DATE APPLICATION FILED: April 15, 2004 DATE OF HEARING: June 17, 2004 DECISION After review and hearing on the application in accordance with applicable provisions of the Zoning Ordinance the Board finds that: Reduction of the required front yard to accommodate the stated needs of the tenant is justified under the provisions of the American with Disabilities Act. In accordance with the above findings the application is granted. In granting the application the board prescribes the following conditions which must be met. The shelter must be removed when the tenant vacates the rental unit. At the request of Mr. Glen King this matter is continued to August 5th, 2004. 500 I Avenue—Request for a sign variance to install an electronic reader board for the Guemes Ferry terminal. Mr. Steve Cox, Skagit County Public Works Ferry Operations manager introduced the request and explained the need for the reader board. The ferry operations will increase the number of trips per hour. The sign will inform passengers and crew as to the departure time. Mr. Steve Flude, Assistant Skagit County Public Works Director, discussed schedule needs worked out with island residents and Public Works personnel. After discussion Mr. Snyder moved, Second by Mr. Coatney, that a sign as described in the application no more than 3 feet by 6 feet and not more than 12 feet high be placed at the west side of the holding area in the area of the existing fire hydrant and no parking area. Mr. Stephen Jaffray spoke to the need for the shelter. Ms. Janice Horton spoke to her needs and how the shelter will be used. The board reviewed a letter from Mr. Frank Penwell indicating concern that the shelter might become permanent. After discussion Mr. Snyder moved, Second by Mr. Curtis, that the variance be granted as requested and that the structure be removed when the current tenant vacates the tenant space. Motion Carried unanimously. With no further business the meeting was adjourned. I am very sensitive to handicap people. For example,I am on the Board, and I am an active worker, for Camp Horizon in Blaine. Our yearly camps are run only for the handicap_ Also,years ago I built a handicap bathroom for free for Jerry Nash(a stranger to me,but a person in need)_ The City of Anacortes even donated the building permit to the Nash's. Anyway, I have looked over the plans and I have also talked to several neighbors to get some input and feelings. While I am empathetic,I am still against the variance because: • The proposed request is a request of convenience and comfort,rather than need. In talking to neighbors, I have been told she is in a wheel chair and missing her legs. We are told the tenant gets around easily by herself. I have been told the tenant is very busy with teaching and physical activities,and that she is"ambitious and aggressive". In fact,I was encouraged to write a letter to the Board against this variance. I have been told,"It will create more problems than it solves." I do not know exactly what is meant by that statement,but the neighbor is not going to show up to make his opinion known to you. I recommend a private walkabout of the neighbors to find out the issues. • There are less expensive ways to protect one self from inclement weather,and there are not very many bad weather days. • The 10' X 20' Steel Frame Canopy is not structurally suitable. For example,the information you sent me states, "The use of this Canopy during heavy wind, ice or snow conditions is not recommended Under severe conditions, disassemble your Canopy and store indoors. " Who will be putting up and taking down this Canopy for the tenant, and will it cause the neighbors' problems? • It appears the 10' X 20' Steel Frame Canopy will not do the job asked of it. The plans and measurements show the Canopy being up against the building. I have looked at the plans and have done some measuring. It appears that the Canopy will have to be more IIIce 6 or 7 feet from the front sidewalk to be marginally effective. This is because the canopy is only 10 ft. wide, and it is probably 12 to 14 feet from the front of the van to the back of the side van door. In the plans the Canopy is 10' from the building toward the road and 20' along the building. In that location the van would have to be parked against the building, and it still would not cover the back door- It is impractical and difficult to park a car this close to a building. Without a substantial curb,the car,or the house,would soon be damaged. • The Canopy will not provide the tenant fill protection from the weather. Besides not covering the van door completely,the Canopy does not extend to the tenant's front door. • The Canopy will be an eyesore in the neighborhood. The picture speaks for itself. • We feel either a simpler less expensive method of weather protection needs to be worked out, or a more substantial and aesthetic solution. Sincerely. Frank M. It is F. & P. Penwell Trust. Second, we are against the variance request to reduce a front yard setback from 20' to 8'. We feel it is a convenience that would not be extended toward all other property owners in the subdivision. If you granted this variance to all property owners in the subdivision at the same time, I would reconsider. For example, years ago I requested a 2' variance for my back property line (in this sub division), so I could build a one story residential home. You, as a Board of Adjustment,refused that variance because an adjacent homeowner,who could not even see our building from their house simply said they did not want us to have the variance, unless we built them a fence to their specifications. We offered to share the cost of the fence. Our variance would have been better for the subdivision, because we would have built a single story family residence. After the denial, I redesigned a two-story duplex building. Perhaps these owners can find a different way to meet their needs, as we did. I was left with the impression that our denial had more to do with who was requesting the denial (Ms. Dunn-Planning Dept.)than it did with anything else. I have seen other, more controversial,variances granted. This may sound to you like sour grapes,but it is not. The duplex has been a much better investment for us, and we are very happy at the turn of events. We just feel it would be unfair to grant variances to one property owner now, and at a future date deny another neighbor, who wanted a front yard variance. Our experience is just an example