Erickson Variance (1411 16th Street) Rehearing
At the December 2, 2004 Regular Meeting, the Board denied Mr. Erickson's request for a variance to
increase the height of an accessory budding from 16 feet to 18 feet to construct a 22'X26', two-car, garage
with overhead storage. There were only three Board members present at the meeting; the Board passed a
motion to grant the applicant the opportunity, at his request, for a rehearing before the full Board. The
rehearing was on this meeting agenda, however Mr. Erickson was not present
A motion was made (Snyder/Curtis) and passed with all ayes to cancel the rehearing opportunity because
Mr. Erickson was not present at the meeting. Mr. Erickson will have to reinitiate the variance request if he
wishes to pursue the matter unless extenuating circumstances prevented his appearance at this meeting.
Alphin Variance (3712 W. 12th Street)
Mr. Alphin reviewed this request for a variance in the maximum height of a fence built on an existing
side-yard retaining wall from four feet to five feet_ The retaining wall consists of large rocks placed in an
attractive random design.
Mr. Alphin explained that he plans to enclose the rear yard of his residence as a free-run for his dog; he
considers 5-foot high fencing essential to protect the dog from outside animal intruders. The retaining wall
varies in height, front-to-rear, roughly from two feet to four feet; the new wood fencing will tie into but be one
of below the top of an existing 6-foot wood fence along the rear property line. At the highest point in the
.ar-yard corner, the retaining wall plus fence will be over eight feet above grade.
There were no comments/objections from City Staff. Mr. Alphin stated that neighbor adjacent to the proposed
fencing supports the request.
A motion was made (Snyder/Mehier) and passed with all ayes to grant the variance as requested. The Board
determined that the fencing would benefit the applicant with an acceptable impact on the neighbor.
Heiner Variance (804 K Avenue)
Mr. Underwood, architect representing Mr. Heiner, reviewed this request for a front-yard setback variance
from 20 feet to 6 feet, the setback of an existing garage that Mr. Heiner plans to replace and enlarge.
Mr. Underwood explained that the proposed location for the garage would maintain a usable back-yard area
behind then garage on the small lot (6,000 sq.ft); the existing residence encroaches the front yard to an
approximate 9-foot setback. The proposed garage is adjacent to an alley with the planned roof ridge-line
running parallel to K Avenue.
The Board noted that the distance from the rear of the proposed garage to the rear property line is 30 feet so
that postioning the garage to a somewhat greater front-yard setback would not sacrifice back-yard area
significantly. The Board also R-T 9tted that the planned roof surface parallel to the street would present a
more "walled appearance" when viewed from K Avenue; reversing the roof ridge-line to parallel the alley
would lessen the visual impact of the garage.

There were no comments/objections from City Staff. Mr. Underwood presented a statement of approval for
the project signed by twelve neighboring property owners.

of the existing residence (approximately 9 feet) and to require that the roof ridge-line run parallel to the
adjacent alley. The Board concluded that the proposed garage as modified would be a complement to an
existing garage across the alley and would have little impact on the neighborhood.

Erickson Variance (1411 16th Street)
Mr. Snyder prefaced the meeting by informing Mr. Erickson that he could request postponement of the
hearing because the Board attendance was minimum for a quorum.
Mr. Erickson reviewed this request for a variance to increase the height of an accessory building from 16 feet
to 18 feet to construct a 22'X26', two-car, garage with overhead storage in the R-3 residential District.
Mr. Erickson explained that he recently purchased his residence, a log home constructed in 1910. The house
has ample living space but lacks closet and storage space; the layout of the log house does not lend itself to
alteration to provide the needed storage space. He proposes to construct a garage with sufficient overhead
storage to meet his needs; the new garage will replace an existing old garage in disrepair that he has already
removed. He also plans to remove a small open shed presently in the rear yard. The proposed garage is an
"off-the-shelf"truss design with a 10-in-12 roof pitch that provides a 9-foot wide X 6-foot high attic for storage.
The garage is 19'10" high but Mr. Erickson has excavated the site to a garage floor level two feet below
grade in order to reduce the garage height to 18 feet.
There were no comments/objections from City Staff or neighboring property owners. Mr. Erickson indicated
that he had discussed the project with some neighbors with no objections forthcoming.
Discussion centered on what was the true garage height Mr. Erickson requested in the variance, i.e. at what
grade point is the height measured; confusion on this matter was evident. Mr. Frank stated that the lowest
point on the actual building site is the grade point for height measurement, in this case at the front of the
garage. Mr. Snyder suggested that the building height could be lowered by abandoning the truss design to a
rafter construction with less roof pitch (and still provide sufficient head-room) and by additional excavation to
lower the garage floor level and the driveway approach.
A motion was made (Snyder/Mehler) to grant the garage height variance to 18 feet with the condition that the
small shed in the rear yard be removed; the motion failed with two ayes (Snyder, Mehler), one nay
(Boubeau). In support of the motion, Mr. Snyder recognized the problem of limited household storage
expressed by the Mr. Erickson, and encouraged him to modify his plans to reduce the garage height below
the 18 feet. Mr. Boubeau felt that the applicant had not expressed sufficient hardship to justify variance
approval.
A motion was then made (Mehler/Snyder) to grant the applicant the opportunity, at his request, for a
rehearing before the full Board. This would permit him to organize his presentation to clearly define his
request. Motion passed with all ayes.

