Will need to install a water meter service at 29th Street and D Avenue, off of the existing 8-inch water main. This Lot will have a long service. If and when the adjacent subdivision, Jacobs Meadow, moves to construction, the water service can be moved to a new location at that time. Fire Coverage: • P56138: Does have fire coverage. • When the adjacent property to the east submits a building permit, they are required to install hydrant on 29th Street at the end of the existing 8-inch water main. NATURE OF APPLICATION A. Request The applicant is requesting short subdivision approval of a three (3) lot short subdivision of approximately 0.57-acres(28,848 SF)in the R2 zoning district. B. Project Chronology/Background The application was determined to be complete on February 15, 2013; public notice of the application was provided consistent with Section 16.08.031 AMC. C. Site Location/Description The site is generally located in the SE %a of the SW '/a of Section 24, Township 35, Range 01 East, at the SW corner of intersection of 29th Place and former E Avenue ROW. The property consists of one tax parcel comprised of lots 13 through 16 of Block 15 of the "Pleasant Slope Addition"and portions of vacated E Avenue and vacated 29th Street(Ord.2883). The site is undeveloped and vegetated primarily with deciduous trees, brush and groundcover. The site slopes slightly toward the northeast. The property is bounded by 29th Place and an undeveloped alley to the north, a single family home to the east, undeveloped property to the south, and undeveloped right-of-way and a vacant property to the west. D. Site and Adjacent Zoning/Uses The subject site and surrounding properties are zoned R2. Surrounding areas are residentially developed. II. PROJECT CONSISTENCY WITH TITLE 16 AMC,SUBDIVISIONS A. Chapter 16.08 AMC,Short Subdivisions and Short Plats The administrative official (Director of Planning, Community and Economic Development) or his or her designee is granted the authority to approve or disapprove proposed short subdivisions in accordance with Title 16. The applicant has submitted all necessary application materials as outlined in this section and proper notice was given pursuant to 16.08.031 AMC. The proposal is exempt from SEPA requirements pursuant to 16.08.010 AMC. Section 16.08.032 AMC requires that short subdivisions comply with development standards for standard subdivisions (Chapter 16.20, Design and Improvement Standards). Consistency with these standards is discussed below. B. Chapter 16.20 AMC,Design and Improvement Standards Section 16.20.010 AMC requires that the design and development of subdivisions preserve the natural terrain, vegetation, drainage patterns and existing topsoil to the greatest extent possible. There is no clearing or grading proposed as part of the short subdivision application. A clearing and grading plan is required to be submitted with individual building permit applications and 2of7 m' reviewed for consistency with applicable regulations prior to construction taking place on the lots. Section 16.20.020 AMC contains standards for development of land found to be unsuitable for subdivision due to potential hazards. No potential hazards as listed in this section have been identified through the review process. Section 16.20.030 AMC contains standards for design of engineering plans for public improvements and other subdivision elements. The Public Works Department has determined that all public improvements necessary for the proposed development have previously been installed, or will be installed as a condition of approval. Sections 16.20.040 and .050 AMC contain standards for lot and block configuration; the proposed short subdivision will comply with the applicable standards. Section 16.20.060 AMC contains standards for street design and construction. Two lots are proposed to be accessed from 29th Place/E Ave., which is improved to City standards. One lot is proposed to access from 29th Street which abuts the site to the west; access would be developed to standards required by the Public Works and Fire departments. Section 16.20.070 AMC contains standards for grading and drainage. The applicant will be required to provide plans addressing stormwater, and clearing and grading, as required by the Public Works and Building Departments, prior to commencement of construction activities for individual lots. Sections 16.20.080 and .090 AMC contain standards for utilities and easements. The Public Works Department has indicated that City public utilities needed to serve the site are in place. Individual utility services may need to be installed for individual lots. New utilities are required to be placed underground. Where practical, easements have been located along rear and side lot lines. Section 16.20.100 AMC contains requirements for park land. Park impact fees will be payable at time of building permit issuance for each lot. Section 16.20.110 AMC contains standards for landscaping and a tree preservation plan. A landscape plan consistent with Section 17.41.020 AMC and a tree preservation plan consistent with Chapter 16.50 will be required to be submitted for review and approval at the time of building peiuiit for each lot. C. Chapter 16.50 AMC, Tree Preservation Applications for subdivision of residential land are required to submit a tree preservation plan consistent with the requirements outlined in this chapter. A tree preservation plan consistent with AMC Section 16.50 shall be provided for review and approval prior to building permit issuance for each lot. III. PROJECT CONSISTENCY WITH APPLICABLE ZONING REGULATIONS A. Chapter 17.05 AMC, Concurrency The Public Works Director has confirmed that, as conditioned, the level of service for transportation, water, and sewer can be provided for this proposal, either with existing infrastructure, or that within the capital facilities plan, financed by system development charges. 