We have reviewed the files and found that permits have not been issued for the garage conversion to living space. A proposal was provided by Mr. Halstead to convert the garage in August 2001 and a review was completed by Ed Frank indicating many items which needed to be addressed. Mr. Halstead did not respond to the review nor acquire permits. My observations of the converted garage on tuesday indicate unsafe construction at the roof and cieling, the bearing wall was removed, as well as a large amount of electrical work, apparantley without permits. The converted garage area could not be occupied until such time as proper permits have been acquired and the required inspections have been completed. UBC Sect.102, Sect.106, Sect. 108. That literal interpretation of the provisions of this title would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this title; c. That the special conditions and circumstances do not result from the actions of the applicant; d. That granting the variance requested will not confer on the applicant any special privilege that is denied by this title to other lands, structures, or buildings in the same district. 2. No conforming use of neighboring lands, structures, or buildings in the same district, and no permitted use of lands, structures, or buildings in other districts shall be considered grounds for the issuance of a variance. 3. The following steps are required for consideration of variance' a. Notice of public hearing shall be given. Written notice shall be mailed to property owners within three hundred feet of the boundaries of the subject property; b. The board of adjustment shall obtain reports from all affected city boards or departments as part of the information to be considered at the public hearing, c. The public hearing shall be held. The board of adjustment shall further make a finding whether or not the granting of the variance will be in harmony with the general purposes and intent of this title, and will not be injurious to the neighborhood, or otherwise detrimental to the public welfare. 4. Variances shall be limited to the area and dimensional requirements of this title. 6 Whenever a variance provides for or anticipates future construction, such construction must be commenced, or application made for a building permit, within ninety days from the date on which the variance was granted. 17.10.060 Appeals of board of adjustment actions. Any person or persons, taxpayer, department, board of the city, the mayor or the city council, aggrieved by any decision of the board of adjustment may seek review of such decision by a court of record, within twenty-one days in the manner provided by the laws of the state. May 11, 2007 To: Building Department City of Anacortes 904 6th St. Anacortes, WA 98221 From: Thomas Wise 816 37th St. Anacortes, WA 98221 Subject: Request For Variance Members of the Zoning Board, Hello. I am the property owner at 816 37th St, and I would like to have a standard 20' X 24' garage built in my back yard, parallel to the existing (vacated) alley. Since the alley is documented as vacated, there is a requirement for a 20' set back from the property line. I am requesting a variance so that my garage may be built parallel to the alley, with the north wall at or very near the property line. The alley is currently used by many of the residents for access to their garages, and by the city for waste and recycling collection. Thank you for your time, Thomas K. Wise c. Actions of the Applicant: 1. The special conditions and circumstances outlined above existed prior to my purchase of the house, and were not a result of any actions of the applicant. d. Special Privilege: 1. As far as I know, granting of this variance does not appear to confer any special privilege on the applicant that is denied to other lands, structures or buildings in the same district Legal Description of Parcel P33074, 816 37th St. TAX 32AC; THAT PORTION OF GOVERNMENT LOT 2, SEC 30, TWP 35, RNG 2 DESCRIBED AS FOLLOWS; BEGINNING AT THE SOUTHEAST CORNER OF SAID LOT 14, BLOCK 12, BEALES MAPLE GROVE ADDITION TO ANACORTES; THENCE WEST A DISTANCE OF 60 FEET; THENCE SOUTH TO THE NORTH LINE OF 37TH STREET AS NOW ESTABLISHED IN THE CITY OF ANACORTES; THENCE EAST A DISTANCE OF 60 FEET; THENCE NORTH TO THE POINT OF BEGINNING Justification For Variance (as outlined in Part 17.10.040B of the Zoning Ordinance) a. Special Conditions and Circumstances: 1. The original garage that was attached to the house was converted to living space prior to my purchase of the house. 2. We currently have three vehicles, so one is always parked in front of the house along 37th street. This creates an obstacle to the view of children by passing drivers, and the view of traffic to children playing in the area. 3. A new garage built in front would be narrow and extremely limited for space. It would also have to be attached to the house. There would be little room for workspace within the garage, or for my motorcycle. 