Young: Thank you for your letter regarding Steinman' s Grocery Store. I have reviewed this matter with Mayor Rice. It would appear that as long as they work within the existing retail space area that they could put in a deli counter. Restaurant style seating would not, in my opinion, be covered by a neighborhood grocery store zoning category. As to the liquor license for on-premise consumtion, this would need the Mayor' s approval. By copy of this letter I am asking the City Attorney and Building Inspector to look into this matter further. MUNCE, I AM A NEIGHBOR OF HELEN SHERWOOD, OWNER PROPRIETOR OF "STIENMANS GROCERY STORE" . THE PURPOSE OF THIS LETTER IS TO MAKE MY AND MY FAMILY'S POSITION CLEAR. WE ARE STRONGLY OPPOSED TO THE FURTHER EXPANSION OF THIS BUSINESS. I WAS TOLD BUY THE BUILDING INSPECTOR THAT THIS BUSINESS WAS LIMITED TO THIRTEEN HUNDRED SQUARE FEET OF RETAIL SPACE. AS THE STORE SITS NOW, THIS SPACE REQUIREMENT IS ALREADY EXCEDED. THE LADY HAS TOLD ME AND MEMBERS OF MY FAMILY, IT IS HER PLAN TO PUT IN A "DELI" AND SERVE ON PREMISE CONSUMPTION OF FOOD. LATER ON, TO SERVE BEER AND WINE TO HER "DELI" CUSTOMERS WITH THEIR SANDWICHES. WHEN I ATTEMPTED TO EXPLAIN TO HER THIS WAS NOT POSSIBLE, SHE GOT ANGRY AND TOLD ME, "IT IS MY STORE AND I 'LL DO AS I PLEASE. " I TRIED TO EXPLAIN IT WOULD REQUIRE A CONDITIONAL USE PERMIT. THIS WOULD REQUIRE A PUBLIC HEARING FOR INPUT FROM THE NEIGHBORS. SHE USED A VULGAR TERM TO STATE IT WAS NONE OF THE NEIGHBORS BUSINESS WHAT SHE DID, AS IT WAS HER STORE. AFTER CONTACTING A FEW OF THE NEIGHBORS, IT WAS MY FEELING NO ONE WANTED A "DELI/TAVERN" IN THE AREA. I WOULD LIKE TO GO ON THE RECORD AS BEING OPPOSED TO ANY FURTHER ATTEMPT TO COMMERCIALIZE THIS NEIGHBORHOOD ANY MORE, THAN IT IS NOW, AND REQUEST TO BE NOTIFIED IF A PERMIT IS FILED FOR. THE NEIGHBORS CONCERNS ARE, THEY MAY NOT BE MADE AWARE OF THE APPLICATION UNLESS THEY LIVE NEXT DOOR TO THE STORE. AS TOUCHY AS THIS MATTER IS, THE NEIGHBORS MOST ASSUREDLY NEED TO BE INFORMED. T �., , Minutes Board of Adjustment Regular Meeting - January 3, 1974 Meeting was called to order by Chairman Charles Kiel at 7: 35 P.M. Members present were: Charles Kiel, Charles Mason, Jack Bagdanov, and Ned Andrich. Member Norwood Young was present at the meeting but did not sit as a member of the Board inasmuch as he was the applicant in the case to be considered . Mr. Kiel welcomed Mr. Ned Andrich as a new member of the Board for a term of 1 year. Minutes of previous meeting of December 6, 1973 were read. Motion by Mr. Mason that they be approved as read was seconded and carried. Mr. Kiel then read the application of Mr. Norwood Young for renewal of a temporary use variance for a walk-in cooler and additional storage space at his grocery store located at 1719 12th Street. Prepratory to considering this request, Mr. Kiel remarked for the benefit of those in the audience that in making their deicisions, the Board must consider two basic elements: (1) what the existing City ordinances state and (2) the need by the property owner to realize a fair and reasonable return on his investment . In doing so, the Board tries to keep in mind four things : (a) what the ord- inances say; (b) what kind of safety factors are involved; (c ) the impact on the surrounding neighborhood and; (d) the opinions of the adjoining property owners might have on the request . He also briefly explained the process by which the information needed to consider the request would be given. Secretary then read the portions of the minutes of the meeting of May 4, 1972 which were pertinent to Mr. Young' s original request and which recorded the granting of the original use variance. Secretary also read a letter, dated December 4 , 1973, addressed to the Board of Adjustment from Mr. Herbert Pearson. In this letter Mr. Pearson outlined and listed 12 items of criteria which he felt had been overlooked in the consideration of the original request of Mr. Young. Said letter is attached hereto and made a portion of these minutes . Chairman Kiel then remarked that he had asked the presence of the City Attorney at this meeting to possibly clarify some questions in the minds of the members of the Board. First , he asked Mr . Mansfield whether two separate actions were involved in the granting of Mr. Young's original variance request . Before replying to the question, Mr. Mansfield said he wished to make it clear to the Board and the audience that his replies were not to be taken as legalities, but only as his opinions based upon his investigation of the matter before the Board. rr-Th 0 Page 2 Mr. Mansfield then said it was his opinion that the case was actually two separate actions . One was the setback requirement of 20 feet (Section 8-7 .03.1. 2. 