Curtis Wharf is located at the corner of 2nd Street and 0 Avenue and adjacent to the south shore of Guemes Channel. Curtis Wharf is primarily used as a working wharf and dock for commercial vessels. We have obtained appropriate permits from the US Army Corps of Engineers,Washington State Department of Fish and Wildlife, and a Shoreline Exemption from the City of Anacortes (all permits included in this application package). The proposed maintenance and corrosion protection work involves recoating and protecting 169 galvanized steel piles by 1) installing a protective dielectric coating to the surfaces of the steel piles between low tide and, at a minimum, 1 foot above the splash zone and 2) installing a cathodic protection system to provide corrosion control to submerged metallic surfaces. Additionally,the project includes maintenance and repair work to timber portions of Curtis Wharf.There are up to 88 timber piles requiring repairs.This work will be performed in three phases: Phase I—southwest steel pile corrosion and timber pile repairs, Phase II—mid-pier steel pile corrosion and east section timber pile repairs and Phase Ill—northeast steel pile corrosion repairs and full wharf impressed current cathodic protection system installation. The Port of Anacortes requires this work due to corrosion of steel pilings and deterioration of timber dock sections at Curtis Wharf from continuous exposure to the marine environment. Further corrosion will lead to exposed steel pilings and timber deterioration that could structurally damage Curtis Wharf.The work is required for tenant use,to extend the wharf's service life, and to eliminate structural safety hazards. Page 1 of 3 SHORELINE ENVIRONMENT/DESIGNATION: The project site lies in the City of Anacortes's 2010 Shoreline Master Program's "Aquatic" shoreline environment/designation. STATE ENVIRONMENTAL POLICY ACT(SERA): The Port of Anacortes acting as SEPA lead agency has determined that the proposed maintenance and repair activities to Curtis Wharf are exempt from SEPA environmental review per WAC 197.11.800(3). li. FINDINGS OF FACT AND CONCLUSIONS OF LAW: 1. According to the City of Anacortes's 2010 Shoreline Master Program (SMP) Section 5.12, Table 5,1, both water dependent industrial and port facilities along with public and private docks, piers, and floats are permitted outright in the "Aquatic" shoreline environment/designation. The subject proposal will be consistent with the policies and provisions of the Shoreline Management Act and the 2010, City of Anacortes's Shoreline Master Plan. 2. According to AMC 17.17.020, permitted uses include "Manufacturing, storing, and shipment of goods, research and development, offices, maritime administration and public meeting space, building and repair of boats and ships, boat and marine equipment sales and services, public parks, piers, wharfs, dry docks and related facilities, commercial parking, private parking, and public parking." The proposed maintenance and repair activities are to Curtis Wharf. The existing and proposed uses at Curtis Wharf are consistent with section 17.17,020 of Chapter 17.17 regulating the Commercial Marine Zoning District within the City of Anacortes. 3. The project is exempt from the requirement to obtain a Shoreline Substantial Development Permit (SSDP) pursuant to WAC 173.27.040(2)(b) —"Normal maintenance or repair of existing structures or developments, including damage by accident,fire or elements. "Normal maintenance"includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair" means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size,shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment." If the likely cause of the fish kill or fish distress is related to water quality, also notify the Washington Military Department Emergency Management Division at 1-800-258-5990.Activities related to the fish kill or fish distress must not resume until the Washington Department of Fish and Wildlife gives approval. The Washington Department of Fish and Wildlife may require additional measures to mitigate impacts. STAGING, JOB SITE ACCESS AND EQUIPMENT 5. Establish the staging area (used for activities such as equipment storage, vehicle storage, fueling, servicing, and hazardous material storage) in a location and manner that will prevent contaminants like petroleum products, hydraulic fluid, fresh concrete, sediments, sediment-laden water, chemicals, or any other toxic or harmful materials from entering waters of the state. 6. Confine the use of equipment to specific access and work corridor shown in the approved plans. 7. Check equipment daily for leaks and complete any required repairs before using the equipment in or near the water. 8. Lubricants composed of biodegradable base oils such as vegetable oils, synthetic esters, and polyalkylene glycols are recommended for use in equipment operated in or near water. 9. Operate vessels with minimal propulsion power to avoid prop scour damage to the bed and marine vegetation habitats. 10. Do not deploy anchors or spuds in seagrass or kelp. CONSTRUCTION-RELATED SEDIMENT, EROSION AND POLLUTION CONTAINMENT 11. Prevent contaminants from the project, such as petroleum products, hydraulic fluid, fresh concrete, sediments, sediment-laden water, chemicals, or any other toxic or harmful materials, from entering or leaching into waters of the state. 12. Use tarps or other methods to prevent treated wood, sawdust, trimmings, drill shavings and other debris from contacting the bed or waters of the state. CONSTRUCTION MATERIALS 13. Do not use wood treated with oil-type preservative (creosote, pentachlorophenol)in any hydraulic project. Wood treated with waterborne preservative chemicals (ACZA,ACQ) may be used if the Western Wood Preservers Institute has approved the waterborne chemical for use in the aquatic environment. The manufacturer must follow the Western Wood Preservers Institute guidelines and the best management practices to minimize the preservative migrating from treated wood into aquatic environments. To minimize leaching, wood treated with a preservative by someone other than a manufacturer must follow the field treating guidelines. These guidelines and best management practices are available at www.wwpinstitute.org. PILING CATHODIC PROTECTION 14. Install dielectric coating to the surfaces of the steel piles between low tide, and at a minimum, 1 foot above the splash zone. 15. Install impressed current cathodic protective system to provide external corrosion control to all submerged metallic surfaces. TIMBER PILE REPAIRS Eelgrass must not be affected by the piling repair work. We have obtained appropriate permits from the US Army Corps of Engineers, WDFW, and a Shoreline Exemption from the City of Anacortes (all permits included in this application package). The proposed maintenance and corrosion protection work involves recoating and protecting 169 galvanized steel piles by 1) installing a protective dielectric coating to the surfaces of the steel piles between low tide and, at a minimum, 1 foot above the splash zone and 2) installing a cathodic protection system to provide corrosion control to submerged metallic surfaces. Additionally, the project includes maintenance and repair work to timber portions of Curtis Wharf. There are up to 88 timber piles requiring repairs.This work will be performed in three phases: Phase I—southwest steel pile corrosion and timber pile repairs, Phase II—mid-pier steel pile corrosion and east section timber pile repairs and Phase Ill—northeast steel pile corrosion repairs and full wharf impressed current cathodic protection system installation. The Port of Anacortes requires this work due to corrosion of steel pilings and deterioration of timber dock sections at Curtis Wharf from continuous exposure to the marine environment. Further corrosion will lead to exposed steel pilings and timber deterioration that could structurally damage Curtis Wharf. The work is required for tenant use, to extend the wharf's service life and to eliminate structural safety hazards. With work planned in three phases, we request that the Building Permit expiration date be the same or later than our Army Corps of Engineers permit (3/18/2023).
