Members present: John Curtis, Ken Wilson, Gary Coatney, George Mehler Staff present: Ed Frank Minutes of the March 7 meeting were approved. Fullmer Variance (1905 23rd Street) Mr. Fullmer reviewed this request for a variance in rear-yard setback from 20 feet to 17 feet to construct a bedroom addition to his existing residence. Mr. Fullmer explained that the added bedroom with bathroom facilities will provide accommodations for the care for his elderly parents. He noted that landscaping, fencing, etc in the area will minimize the visual impact of the addition on the neighboring properties There were no City Staff comments/objections. Mrs. Casey (1904 24th St.) expressed concern that the addition will exacerbate an existing water drainage problem on her property that is below the Fullmer property; she did not object to the variance in setback. Mr. Fullmer stated that roof drains for the addition will conned to the present roof drains for the house which are routed to 24th Street. In a letter, Mrs. Moore (1903 23rd St.) stated "a structure 3 feet from the fence line would be totally unacceptable to us". This was in reply to an unfortunate error the official notification sent to neighboring property owners stating the request for setback variance was to three feet A motion was made (Coatney/Mehler) and passed with all ayes to approve the requested variance subject to City Staff expeditiously contacting Mrs. Moore to explain fully the variance request; should she continue to object to the true variance request, the Board will rehear the request April 18. The Board recognized the hardship expressed by the applicant in providing accommodations for elderly parents and felt the addition would have minimum visual impact on neighborhood. Bohnker Variance (709 37th Street) Mr. Bohnker reviewed this request for variance in front-yard setback from 20 feet to 3.7 feet to construct an elevated 12'X20' deck adjacent to existing entry steps and front entry platform to his residence. Mr. Bohnker explained that the entry to his residence is about twelve feet above the grade of 37"' Street with front access gained via three sections of steps with intermediate platforms: A 6-foot, two-step concrete and rock retaining wall establishes the front yard. The present front-yard setback to the house is 15.7 feet; the retaining wall is actually in the 37th Street right-of-way. The proposed deck will step up about one foot from the present entry platform in order to clear a basement window and will be over five feet above the grade of the front yard. City Staff comment stated no anticipated vehicular sight problem from the deck; there were no comments from adjacent property owners, although Mr. Bohnker indicated they had no objections. A motion was made (Curtis/Coatney) and passed with three ayes (Curtis, Wilson, Coatney), one nay(Mehler) to grant the requested front-yard variance. The Board considered that, without neighborhood objection, the deck benefited the applicant. Mr. Mehler felt that the visual impact of the deck in the area would be significant. S 2. Marshall Vacation (Portion of L Avenue Hagadoms and Stewarts Addition) Mr. Marshall reviewed this Petition for street vacation: the east 30 feet of L Avenue adjacent to Lot 11 Block 3 Hagadoms and Stewarts Addition. This section of L Avenue is a platted undeveloped 80-foot right-of-way. Mr. Marshall explained that the purpose of vacating this 30'X100' (3,000 sq.ft.) of L Avenue is combine it with adjacent Lots 11 — 13 Block 3 (9,000 sq. ft.) thereby creating two 6,000 sq.ft_ building lots in the R3 Medium Density Zone. The alternative is to build a duplex on the three Lots, which Mr. Marshall considers less desirable. He stated that Ace of Hearts Creek crosses the adjacent northern portion of L Avenue evidently assuring that this portion of L Avenue will not be developed in the future. In discussion, Mr. Frank confirmed that the Anacortes Comprehensive Plan essentially dictates that Ace of Hearts Creek may not be enclosed. Further, the City has an encroachment agreement with the developer of Lots 9 and 10 Block 3, immediately north of the applicant, to maintain the landscaping of the Creek in this area. City Engineering Staff comment: there is a possibility that the L Avenue right-of-way may be used to install a sewer line connection north from properties south of 35th Street, which fronts Lots 11 — 13, to a sewer main in 34th Street. Would the vacation possibly interfere with this possibility? Mrs. Crumm, associated with these properties, also expressed this concern. In discussion, Board members felt a recommendation to Council was inappropriate without resolution of the sewer question. A motion was made (Wilson/Mehler) and passed all ayes to continue this issue with a request that City Engineering Staff firmly establish the potential use of the L Avenue right-of-way for the sewer connection for consideration at the April18 meeting.
