On September 20, 2019,the City noticed that work was commencing without a permit; a Stop Work Order was issued on that date, due to the fact that work that required a permit was commencing without one. Anacortes Municipal Code 19.14.025 states that the International Residential Code, 2015 Edition, was adopted by the City of Anacortes. Work that requires a permit: The 2015 International Residential Code, adopted by the City of Anacortes, R105.1. states: "Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be performed, shall first make application to the building official and obtain the required permit." You spoke, a few days later, with the City about the work that commenced without a permit, and your intention to obtain a permit for the work that was done and you requested that an estimate be given you for the cost of the permit and plan review fee. Box 547, Anacortes, WA 98221 Office Location: 904 6rh Street, Anacortes WA 98821 Phone: (360) 293-1901, Fax: (360) 293-1938 Violation for work that requires a permit: The 2015 International Residential Code, adopted by the City of Anacortes, R113. states that if an unlawful act of work required by this Code is done without a permit that a Notice of Violation is to be issued with the mention of the penalities that the violator is subject to, which are as follows: R113.4 Violation penalties. "Any person who violates a provision of this code or fails to comply with any of the requirements therof or who erects constructs, alters, or repairs a building or structure in violation of the approved construction documents or directive of the building official, or of a permit of certificated issued under the provisions of this code, shall be subject to penalties as prescribed by law." Anacortes Municipal Code 20.30.080 Civil penalty states the following: A. In addition to or as an alternative to any other judicial or administrative remedy, a person who causes a civil violation, or by any act of commission or omission procures, aids, or abets such a civil violation, may be subject to a civil penalty. B. Amount of Civil Penalty. 1. The amount of civil penalty is one hundred dollars per day per violation unless otherwise provided. 2. For a civil violation related to critical areas, as defined in the Anacortes Municipal Code, the Director may impose an additional civil penalty up to: a. An amount, not to exceed twenty-five thousand dollars, that is reasonable based upon the nature and extent of the violation and the costs to the City of enforcing this Chapter against the violator; or b. The resulting increase in the market value of the property or the value received by the violator; or ii. The savings of construction costs realized by the violator derived from the act that constituted the violation. The construction done on the house at 2614 Oakes Ave required a permit and none has been applied for, nor obtained since the date of the Stop Work Order. You have until Tuesday, the 21st of January, 2020 to obtain a permit for the work that was done at 2614 Oakes Ave. Failure to obtain a permit may result in penalties under Anacortes Municipal Code 20.30.80.
