The Board reviewed an identical request July 21, 1996 and granted the setback variance- however, Mr. Tracy did not exercise the variance within the allotted time because of financial considerations. After reviewing the issue, the Board unanimously approved a motion to grant the setback variance (Curtis/Snyder). Wooding Variance (406-418 30th St.) Mr. Wooding presented this request for a side-yard setback variance from 10 feet to 2 feet on the West property line of his building site along the Burlington Northern right-of-way (ROW). He plans tb construct a 50'X 220' pre-engineered steel building paralleling the property line. The area is zoned Heavy Manufacturing. Mr. Wooding proposes to construct three industrial buildings on the 2.4-acre tract as Phase 2 complementing the nearby completed Lake Erie Industrial Park, Phase 1. He explained that the angular West property line creates a hardship in maximizing building size (to tenant's needs) while providing adequate ground space for trailer truck accessibility, maneuverability, and parking; the latter needs were observed through experience in managing Phase 1 traffic flow. The buildings are targeted for single occupancy. Mr. Perkes, project designer, reviewed site/building dimensional details and how the requested setback relief is required. City Staff: Mr. Curtis (Fire Marshall) submitted some fire-safety needs which Mr. Perkes noted have been included in the project design. there were no other comments/objections. Discussion primarily addressed the visual impact of an expansive wall fronting the railway ROW as undesirable with the likelihood that the ROW will become a recreational pathway. The Board noted that the site plan allowed for a 15-foot required East side setback which could be an alternative setback encroachment to avoid the close proximity to the West side railway ROW. Mr. Wooding explained that this East side area has been retained as a potential vehicle parking area, although not designated as such in meeting Ordinance parking requirements; again, experience with parking needs in Phase 1 indicated this planning desirable. A motion to grant the requested variance was made (Curtis/Mehler) and passed with three ayes (Curtis, Wilson, Mehler), one nay(Snyder). Members present : John Curtis , Ken Wilson, George Mehler Staff present : Edwin Frank Minutes of July 6 , 1995 meeting were approved/passed (Wilson/Mehler) Tracy Variance ( 1217 37th St . ) Mr . Tracy reviewed this request for rear-yard setback variance from 20 feet to 8 feet for proposed construction of a 24 'X20 ' garage to the rear of a recently completed new home. Mr . Tracy stated that there is no platted alley serving this property for garage access , thus necessitating driveway access from street frontage. But , because of the relatively narrow 56-foot lot , garage placement is pretty much limited by vehicle maneuverability, with the proposed location considered optimal . An old, deteriorated garage formerly in this location was torn down during house construction. Mr . Tracy explained that he has been in constant communication with neighbors and sensitive to their concerns during this project . To this end, the proposed garage will be low-profile, less than 10 feet high. He also noted similar garage placements on other properties nearby in the alleyless Child-Hagadorn Addition. City Staff comments: Mr . Pemberton cited a driveway drainage problem, which has been addressed; there were no further comments/objections . There were no comments from adjacent property owners . A motion to grant the variance was made (Curtis/Wilson) and passed with all ayes . The Board considered that the applicant addressed the lot-size restriction reasonably in effort to minimize impact of the neighborhood. Eaton Variance (2615 W 3rd St . ) Mr . Eaton reviewed his request for 1 ) side-yard setback variance from 10 feet to 4 feet along undeveloped Baltimore Avenue and 2) rear-yard setback variance from 20 feet to 16 feet along the rear 14-foot alley, to construct a perimeter deck for his residence. Mr . Eaton explained that the proposed uncovered deck will be at first-floor level , ranging from 20" to 33" above grade. He also indicated that the ' steeply sloped platted 80-foot ROW Baltimore Avenue in this area would probably not be developed in the future. City Staff : no comments/or objections . Hearing dates are scheduled the first and third Thursday of each month. Appli- cations must be received by the Building Official not less than 10 days prior to the scheduled meeting day (not later than the Monday of the week preceding the meeting day) . Fee for the hearing is thirty-five dollars ($35.00) and must be paid at the time application is filed. x Provide ownership and property description as requested. The Skagit County As- sessors parcel number may be used for the legal description. Provide both if pos- sible. "Description of Variance Being Requested": State as accurately as possible what you are requesting and the purpose of the variance. Use additional paper if necessary. An example: "To reduce the front yard setback from 20 feet to 15 feet to allow construction of an entry deck and steps for an existing building." "Provisions of the Zoning Ordinance": Reference those sections of the Zoning Ordi- nance affecting your request. An example: "Part 17.04.04.9 f page 6 - Front yard requirements for the Residential Medium density Zone." List any other parts that apply. The counter person will help identify them. "Justification": This is the most important part of the application. Use as much space as necessary. Be accurate, clear and to the point. Site plan, elevation drawing and photographs are valuable information and should be included. The Board may reject an application if adequate and accurate information is not submitted. The Board of Adjustment is directed by ordinance to base its decision on the fol- lowing criteria. The argument for justification must address these points. 1. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same district; 2. That literal interpretation of the provisions of this ordinance would de- prive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this ordinance; 3. That the special conditions and circumstances do not result from the actions of the applicant; and 4. That granting the variance requested will not confer on the applicant any special privilege that is denied by this Ordinance to other lands, structures, or buildings in the same district. 5. Whenever a variance provides for or anticipates future construction, such construction must be commenced, or application made for a building permit, within 90 days from the date on which the variance was granted. An example: "The existing structure was constructed some 40 years ago. The building line is set 20'-0" from the front property line. No conforming use of neighboring lands, structures, or buildings in the same dis- trict, and no permitted use of lands, structures, or buildings in other districts shall be considered grounds for the issuance of a variance. The following steps are required for consideration of variance: 1. Notice of public hearing shall be given. Written notice shall be mailed to adjacent property owners, and if deemed necessary because of character of variance, the Administrator may expand the written notification area. 2. The Board of Adjustment shall obtain reports from all affected City boards or departments as part of the information to be considered at the public hearing. 3. The public hearing shall be held. Any part may appear in person, or by agent, or by attorney. 4. The Board of Adjustment shall make findings that all of the requirements of numbers one through five above are met. 5. The Board of Adjustment shall further make a finding that the reasons set forth in the application justify the granting of the variance, and that the variance is the minimum variance that will make possible the reasonable use of the land, building, or structure. Provide the names and mailing addresses of all abutting property owners. In- clude property directly abutting and directly across the street(s) and alley(s). The date of the hearing will be set at the time a complete application is received and fee paid. The normal meeting time is 7:30 p.m. in the Municipal Building Council Chambers. You will receive no other notification.
