This is to confirm my meeting with you at the above site. We met to determine if side
yard setbacks for the existing 4 unit dwelling would meet zoning setback requirements if
lots 1, 2 and the east 1/2 of 3 were separated out as a separate parcel.

We uncovered a survey stake at the northwest corner of the property near the sidewalk.
We measured east, to the proposed new division line, 115 feet. Based on field inspection
it appears that the existing 4 unit apartment will meet the requirements for setback on the
side yards (at least 10 feet on either side)with more than enough space.

RE: Your Inquiry Last Week Regarding Property Located at 1506 17th Street
Dear Ms. Gardner:
Relative to the above request I attach a memorandum dated March 27, 1997 from the City
Building Inspector.
You will note from the information supplied that in concept your client's proposal appears
workable, provided that the necessary off-street parking and side yard setbacks can be
established. As to Mr.Kaizen's question relative to sale as separate parcels, my answer would be
that this is feasible provided that parking, setback, and other zoning issues are addressed in a
conforming manner for each of the two parcels.
As this latter issue involves questions that are handled by the City Building Department, I would
ask that you pursue this matter further with Mr. Ed Frank(293-1901). I trust that the attached
information is of assistance.

Subject: ZONING INFORMATION AND VERIFICATION REQUEST
PROPERTY LOCATED AT 1506 17TH ST, ANACORTES
Ian, this request for information will help me better
understand the zoning particulars for an Anacortes property
which I am interested in purchasing. The Parcel Number is
37721260170004 . The site is legally defined as "Anacortes
Lot 1 thru 6, block 126 TGW, N1/2 Vac Alley Adj & Lot 15,
16, & 17 Block 126 Exc S 90ft Sd Lots TGW S. "
Information provided by the seller indicates that the
current site is presently zoned R-3, for residential and
multi-family units. The seller information suggests .that in
addition to the current four-plex, the property is also
zoned to allow an additional duplex. I would like to
confirm that this is the case and to know what the R-3
status means .
I am also interested to know if I can divide the property
into two separate parcels and retain the right to sale
either property later, if desired. I ask this information
so that I can more clearly consider potential options in my
retirement planning and make an informed decision prior to
purchasing the property.

A regular meeting of the Anacortes City Council was called to order by Mayor James
Rice at 7:30 P.M. on October 7, 1974,
Roll Call: Mrs. Bettye Bryant, Mr. Jerry Mansfield, Mt. Ray Separovich, Mr. James
Rice, Mr. Henrik Sortun, Mr. Floyd Lansford, Mr. Gary Nelson,
Mayor Rice requested the Councils pleasure on the minutes of the previous meeting
held on September 16y 1974. Motion made by Mr. Mansfield and seconded by Mr.
Separovich that the minutes he approved as if read. Rolls Ayes--Bryant, Mansfield,
Separovich, Rice, Sortun, Lunsford, Nelson. Motion carried.
Mayor Rice called for guest hearings: Mrs Ralph Gregory addressed the Council and
asked if the city wide water L. I. D. would be discussed at the meeting. Mayor
Rice replied that it would not be brought up to-night, but that a special meeting
would be held on Tuesday, October 15,, 1974 at which time the LLD. would be discussed.
Mr. Delbert Taylor from Skyline addressed the Council and asked if permits would be
issued after the storage reservoir is completed at Skyline. He was advised that
there possibly might be a limited amount of permits issued, but it was doubtful if
there would be much added capacity even after the storage tank is completed.
Mr. Rick Latham addressed the Council and stated that he thought there should be
more public information bulletins on the proposed logging operations.
Mrs. Amelia Heilman addressed the Council and asked if there would be public
hearings on the logging proposal before anything is done. She was advised that
there would be.

Mayor Rice declared a public hearing to be open to consider a re-zone request from
William Stitt and W. A. Mitchell and preliminary approval bf proposed Plat of
Division I of Stittwood Addition. They are requesting a rezone from R-S and R-1
to RPUD (Residential Planned Unit Development) of 25,9 acres of land located on
the hill above Highway 20 and east of the Grandview Cemetery. Mr. Stitt addressed
the Council and stated that their plans call for 39 single family units and 60
multi-family units. People living in this area expressed concern over the water
situation. Mayor Rice declared the public hearing to be closed. A motion was
made by Mr. Nelson and seconded by Mr. Lunsford that the City Attorney be instructed
to draw up an ordinance to cover this request and present it at the next Council
meeting. Roll: Ayes--Mansfield, Separovich, Rice, Sortun, Lunsford, Nelson, Bryant.
Motion carried,
Mayor Rice declared a public hearing to be open to consider a request from Ann
Rydberg to declare 3.15 acreas of land that she owns to be "open space". The City
Manager explained that "open space land" means (a) any land area so designated by
an official comprehensive land use plan adopted by any city or county and zoned
accordingly or (b) any land area, the preservation of which in its present use
would conserve and enhance natural or scenic resources, or protect streams or water
supply, promote conservation of soils, wetlands, beaches or tidal marshes, or
enhance the value to the public of abutting or neighboring parks, forests, wildlife
preserves, nature reservations or sanctuaries or other open space, or enhance

