In the R3 use zone, duplexes are listed as a permitted use with a minimum lot size of 7,500 square feet. Pursuant to 17.34.050 AMC, "units in a multi-family development of two or more units may be attached or detached, provided that the underlying property shall not be subdivided and sold separately unless the subdivided lots meet the setback, lot coverage, parking, and other requirements for the buildings thereon." In some cases, a property owner may decide to "condominiumize" a duplex as allowed consistent with the state Condominium Act (RCW 64.34); however, the Condominium Act does not invalidate or modify any provision of any zoning, subdivision, building code, or other real property use law, ordinance or regulation(RCW 64.34.050). Therefore, the condominium units are still subject to all applicable local zoning provisions. In the subject instance, the structure is an attached duplex, and the individual dwelling units could not meet minimum setback requirements if the underlying property were subdivided(since they are attached). The Planned Unit Development (PUD) provisions in the AMC provide for single family, multi-family and condominium development where an applicant may request the use of reduced zoning standards, such as zero-lot line units, through a public review process, including a public hearing;however, the subject duplex property has not undergone this process.
