We own pC:oiTe-r7Y-71-870-87793/40 There is an alley separating us from the lot behind us, which fronts on 36th St. The North half of the alley belongs to the property fronting 36th St, and the South half of the alley belongs to us. It is my understanding that we are not able to fence in our half of the alley, since it is a City of Anacortes easement for sewer and utilities. If I am wrong, do let me know. The problem we are having is the people living in the house fronting 36th Street seem to feel that the alley is their personal parking place and our back yard their personal turn around. There seems to be a bit of a misunderstanding. First, Mr. Perkins does not own the property behind us (Lots 9 and 10, Block 12, Beale's Maple Grove). Mr. Alan Beesley owns this property. Second, our concern is not with the neighbor putting up a fence. It's the location of the fence that we are concerned with. Our trash is picked up in the alley between Lots 9 and 10 and Lots 11 and 12, Block 12, Beale's Maple Grove. We have, on more than one occasion, had to contact the city trash service because our trash was not picked up. This has been due to the alley being partially blocked. The neighbor at Lots 9 and 10, Block 12, Beale's Maple Grove, will be blocking the alley completely if she puts her fence up where she has proposed; which has been to fence in the entire alley between our lots. While our boundary line disputes are between us, the ability of the city to pick up our trash, service the sewers, and whatever else that alley is used for, is what prompted us to contact the city. If blocking the alley is not a problem for the city, then we have no complaint. However, if blocking the alley will interfere with the services provided by the city to us,then we do have a problem. You also requested a map of the area. Enclosed you will find a copy of our map of the area. Because the alley that you share with your neighbor is vacated, you and Mr. Perkins each own half of the alley. The city maintains an easement for our sewer line under the alley. Mr. Perkins is within his rights as a property owner to construct a fence along the property line. This practice is common in the city and allows property owners the full use and enjoyment of their property, while allowing the city the right to maintain our sewer line under private property.