recreation opportunities, or preserve historic sites, or retain in its natural state
tracts of land not less than five acres situated in ah urban area and open to public
use on such conditions as may be reasonably required by the legislative body granting
the open space classification. The Management recommended that the request be denied,
as this property meets very few, if any, of the considerations. A motion was made
by Mr. Sortun and seconded by Mrs. Bryant that the request be denied. Roll: Ayes--
Separovich, Rice, Sortun, Nelson, Bryant, Mansfield. Nayes--Lunstord. Motion carried.
A recommendation was received from the Planning Commission tecotmiending that the
City Council authorize the City Manager to negotiate the transfer, sale, or trade
of the Guemes Island Park to the State Park Department realizing the maximum benefit
to the City of Anacortes. As no reoommendation had been received from the Parks and
recreation Commission, action on this was Postponed until a later meeting.
A letter was received from the Port of Skagit County requesting that the City of
Anacortes handle, through its treatment plant, dolnestic^, sewage from a marina project
and an industrial developineht ih LaConner, pending installation of adequate sanitary
sewage treatment facilities in the City of liaConner. The letter also requests that,
provided permission is given for handling the sewage, that a cost figure on a per
thousand gallon basis be quoted. Mr. David Ford, Director of Phbiic Works, stated
that the Port of Skagit County estimates, at- present, although they are still verify-
iiig these figures, that ,they will have approximately 2 thousand to 5 thousand gallons
per day of saiiitd$y sewage to dispose of. The sewage they wish to dispose of will be L
domestic only, and will not be septic. It would be froth showers, restroom facilities,
possibly a laundry, from the marina project and the industrial facility. Mr. Ford
stated that the following charges have been discussed. A basic charge of $5.00 per
delivery, plus 900 per thousand gallons. This would mean that the Charge for each
delivery per day of 2 thousand gallons would be $6.80 and for each delivery of 5
thousand gallons would be $9.50.
The present plant capacity is such that the City would have no problem in handling
the estimated amounts of sewage. The Council requested that a contract be drawn
up covering all details and presented to the Council at their next meeting.
An ordinance was read levying a tax upon real and personal property within the City
of Anacortes for municipal purposes for the year 1975 as follows:

Motion made by Mr. Mansfield and seconded by Mrs. Bryant that this ordinance be
approved and adopted and given ORDINANCE NO. 1627 Roll: Ayes--Rice, Sortun,
Lunsford, Bryant, Mansfield, Separovich. Motion carried.
The tax levy ordinance is based on 71 mills, the other z mill which the City is
entitled too will go to Island Hospital. The so called floating a mill, when assessed
to the capabilities of the City of Anacortes, returns a tax revenue of $22,058. When
applied to the assessed valuation of the Hospital district, it would return in excess
of $64,000 with a possibility of approximately another $40,000 if the Hospital District
can assess on the re-evaluation recently completed. The City Manager stated that
since there appears to be a controversy on whether the City should operate the ambul-
ance through the Fire Department and there is some concern as to the proposed contract
that has been approved by the Hospital District, he recommended to the Council that
they negotiate with the Hospital District for the supplying of dispatching services
through our central dispatch agency and the Hospital District_would pay the City
$22,058 for this service; and in return therefor, the City will release the floating

i mill to the Hospital District thus preserving the Hospital District's capability
of assessing this tax.
An ordinance was read amending the zoning map of the City of Anacortes. The following
described area, heretofore classified and placed within the R-1 Single Family Resident
District is hereby and shall hereafter be placed and classified in the R-3 Multiple
Family Residential District: Lots 1 through 17, Block 126, City of Anacortes, and
North half of vacated alley adjacent to lots 1 through 10, the south half of vacated
alley adjacent to and the north 10 feet of lots 11 through 17 of Block 126. The re-
quest for this change having been made, by Mr. Maynard Lewis. Motion was made by Mrs.
Bryant and seconded by Mr. Mansfield chat this ordinance be approved and adopted and
given ORDINANCE NO. 1628 . Roll: Ayes--Sortun, Lansford, Nelson, Bryant, Mansfield,
Separovich, Rice. Motion carried.
An ordinance was read amending the zoning map of the City of Anacortes to change the
zoning classification of certain land areas within the City. The following described
area are, heretofore classified and placed within the R-1 Single Family Resident
District is hereby and shall hereafter be placed and classified in the Commercial
District--C-2. Lots 31 and 32 of Norman and Wood's Subdivision, except that portion
lying easterly of the westerly line of a 120 foot strip deeded to the City for road
purposes and known as Ferry Terminal Road. This request having been made by Mr.
Charles Funk. A motion was made by Mr. Separovich and seconded by Mr. Sortun that
this ordinance be approved and adopted and given ORDINANCE NO. 1629 . Roll: Ayes--
Lunsford, Nelson, Bryant, Mansfield, Separcvich, Rice, Sortun. Motion carried.
An ordinance was read amending Ordinance No. 1583 entitled "An Ordinance adopting
the budget and salary schedule for all municipal uses and purposes for the year 1974".
The budget would be amended to reflect additional revenue to the Park Fund from the
Estate of Edna Drake in the amount of 000.00, and provide for the expenditure thereof.
Motion made by Mr. Nelson and seconded by Mr. Lunsford that this ordinance be approval
and adopted and given ORDINANCE NO. 1630 . Roil: Ayes--Nelson, Bryant, Mansfielu,
Separovich, Rice, Sortun; Lunsford. Motion carried‘
Claims against the City for the month Of September 1974 were presented as follows:
Salaries and wages 72,664.81
Expenditures 104,141.53
Upon approval of the Finance Committee,motion was made by Mr. Sortun and seconded by
Mr. Lansford that the claims be approved. Roll: Ayes--Bryant, Mansfield, Separovich-
Rice, Sortun, Lunsford, Nelson. Motion carried.
Mayor Rice announced that the Council would be holding a study session at 7:30 P.M.
on Tuesday, October 8, 1974.
There being no further business to come before the Council, Mayor Rice declared the
meeting to be adjourned at 8:35 P.M.
