The City enforces only its existing codes and ordinances. r. It is also our opinion that large docks in this area • are not in keeping with the single family character of the area and the intent of the ordinance. It should be pointed out that leasing of moorage space in this area is illegal and that it is difficult for the City to police and enforce the ordinance as it relates to this matter. The intent of the ordinance is to allow home owners in the area to construct moorage in this area for their use only. If Mr. Coen can adequately demonstrate to the Board that the additional moorage faces are in fact necessary, due to the shallow depth of the water closer tro -+tore, then we would not object to this request. k Ail, • II -----—---- CITY OF ANACORTES INTEROFFICE MEMORANDUM To Board of Adjustment Dept. From Stephen E. Mansfield Dept. or Title City Attorney Subject Application for variance by Bob Coen Date 5-25-78 Application has been submitted by Mr. Coen for a variance allowing four moorage sides in excess of five feet on his proposed dock. Specifically he is requesting permission to construct an L-shaped dock having mooring faces of 24 feet, 16 feet, 50 feet, 50 feet, 30 feet, and 30 feet, and 8 feet. The intent of the ordinance appears to be to not allow any dock but a rectangular dock not to exceed 8 feet in width. The 5 foot figure was apparently in the code prior to the time that a change was made allowing docks to be 8 feet in width instead of the originally proposed 5 feet in width. Mrs Coen has proposed an extension to his 50 foot dock of 30 feet which is proposed atan angle to- the main dock itself. It is my opinion that the additional 30 foot section constitutes separate mooring sides as long as it presents an angle face to the main dock structure. Although Mr. Coen' s application is filed on the forms used under the previous code it does, in my opinion, substantially comply with the requirements of the new code and therefore is sufficient for Board of Adjustment consideration. It does not appear to request a variance as to the additional 30 foot section, however. The petition alleges that insufficient water depth makes it necessary to utilize the L-shape. The Board of Adjustment has thepower to require expert testimony as to the water depth in existence and the amount of water depth necessary. Mansfield, City Attorney Date 5/25/78 Attached is a memo from the City Attorney suggesting some considerations by the Board under the new zoning code. CITY OF ANACORTES INTEROFFICE MEMORANDUM To Board of Adjustment Dept. From Stephen E. Mansfield Dept. or Title City Attorney Subject Requirements under new zoning code Date 5-25-78 Under the new zoning code an individual petitioning for a variance from area and dimensional regulations in the code will be required to establish the following: 1. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same district; 2 . That literal interpretation of the provisions of this ordinance would deprive the applicant of rights -- commonly enjoyed by other properties in the same district under the terms of this ordinance; 3. That- the special conditions and circumstances do not result from the actions of the applicant; and 4 . That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands , structures , or buildings in the same district. The burden for demonstrating the existence of the necessary facts is on the petitioner and the Board has the right to request that any technical data necessary be provided by regis- tered surveyors, engineers , or other individuals with technical expertise. Oftentimes a particular condition is alleged to exist but no proof is provided other than the allegation. In my opinion, the Board of Adjustment should require some addi- tional information sufficient to satisfy them that the condition does in fact exist. The code authorizes the Board of Adjustment to grant a variance only in cases where a literal enforcement of the ordinance would result in"unnecessary hardship" . The intent of the code is to grant variances on a very limited basis and not simply for the convenience of the petitioner or on the basis that no one will be immediately harmed by the granting of the petition. It is further my suggestion that written findings be made by the Board of Adjustment in each case where a petition is filed as to whether or not all of the requirements listed above are met and further that the variance is justified, and that it is the minimum variance that will make possible the reasonable use of the land, building or structure. In addition, the Board of Adjustment should make a written finding that the granting of the variance will be in accordance with the general purposes and intent of -1- C To: Board of Adjustment May 25, 1978 Page 2 . the code and will not injure the neighborhood or the public welfare in general. Also the Board of Adjustment should be aware that it has the power to require certain conditions and safeguards in granting the variance and that violation of those conditions and safe- guards , if included in the variance granted, will be a viola- tion of the zoning code. SEM:tf Board of Adjustmry Meeting - June 1, 1978 �( JJ Meeting called to order by Chairman, Norwood Young, at 7 : 35 P.M. Members Present : Norwood Young, Bill Morningred, George Mehler, Tom Cleland, Rick Sparks . Ray Iversen represented City Staff. Mr. Young asked the Board's pleasure on the minutes of the last meeting and of the meeting of March 16, 1978. Motion was made that the minutes of both meetings be approved as if read. Vote: All ayes , motion carried. Mr. Young then asked if there were any comments from the Board on a memo sent to them from Steven Mansfield, City Attorney, suggesting