Members present John Curtis, Ken Wilson, Charles Boubeau, George Mehler Staff present: Edwin Frank Minutes of October 7 were approved Qurkovich Variance (413 34th Street-1 Mr. Jurkovich reviewed this request to reduce rear-yard setback from ten feet to zero feet from an existing platted alley to construct a 40' X 74' boat building and repair building on a 60'X 100' lot in the Industrial District. Mr. Jurkovich explained that the boat service industry is flourishing and in high demand in Anacortes. However sites in the Industrial District to construct boat building and repair shop space is limited. The applicant proposes to build shop space on a small Industrial lot. He stated that compliance with Ordinance requirements is compromised by on-site parking requirements, optimum building size, and rear-yard setback requirement. The proposed building will be set back 26 feet from the front property line to provide the required on-site parking for five vehicles. That, with the 74-foot building length, leaves no provision for a rear-yard setback from the existing alley. Mr. Jurkovich stated that the alley will not be used as a service entrance to the building. A fenced industrial area is adjacent to the alley behind the proposed building site. The building will comply with the maximum 30-foot height limit. There were no comments/objections from City Staff; there was no input from adjacent property owners. Mr. Stent (?){506 35th Street}commented that the residential neighborhood near this Industrial area is a very difficult place to live—loud noise at 4AM emanating from a nearby truck hauling company, constant truck traffic noise from the badly maintained 34th Street, and astringent odors from a nearby boat building facility. The Board commented that his concerns should be brought to the attention of City Staff. Mr. Mehler noted that 34th Street is a platted 80-foot right-of-way and suggested the applicant obtain a 10-foot encroachment into 34th Street to supplement parking, thus providing a 10-foot rear setback, Mr. Frank commented that the applicant, as part of the project, will provide curb and sidewalk that will align with that already existing east of the property; also the full width of 34th Street should be maintained in this heavy industrial area. Mr. Curtis and Mr. Wilson supported the latter comment. A motion made (Wilson/Curtis) and passed with three ayes (Curtis, Wilson, Mehler), one nay (Boubeau) to grant the variance as requested. The Board determined that the small lot size created a hardship for the applicant to construct a needed service shop in the demanding boat industry. R & M, LLP Vacation (portion 29th Street, Anacortes Original Addition) Mr. Mansfield, representing R & M, LLP, reviewed this petition for vacation: the north 40 feet of undeveloped platted 29th Street 80-foot right-of-way adjacent to Lots 7— 12 Block 178 Anacortes Original Addition. Mr. Mehler mentioned that he was the owner of property in the area; he could hear this petition unbiased. The Board and Mr. Mansfield concurred. Mr. Mansfield explained that two building sites are proposed for Lots 7— 12 Block 178. Access to a Lot 11-12 site will be via 29th Street east from D Avenue; as well, this site requires the 30-foot frontage on an improved public street. This can be accomplished in three ways: 1) pave, curb, and sidewalk this section of 29th Street to the site, 2) obtain a City conditional use permit for a 30-foot extension of 29th Street from the Lot 11-12 site to D Avenue for D Avenue frontage, or 3) vacate a portion of 29th Street to D Avenue and incorporate the vacated area into Lot 11-12 to provide D Avenue frontage (as proposed in this petition). Discussions with City Staff favored the vacation (Option 3); Option 1, pave, curb, and sidewalk serving a single homesite would be costly. No building or other structureshall be built closer than 15 feet from the street right of way lines. B. Branko Jurkovich 608 Longview Avenue Anacortes, WA 98221 City of Anacortes Board of adjustment Re: Request for variance Oct. 13, 2004 Dear Board of Adjustment: 413 34th Street is a relatively small parcel situated in an industrial neighborhood that is highly desirable for boat building and repair. The current building proposal is for a 40' x 74' structure, 2960 square feet in total and less than 50% of the lot size. Current zoning for boat building and repair allows for up to 75% of maximum lot coverage in which the City may consider and approve lot coverage in excess of these percentages. (See Chapter 17.16 Industrial District Maximum Land Coverage 17.16.080). However, compliance with required setbacks to the rear/south side of the property, in addition to the required space dedicated to parking, conflicts with full utilization of the property and would result in a loss of 400 square feet, a size reduction of approximately 14%, ultimately a building that is less attractive and less accommodating to the boat building and repair industry because of its size. Because there are other preexisting structures and established landscape buffers within the same rear setback on the same alley way it appears that requiring a 10' set back for the proposed building will not improve the alley. By the same token, it also appears that granting a variance for a zero lot line adjustment thereby allowing construction of proposed building in the same location of the preexisting structure on the parcel would have no adverse effect on the current alley way either. Due to the fact that currently only a limited number of industrial sites are available for development, coupled with the growing needs and demands of the flourishing boat building industry for more and larger shop space, it seems that maximizing these properties to their highest and best use would benefit not only one of the leading industries in Anacortes but also have a positive impact on the job market in our community. In view of the above, it is hoped that the board of adjustment will strongly consider the growing needs of a flourishing boat building industry, recognize the intention to optimally accommodate those needs, as well as the desire to utilize an industrial property of limited availability to its highest and best use.