2 of the Code) which was varied to 7 feet setback. This setback variance would be binding in Mr. Mansfield's opinion. The second action concerned the non-conforming use of the request. The second question then put to Mr. Mansfield by Mr. Kiel was whether the Board actually have authority to grant the non-conforming use. Mr. Mansfield said that he did not feel that it did because under Section 8-7 .05.2. 1 of the Code it states "It is the intent of the ordinance to permit non-conformities to continue until they are moved, but not to encourage their survival further that non- conformities shall not be enlarged upon, expanded or extended. . . ". To further support his opinion, Mr . Mansfield also quoted from Section 8-7. 07.2. C (g) "Under no cirucmstances shall the Board of Adjustment grant a variance to allow a use not permitted under the terms of this ordinance in the district involved, or any use ex- pressly or by implication prohibited by the terms of this ordinance in said district . Variances shall be limited to the area and dim- ensional requirements of this ordinance . " Mr . Mansfield further elaborated by defining the term "temporary use" to mean a use not anticipated to continue and that the temporary use which was previous- ly granted was not such a use - that it was a use which was expected to continue. The Building Inspector, Mr. Ray Iversen, did not agree with Mr. Mansfield' s contentions and quoted from Section 8-7 .05 .1 "The Board of Adjustment may authorize the building inspector to issue a permit for the construction of a non-conforming building, or for the non- conforming use of any area or building, for a specific period of time not exceeding one year. . . . " Therefore, Mr . Iversen said, the Board of Adjustment was acting under its authority when the variance was granted to Mr. Young. Mr. Andrich voiced the opinion that the structure being built by Mr. Young was not a temporary but a permanent thing and Mr. Kiel acknow- ledged this stating the question before the Board was concerning 1 the renewal of the temporary use and not the setback requirement variance which had been granted. Mr. Kiel then acknowledged Mr. Young from the audience and Mr. Young requested a recess of the meeting for 5 minutes for a discussion with Mr. Kiel, Mr. Mansfield, Mr. Andrich and Mr. Iversen. All 4 men retired from the Chambers at 8: 15 and at 8: 30 the meeting re- convened. Mr. Kiel stated it appeared the Board could elect to do one or more of three things: (1) take Mr. Mansfield' s advice that they did not have the authority to grant such a temporary use variance; (2) proceed with the hearing; or (3) take whatever other action the Board may wish. He asked the pleasure of the Board with no specific response. Page 3 Mr . Bagdanov stated that the two main sections of the code (above quoted) contradicted each other. Mr. Mansfield said he agreed that it seemed so, but that specific provisions quoted in an ordinance controlled the general provisions and he felt this was so in the instant case . He said there was generally great enlargement or explanation of non-conforming uses, but not temporary uses. There was further discussion and Mr. Andrich asked, "What is this going to do with other businesses in the area? Will it set a precedent?" Mr. Kiel said that many cases have set precedents in the past . Mr. Young then asked to be heard again and he cited several cases previously heard in the Washington State Courts on situations very similar to his where the Courts have found in favor of the appellant . He said the Courts are liberal in allowing municipalities to create zoning ordinances , but are strict in restraining their police powers which may infringe upon the rights of individuals . Mr. Young also cited a case heard in the U.S. Supreme Court which upheld a plaintiff under circumstances similar to hiw own. He also quoted from a book published as a guide for planning boards and compared items listed therein to his case . Some were the following: the variance, if granted, will not alter the neighborhood as the store had been there before 1928; will not be detrimental to the public needs ; adjacent property owners have no objections; will not substantially impair the intent and plan of the zoning ordinance; his need for the variance was not a self-created hardship . Mr. Young said that in his opinion almost all zoning ordinances have been predicated on the use of the automobile and now, with the fuel and energy in short supply, the neighborhood store will become increasingly import for customers who cannot travel further distances for the commodities sold. He further said he does not feel that the Board would be in error in granting his variance . He said there were no objections when his original variance was granted and, because the structure he has started to build is not yet ready for use, he did not feel the temporary use variance would have to be renewed until it was ready for use. In light of