Variance request at 1717 25t°Court to reduce rear yard setback to 3 feet to construct a new deck. BOARD OF ADJUSTMENT MINUTES - JULY 6, 2000 REGULAR MEETING Meeting called to order by Chairman Brad Snyder at 7:00PM. Members present: Brad Snyder, Tom Slocum, George Mehler Staff present: Ed Frank Approval of Minutes of the June 1, 2000 meeting was deferred to the July meeting. Seacrest LLC Variance Clarification (628 Hillcrest Drivel Mr. Frank stated that he had received questions about the height and size of pillars erected in conjunction with the solid wall constructed along Oakes Avenue adjacent to the Seacrest residential development; the pillars are about two foot square and extend roughly six inches above the wall. The Board had granted a variance at the May 4, 2000 meeting allowing a 4-foot solid wall at this site to shield residences from traffic noise of the heavily traveled Oakes Avenue. Pillar construction, as such, was not specifically addressed in the variance. Mr. Snyder, who originally made the motion for the variance, stated that it was his intent that the four-foot height applied to the entire wall structure—wall and pillars; Board members concurred. The Zoning Ordinance makes no distinction between the height of a fence/wall and the supporting posts/pillars. For clarification, the Board queried Mr. Frank about City Staff interpretation of fence height. He indicated that Staff customarily allows supporting posts to exceed the height of the fence up to six inches as this greatly improves the appearance of the fence design by avoiding a constant height structure. He noted, however, that the fence supports encountered have been 4"X4" (at the most 6"X6") posts which are unobtrusive in context with the total fence. In the case of the Seacrest wall, Staff applied the same logic not realizing the size or the visual impact of the pillars on the Seacrest wall. Mr. Cox, representing Seacrest LLC, stated that the pillars, spaced about eighteen feet apart, were installed specifically for the purpose cited by Mr. Frank, to provide an attractive wall design. A motion was made (Snyder/Slocum) and passed to augment the 4-foot solid wall height variance granted May 4 to allow solid pillars not to exceed six inches above the wall. The Board noted that this is an extension, however extreme, of a common practice Staff uses in dealing with fences and was unfortunately not discussed in the original variance review. Aguilar Variance (1802 36th Streetl Mr. Aguilar reviewed this request for variances in side-yard and rear-yard setbacks from five feet to three feet to construct a deck in his residence rear yard that is more than 18 inches but not exceeding 30 inches above grade. Mr. Aguilar explained that the ground slopes such that optimum placement of the planned deck has the west side at or below ground level with the east side above grade approaching 30 inches at the southeast corner. The deck will be configured with three levels because of the grade and will include a hot tub. To have adequate spacing around the hot tub, the portion of the deck adjacent to the tub will encroach the side-yard setback; the remaining setback encroachment minimizes yard dead space below the deck yet provides space for a 3-foot walkway There were no City Staff comments/objections. Mr. Aguilar stated that adjacent neighbors indicated no objections to the project but an unsigned memo from a neighbor cited a loss in his privacy by the elevated deck and that the large deck will overcrowd the rear property of the Aguilar residence. A motion was made (Mehler/Slocum) to grant the requested side-yard and rear-yard variances and passed with two ayes (Mehler, Slocum), one nay (Snyder). The Board reasoned that the setback encroachments benefited the applicant with little impact on the neighborhood. I e 2. Business Because of a rash of fencing problems recently, the Board strongly suggested that Mr. Frank discuss with Staff(1) reinstitution of a modified fence permit process in which Staff advises applicants of Ordinance requirements for fences and makes an on-site determination of property lines; a survey would be required only if property lines can not be reasonably ascertained and (2) address the specifics of fence posts/pillars in the fence/Wall section of the Zoning Ordinance.
