8. NBFU No. 59 Standards of the National Board of
Fire Underwriters for the Storage
and Bandling of Liquefied Petroleum
Gases at Utility Gas Plants.
All State Rules and Regulations of the Washington Public
Service Commission applicable to Gas Public Utilities.
B. Provided, however, that in the event the standards
• embodied in state and federal laws and rules and regulations
are higher or in conflict with those contained in other
sources adopted by reference in this chapter, the state and
federal laws and rules and regulations shall govern; pro-
vided further, that in the event any provisions of this
chapter conflict with any of the provisions of other ordi-
nances of this city, the provisions of the ordinances con-
taining the highest standards shall be observed. (Ord. 1180
$32, 1956) .
15.16.390 Violation--Penalty. A. It is unlawful for
any person by any means to restore the flow of gas through
pipes which have been shut off either by the pipe supplying
the gas, or the gas inspector. It is unlawful for any per-
son, by any means to cause gas supplied by any utility com-
pany to bypass the meter by which the amount of gas supplied
by the utility company is measured and such acts shall be
prosecuted according to the terms contained in this chapter.
B. Any person, firm, or corporation that fails to
comply with or violate any of the provisions of this chapter
shall be deemed guilty of a misdemeanor and upon conviction
thereof shall be fined in an amount not exceeding one hundred
dollars, or imprisonment in the city jail not exceeding
thirty days, or by both such fine or imprisonment. (Ord.
1180 S31, 1956) .

15:20.010 Definitions. For the purpose of this chapter,
the following definitions shall apply:
A. "Alley" means a public thoroughfare or way having a
width of not more than twenty feet which affords only secon-
dary means of access to abutting properties.
B. "Alley improvement" means the drainage, grading and
pavement facilities required to improve the alley to city
design standards.
C. "Building" means a structure as defined in this sec-
tion. When separated by division walls without openings,
each portion so separated shall be considered a separate
building.
D. "City design standards" means the construction and
design standards specified in Title 16. -
E. "Primary use" means the use for which a lot, struc-
ture, or building, or the major portion thereof, is designed
or actually employed.
F. "Public works director" means the person appointed
by the city manager to direct the public works department,
or his designee.
G. "Right-of-way" means the public property used or
reserved for municipal purposes including all public utili-
ties and street usages.
H. "Street" means all or any portion of the city pub-
lic road network open to the public for travel with exception
of alleys and limited access highways designated as state
highways.
I. "Structure" means a combination of materials con-
structed or erected which has permanent location on the ground
or attached to something having permanent location on the
ground, not to include fences less than six feet high, or
paved areas.
- _ - J. "Undeveloped platted road or streets means those
roads and streets indicated on the map attached to the ordi-
nance codified in this chapter.
A. "Zone" means various zones as set forth in the city
zoning ordinance as now in effect or hereinafter amended.

15.20.020 Permit issuance--Commercial property_ improve-
ments. No building permit shall be issued by the city for
construction of any new building or structure, or for the
addition, alteration, or repair within a twelve-month period
the cost of which exceeds fifty percent of the current market
value of the existing building or structure on the property
which is located in a commercial (C) , commercial marine (CM) ,
• central business district (CBD) , heavy manufacturing (HM) ,
light manufacturing (LM) , residential high density (RH) , resi-
dential high density two (RH 2) , or residential high density
Two (A) (RH2-A) zone unless and until improvements are made
to the public streets and alleys and storm sewer system in

accordance with and to the extent required by city design
standards. (Ord. 1954 52(A) , 1984: Ord. 1857 52(A) , 1981) .
15.20.030 Development of platted roads, streets and
alleys. A. The development and construction of undeveloped
platted or newly dedicated roads, streets or alleys shall
conform to all construction, design, and development Stan-
' dards contained in the Anacortes Subdivision Code as estab-
lished by Ordinance No. 1805 adopted on the 3rd day of Dec-
ember, 1979, or as modified by subsequent ordinances.
B. All improvements required under this section shall
be extended as necessary to provide a smooth transition with
existing improvements both laterally across the street and
longitudinally up and down the street for drainage, vehicular
and pedestrian traffic. (Ord. 1954 52(B) , 1984) .
15.20.040 Public street developments. In areas where a
street, road or alley providing access to a building site is
developed in accordance with city standards but only on the
side of the street not abutting the building site, no build-
ing permit shall be issued for the construction of any build-
ings or structures on said building site until the public
street for the undeveloped portion of the street immediately
adjacent to the building site is developed to match the im-
provements on the portion of the street which is developed,
in accordance with standards and specifications as provided
by city ordinances. (Ord. 1954 521C) , 1984: Ord. 1857 52
(C) , 1981) .
15.20.050 Public streets, alleys and storm sewer system
improvements. No building permit shall be issued or site
development approved for the construction of any building(s)
or structure(s) , where said building sites abut an existing
arterial street as defined by the Functional Classification
System Map, unless and until the public streets and alleys
and the storm sewer system abutting said property shall be
improved in accordance with city design standards; and, pro-
vided further, that upon application for a building permit to
construct a single-family or duplex residential structure the
director of public works may waive all or a portion of the
construction of improvements required in this chapter by autho-
rizing execution of a power of attorney and covenant not to
oppose establishment of a local improvement district to con-
struct said improvements required. The power of attorney and
covenant not to oppose establishment of a local improvement
district shall be on forms approved by the city attorney,
shall be executed by all persons having an interest in the
property for which application for a building permit is being
made and shall constitute a covenant running with the land
and be binding on future owners of said land. (Ord. 1954