the paragraph under Section 8-7 .07 .2 C(g)-previously quoted-which says the Board of Adjustment shall not grant a variance to allow a sue not permitted under the terms of the ordinance, etc . , he feels the ordinance is unconstitut- ional. Mr. Mansfield interjected stating he felt the ordinance is entirely constitutional. Mr. Young then presented a petition which had been signed by 382 residents of his neighborhood stating, "We, the undersigned, have no objections to Steinman' s Grocery in its present form nor do we object to the addition now under construction. " Said petition is I attached hereto and made a part of these minutes. Page 4 Mr. Iversen said he was a member of the very first Board of Adjustment for the City of Anacortes and that they were guided by Attorney Wells who told them the Board had authority to grant variances on (1) area and dimension requirements ; (2) special exceptions listed in R-3 and C-2 zones; (3) temporary uses and, ( 4) fences. As a matter of information, Mr. Kiel asked Mayor Rice, who was in the audience , why it was necessary for the Council to grant temporary use requests to live in mobile homes instead of such a request being handled by the Board of Adjustment . Mr. Rice replied that it was because living in mobile homes is not allowed at all in Anacortes unless in a mobile home park. Mr. Rice further stated that , in his opinion, temporary uses should be decided by the City Council. Mr. Kiel asked him if the Council would give this case a hearing and Mr. Rice said it would. Mr. Kiel asked what criteria would be considered pertinent and Mr. Rice replied whatever could be asked, "does it benefit Anacortes?" . Mr. Kiel asked whether the Council could ignore ordinances and Mr. Rice referred him to Mr. Mansfield. Mr. Mansfield said, no, the Council in all cases would have to follow procedures set down for consideration of any requests . In this same line, Mr. Mansfield said the Board could go ahead and address itself to the issue at hand and then the question of their authority to do so would have to be decided between the City Attorney and the Building Inspector. Mr. Andrich said he thought the ordinance should be chang- ed. Mr. Kiel requested all present not to let their emotions inter- ject. Mr. Kiel then recognized Mr. Robert McCaffery in the audience who stated he signed Mr. Young's petition, but not because of emotion. He signed it because he believes Mr. Young deserves a break; that Mr. Young is working hard to make a good business and service to the community . Mrs . McCaffery said she signed the petition because it is a friendly store and she would like to hear from Mr. Pearson. Mr. Kiel interjected to say that motives could not be involved in any decisions and they would be made on the rights of the property owners involved and on the merits of the application in light of what the ordinances state. He then recognized Mrs . Ruth Steinman who stated she and her husband feel that some of the things mentioned in Mr. Pearson's letter should be commented upon. First , Mr. Young had nothing to do with the store 's having a liquor license. They got it at the request of their customers long before they sold the store to the Youngs . Second, regarding relocating the store , it has been in the same location for 40 years; there has been a definite need for it all that time. Third, regarding the street traffic, they had bought additional property alongside sow ly for the purpose of parking; fourth, the gasoline pumps - the city had advised them some time back that so long as the Page 5 State Highway Department had not made any decision on what they were going to do about 12th Street , to leave the pumps in their present location; fifth, she asked the question, "Could the Board deny renewing Mr. Young's request for permit without feeling that Mr. Young had recourse?" Mr. Kiel said this was a good point. Mr. Kiel requested a short recess for the members of the Board to discuss the matter between themselves without leaving the Council Chambers. Before this was declared, Mr. Young said he wished the minutes to show that he very strongly objected to any voting by Mr. Andrich on this case as Mr. Andrich, being a new member of the Board, would not be qualified to sit in the case. Recess was declared at 9 :05 p.m. and at 9 : 30 p.m. meeting was called back to order. Mr. Mason asked Mr. Mansfield what recourse the people have against the Board if the request was not granted. Mr. Mansfield said that if the Board did not have the power to grant the temporary use request and if they did so; then it was decided later that they did not have the right to grant the request , the variance would become null and void and there would be no crcourse. However, if the Board decided their action was legal and decided to grant the variance , it would be subject to challenge by