Re: Sewer Hookup Fees - Horizon Heights Addition
Date: May 30, 1984
As,.you may or may not be aware an agreement between the City, of
Anacortes and Mr. Ray Jones was taken to court to determine whether
r or not the City had :the right to assess sewer hookup charges to all
property owned by Mx, Ray Jones. The City's contention was that
under the agreement the City did have the right to charge sanitary
Sewer hookup fees. Mr. Jones' contention was obviously just the
opposite7
An' interpretation of the contract against the City by a Superior
Court Judge was upheld by the Court of Appeals. The ruling was
that Mr. 'Jones' property is exempt from paying connection fees for
-sanitary sewer. Therefore, all properties contained within the
present Horizon Heights Additions No. 1 & 2 and all future Horizon
Heights- additions may not be charged sanitary sewer hookup fees. '
Mr. Jones ixoperty, however, is not exempt from payment of water
hapkup, fees7and the $15 sewer inspection fee may also be charged.
Please make a note of this exemption from payment of sanitary sewer
hookup fees when discussing hookup charges with prospective builders
.within the Ray Jones properties.
