REGULAR MEETING
Meeting called to order by Vice-Chairman John Curtis at 7:05PM.

Minutes of the August 6, 1998 meeting were approved.
Ballenger Variance(1519 10th Street
Mrs. Ballenger reviewed this request for a side-yard setback variance from 10 feet to zero feet along
J Avenue to construct a 1'/z-car garage attached to their existing residence; garage entrance would
be from 10th Street.
Mrs. Ballenger explained that the layout of the residence on the 60' X 100' lot limits possible locations
for building the proposed garage. Another factor is garage accessibility for their handicapped child
which, she stated, precluded a detached rear-yard location. The garage in the original construction
had been converted to living quarters. Mrs. Ballenger noted that J Avenue (platted 80-foot) paving is
approximately 28 feet from the property line, already providing a reasonable setback. There is nil
likelihood that J Avenue would be widened in this developed residential neighborhood. She stated
that the garage will be over 25 feet from 10th Street (also platted 80-foot) so that traffic sight
impairment at the J Avenue and 10th Street intersection will not be a problem.
City Staff comments: Mr. Lervik mentioned the need for a land survey, sight consideration, and
compliance with City Standards regarding driveway impact on the existing sidewalk. A letter from Mr.
Stavig, 1602 10th Avenue, 1) noted a potential line-of-sight concern at the above intersection,
suggesting installation of two-way stop signs on J Avenue and 2) requested that the garage
construction be architecturally consistent with the existing residence as the Ballenger property is in
full view from his residence. Mrs. Ballenger assured the Board that the garage will be finished as an
extension of the residence and will have a small cupola for effect.
A motion to grant the setback variance was made (Mehler/Wilson) and passed with all ayes. The
Board reasoned that a combination of hardships for the applicant favored the proposed garage
location with minimal impact on the area. The Board also extended the permit application time-period
from 90 days to 270 days at Mrs. Ballenger's request for sufficient time to design the garage.
Knorr Variance (3604 10th West)
Mr. Wilson was excused from this issue since he knows Mr. Knorr.
Mr. Knorr reviewed this request for variances to 1) increase land coverage from a maximum 35% to
38%% and 2) reduce rear-yard setback from 20 feet to 17 feet to construct a single-level residence on
a 8,305 sq.ft. lot.
Mr. Knorr explained that he has designed the proposed residence placed lengthwise (front-to-back)
on the 75-foot wide lot rather than the more common side-to-side configuration to achieve over an
18-foot setback from the adjacent building lot; the other side borders an undeveloped platted street.
He feels this building arrangement will lessen a crowded appearance of a large home on a small lot.
In addition his design includes an enclosed RV garage within the structure. To accomplish these
objectives, he is thwarted by an abnormal lot configuration -the lot faces a partial cul-de-sac which
reduces front yard space up to 14 feet. To obtain a reasonable front-yard setback from the street, he

proposes to encroach the rear-yard setback three feet. Also, the land area of the large house, 2-car
garage, RV garage, and decks exceed the maximum land coverage for the lot. He pointed out that
adjacent lots along 10th West are not burdened with a cul-de-sac that reduces front-yard space.
City Staff comments: Mr. Frank noted that a land purchaser should understand lot conditions and
restrictions prior to purchase. Mr. Mansfield so no demonstrated "hardship" in this petition. Mr. Lervik
commented on the potential of setting a precedent decision for other landowners in the area.
Mrs. Richardson, rear-yard adjacent property owner, stepped through the four criteria considered by
the Board in assessing a variance request and how they applied, in her mind, to Mr. Knorr's petition.
She did not support the request for a 17-foot rear-yard setback.
A motion (Mehler) to grant the requested variances was made but had no second.
A motion to deny the requested variances was made (Curtis/Rosenberger) and passed with all ayes.
The Board felt that the applicant did not demonstrate a hardship in his request -the building plans
could be readily adapted to comply with conditions of the Zoning Ordinance.