citizens to bring action to declare the action illegal. He could see no personal liability or any liability on the part of the City of Anacortes for any damages . Mr. Kiel said he would like to summarize the recess discussion of the Board members . The majority were of the opinion that the reasons under which the original variance was granted were still valid; that the request served a need in the community and was not a hindrance and there were no serious objections to it at the time it was granted. On the other hand, the legal aspects , because of the ordinance, had to be considered. If the Board grants the variance and then a later Board says it was not legal , the appellant would have more to lose at a later date than if the Board were to rule against him now. He said he felt the Board should decide whether it was within their authority to make a decision and asked the pleasure of the Board. No member offered a suggestion. Mr. Forrest Miller asked to be recognized and asked who would make a decision if the Board should decide it could not. Mr. Mansfield replied that possibly the Council could pass another ordinance or amend the present ordinance to resolve the problem. Mr. Young again addressed the Board and stated he had already made a substantial investment ; that the same conditions and violations of ordinance exist in other parts of the City ; that he feels he was singled out for this debate, but doesn' t know why. ( i Page 6 Vivian Kempthorn addressed the Board and said that if the Board assumed that perhaps a later Board would say no to Mr. Young, would it not be possible that they would say yes? She feels that if Mr. Young is willing to put in the time and money to make his business grow, she approves of it. Another member of the audience asked if the temporary use permit must be only for 1 year at a time. Mr. Kiel replied, yes , according to the ordinance . Mr. Pearson then asked to have the floor. He said he had not planned to speak inasmuch as his letter had been read, but felt he should perhaps bring out some additional points . Mr. Pearson stated that in 1969 the University of Washington prepared and published a Comprehensive Report on the City of Anacortes which made statements which residents of Anacortes would not like to hear. Among other things , it stated that the town has a very poor appearance and gave the reasons why. It also gave 9 recommendations for correcting such appearance and the first on the list was to apply the zoning ordinance and strengthen it . Mr. Pearson was of the opinion that the establish- ing of a precedent should be considered among other things in the instant case and, on the other hand, if denial is made , perhaps it would bring personal hardship to the applicant . He said there were some alternatives which might be considered if the Board hadn 't thought of them: (1) through a zone break-away; (2) through a re- zoning of the area which would make the use legal; (3) zoning with contract (Mr. Young would apply for re-zoning of his property only, which limits uses , etc. , and is commonly called "spot zoning") ; this is done by application to the Council who refers it to the Planning Commission for investigation and thertthey, in turn, make recommendation to the Council; and(4) change the language of the zoning ordinance which is also done by recommendation to the Council regarding non- conforming uses and strike that portion which says non-conforming uses will not be expanded, however, he expressed his hope that the instant case could be resolved within the framework of the laws of the City. His (5) fifth alternative would be that if the board should deny the request , the Board make a recommendation to the Council that Mr. Young be allowed to sue the City for a reasonable amount and the City take a no-contest stand. At the request of Mr. Kiel, Mr. Mansfield explained further the contract-zoning. Mr. Mansfield said there had been no recent cases, but there have been previous cases in various places in the City . Contract zoning limits the uses , etc. and if the contract is not complied with, the zone reverts back to the original class . Mr. Iversen said that in this case , a re-zone would have to be some kind of a C zone. Mr. Kiel requested a short discussion between the members of the board and Mr. Young and then requested the pleasure of the Board. i Page 7 Motion was then made by Mr. Bagdanov that the matter be tabled for no more than six (6) months pending presentation of a request to the City Council by Mr. Young for a contract re-zone of his property; and if that action is not successful, then the application will be again taken up by the Board of Adjustment. Motion was seconded by Mr. Mason. Vote all ayes . Motion carried. Mr. Young asked the Board about his building; whether he could continue with it and he was assured that he could.