3of7 Additionally, the City has adopted impact fees for transportation, park, and fire facility improvements which adequately address the development's impacts on these facilities. B. Chapter 17.36 AMC,Residential District(R2) The minimum lot size for single family residences in the R2 zone is 7,500 square feet. Each of the proposed lots exceeds this requirement (ranging from 7,515 SF to 9,323 SF). The proposed density is consistent with that which is permitted in the R2 district (four dwelling units per gross acre): 0.68 gross acres x 4 du/ac=2.72 or 3 dwelling units allowed. Consistency with building coverage, height, setbacks, and parking requirements, etc. will be reviewed at time of individual building permit application for each lot. C. Chapter 17.41 AMC,Landscapinff Pursuant to 17.41.020.G AMC, subdivisions in the R2 zone are required to have a minimum of 20%the gross site area landscaped. Consistency with landscaping requirements will be reviewed at time of individual building permit application for each lot. D. Chapter 17.46 AMC,Parkink A minimum of two off-street parking spaces is required for each detached single family residence. Consistency with parking requirements will be reviewed at time of individual building permit application for each lot. Due to property and road frontage configuration which results in minimal available on-street parking along the property frontage, a condition of approval is the provision of two additional off-street parking spaces for each lot, in addition to the minimum required per 17.46 AMC. IV. PROJECT CONSISTENCY WITH 2012 COMPREHENSIVE PLAN The 2012 City of Anacortes Comprehensive Plan designates the project site as R2. The goals and policies outlined in the Comprehensive Plan are intended to provide guidance for both public and private decision makers in future growth and development of the City. Development goals and policies pertinent to the request are as follows: GMA Goals 1, 2,4& 12; General City Goals 1 &3;Housing/Residential Goals 1, 3, &7. V. PUBLIC COMMENTS As of the date of this report, multiple written comments have been received regarding the application. The comments primarily focused on the following summarized issues: development fit with existing community appearance, traffic and parking impact, lot access, consistency with code requirements. In response to comments received, the applicant has proposed the establishment of private covenants and restrictions governing the development of the proposed lots and revised the layout to reduce the number of lots accessing from 29 ' Place/E Ave. from three to two. The provision of additional off-street parking is a condition of approval. The proposal has been reviewed by appropriate staff from the Public Works, Fire, Building, Planning and other departments; based on this review, staff has concluded that the proposal complies with applicable standards for access and other code requirements. 4of7 VI. CONCLUSIONS OF LAW-APPROVAL CRITERIA Pursuant to AMC 16.08.030.B,if the administrator finds that the proposed short plat is consistent with the Comprehensive Plan; SEPA requirements, and zoning requirements for the district, and that there is adequate provision for drainage, sewage disposal, water supply and access for each lot, that requirements of this title are met, and the short plat would not landlock other parcels he or she shall approve the application. Conclusion: Based on the above analysis, and as conditioned, the short subdivision application is consistent with the Comprehensive Plan and zoning requirements for the district, and is exempt from SEPA requirements. Existing public water, sewer and stormwater facilities have been deemed adequate to serve the proposed development and provisions for connections to these public systems will be made at time of building permit. Access to the lots is available from 29th Street and 29`h Place/E Ave., and the short plat will not landlock other parcels. RCW 58.17.060 provides the following criteria for approval of a subdivision: (a) Appropriate provisions are made for he public health, safety, and general welfare and for such open spaces,drainage ways, streets or roads, alleys, other public ways,transit stops, potable water supplies, sanitary wastes,parks and recreation,playgrounds, schools and schoolgrounds and all other relevant facts,including sidewalks and other planning features that will assure safe walking conditions for students who only walk to and from school; (b) The public use and interest will be served by the platting of such subdivision. Conclusion: As conditioned, appropriate provisions are made for the items enumerated in RCW 58.17.060. The City has designated the property for single family use in the Land Use Element of the Anacortes Comprehensive Plan and zoned the site R2, indicating there is a public need. It serves the public interest to develop the property as a single family short subdivision in conformance with those land use and zoning standards. The standards of the City's Subdivision Ordinance are further City standards for what meets the public use and interest in the City; the proposed short subdivision conforms to all these standards. Additionally, the proposed short subdivision meets the minimum requirements of the Anacortes Municipal Code, which are designated as the official standards for public health, safety and general welfare. VII. DECISION Based on the foregoing Findings of Facts and Conclusions of Law, the Subdivision Administrator hereby grants approval of the proposed three-lot short subdivision, subject to the following conditions: 1. Preliminary short subdivision approval authorizes the applicant to proceed with application for necessary permits to construct required improvements and to prepare construction drawings in accordance with the determinations made and conditions imposed. The scope of this permit is not to exceed that as set out in the short subdivision application and preliminary short plat map(Attachment A). 5 of 7 J 2. Clearing limits on Lots 1 &2 shall be setback 15 feet from the south property line of said lots and a fence installed constructed out of materials that are substantially similar to those used on the abutting lots to the east (Ord. 2883). A note to this effect shall be recorded on the final plat map. 3. Prior to building permit issuance for each lot, the applicant shall submit for review and approval, a landscaping plan consistent with the requirements outlined in Chapter 17.41, Landscaping Requirements,and Chapter 16.50—Tree Preservation. A note to this effect shall be recorded on the final plat map. 4. 29t1i Street shall be developed to standards determined by the Public Works and Fire Departments and, if applicable, a commitment of non-opposition to any local improvement district shall be submitted to the short plat administrator prior to final short plat approval. Lot 2 shall be responsible for maintenance of the access on 29th Street until such time 29i1i Streetis developed to full city standards,or as otherwise approved by the Public Works Department. A note to this effect shall be recorded on the final short plat map. 5. Lot access and fire protection measures shall be developed to meet Fire and Public Works Department standards, including provision of a residential sprinkler system for proposed lot 2, if required by the Fire Department. In addition to that required under Section 17.46 AMC, two additional off street parking spaces shall be provided for each lot as required by the Planning Department. The lots in this short subdivision are subject to applicable water, sewer, and stormwater general facility and hookup fees and transportation, fire, and park impact fees. These fees are payable at levels in effect at the time of building permit issuance and may differ from those fee levels currently in effect; sewer and water latecomer charges may be payable. A note to this effect shall be recorded on the final plat map.