15.20.060 Requirements waiver--Conditions. The City
Council, upon proper application thereto, may waive all or a
portion of the requirements that improvements be constructed
to city design standards by authorizing an agreement requir-
ing construction of those improvements necessary to meet city
design standards and the execution of a power of attorney and
covenant authorizing establishment of a local improvement
district to construct that portion of a necessary improvements
to meet city design standards which is not feasible to immedi-
ately construct, when one or more of the following situations
exist:
A. When no adequate storm drainage trunk system exists
in the vicinity of the site on which the improvements are
being made in which to direct the flow of the required storm
sewer collector system; and/or
B. When requiring full width paving of streets abutting
said area being developed would create a traffic hazard due
to transitions to adjacent narrower paved services; and/or
C. Where substantial likelihood exists that the improve-
ments required, if placed at the time of granting of the
building permit or the making of the improvement will have to
be removed or substantially modified because of additional
potential development in the area. (Ord. 1954 5(E) , 1984) .

number 2169 repealing transportation benefit area number 1 .
On February 6 , 1989 you payed a transportation impact fee of
$2 , 600 for your building at 401 34th Street. Please find
inclosed a refund check for that fee.

Re: Transportation Benefit Area Impact Fee
It is my opinion, after reviewing the various ordinances
involved, that a refund of monies paid as part of the
Transportation Benefit District which was disolved should include
any interest earned on those funds. Although the ordinances are
not specific on this, it would appear that by repealing the
ordinance we have also repealed the existence of the fund and
hence we should close the entire fund out.

Thomas O"Brien was the only one to pay into this fund.
Since the fund has been discontinued, I have requested
finance to refund his money together with accumulated
interest . Mr Khatain would like to know where in law he has
authorization to include the interest with the refund.
For your information, I am including the memo to Kay
Schroder requesting the refund. Would you please advise us
whether or not the accumulated interest must be returned to
Mr . O:Brien.

I recieved a letter dated June 9, 1990 from Edwin Franks concern-
ing a commercial building I own at 401 34th Street. The letter
lists three items to be completed before a Certificate of Oc-
cupancy may be issued.
There is no problem complying with the first two items, even
though the second one dealing with wheel stops had not been men-
tioned before. It had already been discussed with the building
tenants and was going to be done.
The problem lies with the third item, which requires that I com-
plete the paving between the new curb and gutter and the existing
paving on 34 th Street and V Avenue's. A meeting was held at the
building site on June 23, 1990 between myself, Mr. Enders
(contractor), Mr. McGoffin (Mr . Enders Attorney), Mr . Shultz (My
Attorney) , and Lyle from the City of Anacortes Engineering
department. At this meeting the City representative assured us?
that the only requirement as far as his department was concerned . 1
was to finish the curb, gutters, and sidewalk according to City p
plans.
It has cost me a considerable sum of money to install storm
sewers under 34th street, voluntarily across to 35th along V
Avenue, and the sidewalks curbs and gutters. I would deeply ap-
preciate your looking over this matter for me and letting me know
where you and city stand on this matter. I have tried to work
with the City through this whole project and hope we can come to
an amiable solution without litigation.

of the Transportation Development fee that is to be applied to all new structures
in the Heavy Manufacturing District east of Commercial Ave. The terms of the
ordinance state that a fee of $0.50/sq. ft. of building area be assessed against
each new building in this zone. Payment or arrangements for time payment is to
be made at the time that the building permit is issued. The fee calculated for
your building is $2,600. Due to the oversite, arrangements for payment of the r
fee must be made prior to occupancy of the building.