4. The back yard is relatively small, and the 20' setback requirement would crowd the area directly behind the house, blocking light and substantially reducing the 60' width of the children's play area, which happens to be perfect for a good game of catch. b. Literal Interpretation/Deprival of Rights: 1. Other properties along the alley have similar accessory structures that were built within the current 20' setback requirement. I am requesting that my garage may be built along the same line as the others. 2. This would help to enclose the back yard, providing a better level of security for my children and property. 11 Teit, I I- IL700 -1.1%4 csIe I . 1 7.',:4 ,C1-ft :I• 1 4 I ,:•:,,;)-• ) iiirAVN6-2 iv..., 44,I F4' LC f iii/ ..'' ri -•TY's14- 1.-1- --'-) - c) i,.. As far as I know, granting of this variance does not appear to confer any special privilege on the applicant that is denied to other lands, structures or buildings in the same district. Legal Description of Parcel P33074, 816 37th St. 2. This would help to enclose the back yard, providing a better level of security for my children and property. i 11356645 e56644:1. e66643 ,; I .----.-____I----._-_-- if.56647t. ......__1 LL , . 649 e56 LAitkes-t '9;04,44: 1 _ .„.. _______ ll , — 1 1 i S j I 1 1 i \ 1 ANACORT ES P33072 . 1E133074 .. ..,,,,,I,x,: . 1 P33069 / 5 / \ t 1 1 / 5 1 i \ t r .----------..5- -_-.--I.. -- . ._ .--..-------. -- -.5 ----------- . The City of Anacortes Zoning Board of Adjustment is empowered by Municipal Code of the City of Anacortes to hear requests and make decisions on said requests in regard to certain appeals for variations in the Zoning Ordinance..The Board of Adjustment (Board) is a quasi- judicial body with authority to grant variance permits for area and dimension in exceptional cases when the request is consistent with the general purpose and spirit of the comprehensive plan and zoning regulations. The Board has no authority to allow a variance whose effect would be the establishment of a use not otherwise permitted by the Zoning ordinance or to extend a non-conforming use of land or to change district boundaries except as outlined in the Zoning Ordinance. Specifically, the board of adjustment shall have the following powers and duties; 17.10.040 Anacortes Municipal Code A. Administrative Review. To hear and decide appeals where it is alleged there is error in any orders requirements, decisions, or determinations made by the Administrator in the enforcement of this title. B. Variances, Conditions Governing Application, Procedures. 1. To authorize upon appeal in special cases such variance from the terms of the area and dimensional regulations of this title as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of this title would result in unnecessary hardship. A variance from the terms of this title shall not be granted by the board of adjustment unless and until a written application for a variance is submitted demonstrating all of the following: a. That special conditions and circumstances exist which are peculiar to the land, structures, or buildings involved and which are not applicable to other lands, structure, or buildings in the same district; b. The literal interpretation of the provisions of this title would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this title; c. 2 3. The following steps are required for consideration of a variance: a. Notice of public hearing shall be given. Written notice shall be mailed to property owners within three hundred feet of the boundaries of the subject property; b. The board of adjustment shall obtain reports from all affected city boards or departments as part of the information to be considered at the public hearing; c. The public hearing shall be held. Any party may appear in person, or by agent, or by attorney; d. The board of adjustment shall determine in writing whether all of the requirements of subsections(B)(1) and (2) of this section are met; e. The board of adjustment shall further make a finding whether or not the reasons set forth in the application justify the granting of the variance, and that the variance, if granted, is the minimum variance that will make possible the reasonable use of the land, building, or structure; f. The board of adjustment shall further make a finding whether or not the granting of the variance will be in harmony with the general purposes and intent of this title, and will not be injurious to the neighborhood, or otherwise detrimental to the public welfare. 4. In granting any variance, the board of adjustment may prescribe appropriate conditions and safeguards in conformity with this title. Violation of such conditions and safeguards, when made a part of the terms under which the variance is granted, shall be a violation of this title. 5. Under no circumstances shall the board of adjustment grant a variance to allow a use not permitted under the terms of this title in the district involved, or any use expressly or by implication prohibited by the terms of this title in said district. Variances shall be limited to the area and dimensional requirements of this title. 6. Whenever a variance provides for or anticipates future construction, such construction must be commenced, or application made for a building permit, within ninety days from the date on which the variance was granted.