some considerations that might be taken by the Board relating to the new zoning ordinance . Mr. Cleland suggested that the Board meet with Mr. Mansfield to go over his suggestions . Mr. Young then asked the secretary to ask Mr. Mansfield to meet with the Board on June 15, 1978 at 6 : 30 P.M. prior to the next Board of Adjustment meeting. Mr. Young stated the first variance request was that of Mr. Robert W. Koop, 2610 View Place, Anacortes requesting a variance from 5 feet to 2 feet in the rear yard to place his mobile home . Mr . Koop was in the audience and spoke on his behalf, and showed photographs -of the particular area. Mr. Iversen showed a copy of the site plan. Mr. Koop stated that he talked to the neighbor next to his trailer lot and the neighbor strongly urged that he request this variance . Mr. Young asked if there were similar requests before the Board in the past . Mr. Iversen said he didn't remember similar requests . Mr. Iversen also stated that the Skyline Beach Club and City Staff had no objections to this request . Mr. Hogg, President of Skyline Beach Club , commented that the Club had no objections to this request . Motion was made by Mr. Mehler that the variance be granted as re- quested. Motion was seconded by Mr. Cleland. Vote : All ayes . Motion Carried. Mr. Young asked that the minutes show the main reason the variance was granted was because the lot abuts on a common green area and does not encroach onto anyone ' s property. Mr. Iversen commented on a procedural change which would be made . The legal notices which are now posted would be eliminated and the petitioner for a variance would now supply names of abutting property owners so they would be notified of petition by mail. Mr. Mehler asked that these notices be sent registered mail. Mr. Young stated that the next request was from James Graves, 2901 Oakes Avenue for a variance in setback from 5 feet to 2 feet at the northwest end of mobile home lot #28, Division 6 , Skyline . After discussion by the Board it was decided that this request was similar to that of Mr . Koop and motion was made by Mr. Cleland to grant variance . Motion seconded. Vote : All ayes . Motion carried. It was also noted that Mr. Graves property has the green belt area. Page 2 Mr. Young read the next variance request to the Board. The request was from Mr. Doyle Foster, 1416 9th Street for a variance of 6 feet Y on the front portion of his property to construct a deck. Mr. Young stated that Mr. Foster discussed the variance with him and the main reason for the request is a place for elderly people to stand when he opens the door. Mr. Young also stated that the house to the west is about 18" further than Mr. Doyle ' s and the house across K Avenue would be out about the same distance as Mr. Doyle ' s . Mr. Morningred commented that this wife has been to the hairdresser shop at this residence and there is somewhat of a problem as it stands now. M Iversen stated that City staff had no objections to this recuest . Mr. Morningred moved that this variance be granted as requested. Motion seconded by Mr. Mehler. Vote : All ayes . Motion carried. The next variance request was that of L.B. Coen, 1915 Bay Place for a variance from two mooring sides in excess of 5 feet to four mooring sides in excess of 5 feet at Lot 43, Division 7, Skyline . Mr. Young asked Mr. Iversen to comment on this request . Mr. Iversen said it was a larger dock than allowed by the zoning ordinance and in this case the only approval can come from the Board of Adjustment . Mr. Coen spoke on his behalf and stated the Skyline Beach Club had given their approval for an 80 ' dock. Mr. Mehler asked why he could not come out from the right side instead of left side of dock, and Mr. Coen said it was a mutual understanding between property owners and the setting of their pier heads so that they will all have openings . Mr. Iversen read the comments from Mr. Steven Mansfield and Mr. Ken Kinzel. Mr. Dean Allen from the audience spoke on behalf of Mr. Coen stating that there definitely was a low water problem. There had been efforts to move the rock and rip rap but it was hard to move around. Mr. Mehler asked for comment from Mr. Hogg. Mr. Hogg stated the Beach Club ' s interest is to know what the rules are so that it will be easier to advise prospective builders . He added that he felt it was contrary to single family residences , but that was not the feeling of the board. Mr. Young stated to Mr. Coen that Steven Mansfield felt that the last 30 feet would not come under the same request as this because it would come off at an angle . (Mr. Coen correctPdthe second section of dock to read 6 ' x 30 ' instead of 8 ' x 30 ' ) . Mr. Young stated, for the benefit of the Board, that this could be left as a separate variance request . Mr. Hogg stated that with the exception of 2 docks, all other docks in the area were 50 feet . Mr. Jerry Lipsey, from the audience , said he was in the same waterway as Mr. Coen and he could see no reason why he should not be granted a variance as long as he is not encroaching on the waterway. Mr. Morningred asked the length of Mr. Coen' s boat . Mr. Coen stated his boat is 24 feet long. Mr. Morningred then asked why the extra space was necessary and Mr. Coen said he needed the space for friends with boats . Mr. Sparks made a motion that an 80 ' dock in a straight line , or one piece , be granted. Motion died for lack of a second. Mr. Sparks said he felt that the request as submitted was not out of single family character. Mr. Cleland made a motion that the variance be granted for a 6 ' x 24 ' and 6 ' x 50 ' "L" shaped dock, eliminating the 6 ' x 30' dock. Motion seconded. Vote : All ayes . Motion carried.