The building is 40 ft x 130 ft. and 20 ft. high.
Construction bracing had been removed for placement
of floor slab and during a recent wind storm was blown
down.
Very few of the trusses are severely damaged. We
agreed to replace the severely damaged trusses and
the wall section also. When this is done the building
will be as good as it was designed to be and I am sure the
' Building Department will agree.

I am, therefore, requesting that before the trusses are reset we receive from the
engineer documentation indicating how the damaged trusses have been marked for
identification and the number of trusses that were damaged.
Site inspection also revealed that the connection between the wall system and the
foundation is not as designed. The mud sill, the top of which is flush with the
top of the poured slab appers to be bolted as designed. The question comes from
the attachment of the bottom plate of the wall to the mud sill. This attachment
is by 16-penny nails placed between 24-30" on center with little or no possibility
of additional connection of the wall structure to the mud sill. I am, therefore,
requesting that the engineer review this for wind and earthquake design and suggest
corrections in accordance with provisions of the Uniform Building Code. This written
information should be submitted to the Building Dept. before inspection of the framing
and the documents must bear the seal and signature of the structural engineer.

22� Chapter 6 of the Washington State Energy Code sets the minimum insulation
for a commercial building less than 10,000 sq. ft. at: Ceiling R-30 minimum,
walls R-11 minimum, slab perimeter insulation R-8 minimum. This chapter also
refers to requirements in Chapter 4 regulating heat system design, lighting use
and water heating system requirements. Review these sections and provide cal-
culations and plans showing how you plan to satisfy these requirements.
13. The minimum number, location, and size of fire extinguishers will be designated
by the Fire Marshall in accordance with the fire code.
14. Provide new site plans reflecting changes made to satisfy the site plan review.
Show also a north-south section and an east-west section thru the lot including
driveway and street grades and any build-up of grades from existing grades.
Provide a floor drain with oil and sand separator, in the work area. This is
to prevent gas, oil and other objectionable materials from entering the sewer system.

16. Submit the above information with corrected plans for review. All applicable
provisions of the 1985 edition of the Uniform Building Code, the Uniform Plumbing

The site plan review committee today reviewed this project. Members
present were: Dave Ford, Jim Pemberton, Doug Terry and Ed Frank. The
following comments and requirements are noted:
1. The site plan is drawn to a reasonable scale, showing most dimensions
necessary for calculating land coverage.
2. The location of property lines appear to be OK as shown.
3. Setbacks required by the zoning ordinance are met or exceeded.
4. Building location and height meet zoning requirements. See Number 10
below.
5. Type of construction shown is type V non rated. A plan check for the
building will be completed about 2 weeks after the site plan is approved,
including Industrial Discharge Permit, paving requirements, storm sewer,
curb, gutter and sidewalks, parking layout, etc.
6. Number of units shown is 3.
7. No easements of record are shown.
8. Landscaping shown appears to be adequate. Plantings and grading
along the street property line are to be kept low so not to restrict
sight distance from any vehicle at any intersection of roads or road and
driveway. Provide more information.
9. No signs are shown.
10. 12 parking spaces are shown. Based on the tenant use indicated, 20
parking spaces are required. At least one parking stall shall be set
aside for the disabled and be so marked and signed. Parking stalls shall
be striped and provided with wheel stops. A 3-foot wide sidewalk raised
6" shall be placed between the building and driveway. Also, Engineering
standards requires at least 44'6" for parking and driveway when 90°
parking is used. This plan shows 37 feet from the required sidewalk to
the property line. Provide the required area and number of parking
stalls.
11. The location and size of driveways is OK as shown.
12. The size of solid waste containers is not called out. The location
shown is OK. Solid waste containers are to be placed on a 6-inch thick
concrete pad. See the attached for minimum dimensions.

13. The location of proposed curbs and gutter, width and location of
sidewalk as submitted is OK except a wheel chair ramp is required at the
northeast intersection. Provide proposed construction design details for
review and approval before beginning construction.
14. The proposed 18" storm sewer along 34th Street and along "V" avenue
from 34th Street to the south side of the alley is OK. Provide
construction design for approval prior to beginning construction. On
site catch basin locations are OK. The last down stream catch basin is
to be provided with an oil/water separator. Provide a catch basin at the
intersection of 34th and V and not in front of the wheel chair ramp.
15. Location of existing water main and meter is shown. Back flow
preventers are required on all hose connections.
16. The location of the existing sanitary sewer is shown. A sampling
manhole is required. Check with Mike Foster (293-1921) for size and
location requirements. Complete and return the enclosed Industrial
Discharge Permit prior to obtaining a Building Permit.
17. Does not apply.
18. Existing zoning is Heavy Manufacturing.
19. Existing topography is shown. Cross sections through the lot showing