Mr. Snyder,
Owing to some unavoidable personal business, I am unable to attend the
referenced meeting this month. I have also advised Ed Frank, and hope this
will serve as my request to be excused this time only.
I write this to express my concern regarding the agenda item referenced
above, and as shown on the Proposed Agenda mailed to all Board of
Adjustments members. As you are aware, this item was previously reviewed
and defeated on December 2, 2004. The Board was short of two members
on that date. You did advise Mr. Erickson that he could delay the request
until a full Board was in attendance which he declined.
Following the vote, we discussed Mr. Erickson's' request for an additional
opportunity to re-submit his appeal. The three Board members present
agreed that he would be permitted to do so provided he consider revising his
design and include deeper excavation, changing from prefab truss design
utilizing "stick framing" and lowering the roof pitch, all to result in the 16'-
0" or less overall height in the roof.
My concerns lie in the fact that Mr. Erickson has not submitted any new
drawings to indicate such changes to his design. If his purpose in attendance
on Thursday, January 6 is to simply re-submit the previous design without
revisions for a Board meeting more fully attended, then it is my contention
his request should not be heard. Further, I feel the Board also led him to
understand that the substantial excess of the zoning requirements shown in
his previous design were not acceptable.
I am aware that our charter discourages Board members from pre-
discussions of variance requests. Accordingly, I have arranged with Ed
Frank that this be presented to you, un-opened just prior to the meeting. I
also understand that proxy votes by Board members are not allowed.
Finally, I am confident that the Board of Adjustments will rule on this matter
consistent with the City of Anacortes 2004 Zoning Ordinance. I truly
appreciate your review of my concerns in this matter, and look forward to
joining you in the next meeting of the Board of Adjustments.

I respectfully request that the city of Anacortes grant me a variance to construct a garage
that will measure approximately 17 feet above the ground surface of my lot.
Section 17.34.060 Paragraph D.2. states that a detached accessory structure may be no
more than 16 feet in height.
I am requesting this variance is justified for several reasons. My home at 1411 16th St is a
log home constructed in 1910. The house has ample square footage for my family of
four, but it is lacking in closet and storage space. There was a simple shed structure on
the lot when we purchased the home, but it was torn down for safety concerns. The
property has no secured parking for vehicles or storage for larger items. Many homes in
my neighborhood have had additions to alleviate the same sort of concerns. The layout,
design, and log construction of the home does not easily lend itself to additions or
alterations. Rather than radically altering the character of this unique and possibly
historic home, I would like to construct a two-car garage with additional storage in the
rafter space. The garage will be an improvement to the neighborhood, and will match the
look of the log home.
After careful review of available plans and discussion with several builders, I have
located garage plans with a truss design that provides for walk-around rafter storage. In
order to match the look and pitch of my home's roof and still provide adequate headroom
in the garage and storage space, the garage needs to be approximately 19'10" in height. I
have excavated the building site for the garage approximately 3 feet down, which will

I respectfully request that the city of Anacortes grant me a variance to construct a garage
that will measure approximately 18 feet above the ground surface of my lot.
Section 17.34.060 Paragraph D.2. states that a detached accessory structure may be no
more than 16 feet in height.
I believe this variance is justified because of the unique character of my house at 1411
16th St. It is a log home constructed in 1910, and was built by the Taylor family of
Anacortes. The house has ample square footage for my family of four, but it is lacking in
closet and storage space. The property used to have a small open shed, but has no
secured parking or storage. Many homes in my neighborhood have been added onto to
alleviate the same sort of concerns. The layout, design, and log construction of the home
does not lend itself to additions or alterations. Rather than radically altering the
character of this unique and possibly historic home, I would like to construct a garage
with additional storage in the rafter space. After careful review and discussion with
several builders, this type of truss arrangement requires a minimum of 19'10" in height. I
have enclosed a 8.5 x 11 print of the plans I am considering. Excavation of the garage
site will yield roughly 2 feet of recessed garage parking space.
The Board of Adjustment is directed by ordinance to base its decision on the following
criteria. From Part 17.10.040 of the Zoning Ordinance.
A. That special conditions and circumstances exist which are peculiar to the lands,
structure, or building involved and which are not applicable to other lands,
structures, or buildings in the same district;
B. That literal interpretation of the provisions of this ordinance would deprive the
applicant of rights commonly enjoyed by other properties in the same district
under the terms of this ordinance;
C. That the special conditions and circumstances do not result from the actions of
the applicant;
D. That granting the variance requested will not confer on the applicant any special
privilege that is denied by this ordinance to other lands, structures, or buildings
in the same district.
