The Board reasoned that the business location ( with proximity of an obstructing building ) created a special condition of hardship , limiting the applicants advertising capability . Thomas Variance ( Block 32 Kelloq & Ford Addition ) Mr . Frank reviewed this request for variance in solid fence height from 2-1/2 feet to 6 or 7 feet along the front edge and side edge within 20 feet of the front property line of Lots 13 - 18 . Mr . Thomas stated that the proposed fence will shield two building lots from headlight glare and noise of vehicles turning at the busy A Avenue and 37th Street corner ; the fence will also provide safety protection for children . Mr . Thomas plans to develop these building lots , but has not applied for construction permits . The Board questioned the timing of the variance request since the need for a fence can not be demonstrated with no housing on the lots . Also , quite likely , the fence would impair traffic visibility for vehicles exiting adjacent driveways . Mr . Snyder suggested that the applicant use innovative planning in positioning residential structures on the lots to address his concerns which he feels necessitate a fence . The Board determined that the applicant was unable to demonstrate a special condition of hardship to justify approval . Houtz Variance ( 1820 10th St ) Mr . Houtz petitioned the Board to reconsider a variance denial ( March 7 , 1991 meeting ) , but changing his original request to include only an accessory building height variance from 16 feet maximum to about 28 feet ; he deleted a request for variance in rear-yard setback from 20 feet to zero feet for a proposed residential addition . Mr . Houtz presented an improved drawing of his proposed project to construct an attached garage paralleling the alley ( zero setback ) with a hip roof to merge into the roof line of his present residence ( approximately 28 feet elevation ) . He also presented signed approvals from adjoining property owners . F In discussion , Mr . Houtz did not have available dimensional data needed to determine the actual height variance requested for Board consideration . A motion for variance continuance to the next meeting was made ( Young/Snyder ) and passed with all ayes .