of how variances can be granted or denied willy-nilly. I am also quite unhappy that we got this notice (on Sat.)in what I feel is a very untimely manner. I do not feel a six working day notice is enough time to investigate and respond to a public hearing. As a result of this short notice, I am not able to attend the June 3rd meeting, and I ask that my letter,against the variance,be read into the Board of Adjustment record. In addition,we were not provided any details as to what is being asked for, or why the request. A temporary carport brings to mind a plastic Costco carport, which would be an eye sore in the neighborhood, and out of place in a planned residential neighborhood. In ending, it is my understanding that this house is owned by the Anacortes Housing Authority. If so, then the actual renters of the housing unit will change periodically, leaving into question many issues that will never be able to be addressed by this variance request. When researching concerns such as those expressed by your department we have consistently found that given our shelter's appearance and sound flexible design, questions have been raised because of perception and, at time, modified consumer use. In reality, our Canopy is not a carport. It is simply a very well constructed version of what is known most commonly as a sun shelter. Sun shelters are manufactured by several companies in a variety of sizes and designs. Large units, usually contain eight (8) steel pipe legs and a steel pipe roof frame covered with a polyethylene fabric held together with bungee cords. Hundreds of thousand have been sold acress the USA. Ours is for the most part identical in construction to all of the others except that we have used 2"pipe of 19 gauge steel, we have added foot plates and pins for more wind stability and we have provided two side panels and one back panel for optional used by the consumer, depending on their needs. Our entire unit can be erected in 45 minutes by 2 persons and dismantled in less than that for storage. Also, the side and back can be rolled up in minutes. When the back panel and side panels are used our shelter does take on the appearance of a carport. However, when you compare our product without the use of the optional back and side panels to other sun shelters on the market today, you will find they are identical. They are designed to be temporary structure as confirmed by the time it take to erect and dismantle. Our objective in developing this products was to offer the consumer sound construction and versatility at a very reasonable price. Further, we have taken great care in making certain that our Instruction Manual reflects our views regarding use in some weather conditions as follows; "The use of this Canopy during heavy wind, ice or snow conditions is not recommended. Under severe conditions, disassemble your Canopy and store indoors", Our product is being used to shield farm feed, vegetables, boats, cars, farm equipment,wood, animals, furniture, cardboard boxes and other such items from rain and sun. Lay out all structural parts. Separate nine(9)powder coated steel pipe pieces main frame(A).These form the length of the structure. Please ensure they are not mistaken for vertical supports(legs). Separate eight(8)vertical support tubes(B)and roof beams(C). 2. Note: When completing the next stage of this assembly it is important that,after attaching each corner piece(G,G-1 &I )to roof beams(C),you connect each using pin(L),immediately after it is assembled.With this in mind,using the appropriate corner pieces(G,G-1 &I)assemble this portion of the roof frame.Once completed,assemble the other side also using corner pieces(G,G-1 & I). (Figure#1)Assemble main frame poles(A)and roof beams(C)using corner pieces(H)and (1-1).No pins are required here.Attach the reinforcement wires(0)to the holes in the upper side of the roof beams(C) then to the turn buckles(P)and adjust to remove any slack in the wires.(See Figure#2) Place tarp over assembled roof frame. 3. Slide one hold down clip(Q)onto each of the 4 vertical support tubes(B).These tubes will be used as the four corner legs of the canopy. Raise ONE side of the roof structure and insert vertical support tube(B)into the corner pieces already attached to the roof structure.It is recommended that two persons be used for this portion of the assembly process.These will form the canopy legs.At the top end of each vertical support tube,fasten the corner pieces using short pins and rings(L).Once completed, repeat the process for the other side (Figure#2). 4. Insert each vertical support tube(B)into the foot plates provided(K).At the bottom of each vertical support tube,fasten the leg to the foot plate using long pins and rings(M)(See insert Figure#2).To prevent disconnection,each leg should be pinned as it joins the assembly. 5. Attach roof to the frame pipe with long bungee cords(J)provided(Figure#3). 6. Attach side panel to the frame using both the long and short bungee cords provided(J)& (J-1). (Figure#5) 7. Attach front and back panels to the frame in the same fashion as in#6.Join tubes(R&S),then slide it into the sleeve at the bottom of the front panel door opening.(Figure#4) 8. Attach the base of the side panels to the base of the rear panel through the grommets provided,then through the holes in the foot plates by using the long bungee cords(J).Repeat the other side.Attach the bottom of the side panels to the foot plates in the same fashion.(Figure#5) 9. At each corner of the roof there is a plastic ball at the end of a cord.Attach it to the hold down clip. Position the hold down clip on the vertical support so that there is tension in the cord then lock the clip in position. (see Figure#4) 10. Secure all other grommet areas.Tighten bungee cords as required. 11.On each side of the canopy roof, tie two nylon straps(N)to the two center eyelets in the overhang and tie the other end to the hole in the foot plate.(Figure#4) 12.Smaller straps are included for securing the sides when rolled up. NCHORING YOUR CANOP After construction, it is imperative that your canopy be securely anchored to prevent movement or wind damage. Do not under any circumstances use this unit without first securing it properly.Holes are provided in the foot plates for this purpose.This unit can be anchored in a variety of ways.Please ensure the appropriate anchoring method is used to coincide with the surface upon which it will stand and the climate conditions of your area.
