HomeMy WebLinkAboutNotice of Application NOTICE OF APPLICATION With OPTIONAL DNS File Number: SPL-2020-0003 Applicant: Landed Gentry Development Inc. / Corner 9 Properties LLC.; Contact: Anna Nelson - anna@landedgentry.com Date of Application: May 7, 2020 Date of Complete Application: June 10, 2020 Date of Notice of Application: June 17, 2020 Project Location: South of the intersection of Cherry Lane and Orchard Ave. (Assessor Parcel # P32077) Application Type / Description: The applicant requests preliminary short subdivision approval, a conditional use permit, and SEPA review to subdivide approximately 3.12 acres in the R1 zone into 6 residential lots and 1 detention pond tract. A portion of the site is bisected by the Ace of Hearts Creek, a designated FWHCA. No changes to the area near the creek are proposed. The project includes a new public road and frontage improvements on Orchard Avenue. Other Required Project Permits/Approvals: The following may be required in addition to the above: Construction stormwater general permit from WADOE, construction plan approval, right-of-way permit, final land division approval, building permits. SEPA Review: The City of Anacortes has determined that this proposal is not likely to result in any significant adverse environmental impact, and that issuance of a Determination of Nonsignificance (DNS) is likely following the comment period for this notice. The optional DNS process of WAC 197-11-355 is being used for this proposal and includes the following: 1. This may be your only opportunity to comment on the environmental impacts of the proposal. 2. The proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. 3. A copy of the subsequent threshold determination for this proposal, once issued, may be obtained upon request. Existing Environmental Documents: The following environmental documents evaluate the proposed project: Critical areas assessment, Stormwater Site Plan, Geotechnical Report, SEPA checklist. Application documents may be reviewed at https://www.anacorteswa.gov/161/Planning-Community-Economic-Development by clicking “Notices of Application” and then opening the appropriate project file number folder. Public Comment Period: Written comments regarding the short subdivision, conditional use permit and SEPA must be submitted to the contact below by 5:00 PM on July 8, 2020. Any person may comment on the application, receive notice of and participate in any hearings, and request a copy of the decision, once made. Public Hearing: A public hearing is required to be held before the Planning Commission; the hearing has not yet been scheduled. A separate notice will be distributed once the public hearing has been scheduled. Preliminary Determination of Consistency: At a minimum, this project will be subject to the following plans and regulations: Anacortes Municipal Code Title 16 Tree Preservation, Title 18 Environmental Protection, Ch. 17.70 Critical Areas, Title 19 Unified Development Code Municipal Code, and the Anacortes Engineering Design Standards.
