Subject: Guemes Ferry Breakwater Maintenance- Shoreline exemption
Dear Ms. Janke:
Skagit County proposes to perform maintenance on the marine breakwater at the Guemes Ferry
slip on the Anacortes side of Guemes Channel. We are requesting exemption from Shoreline
Permitting because the project is maintenance and repair of an existing structure.
The work will entail removing creosoted timbers and wales and replacing them with plastic
"timbers"and steel W Beam wales. The wales and timbers in the breakwater have insect
damage and rot. This project will repair the north 77 feet of the breakwater wall.
This JARPA is also being submitted to Brian Williams, WDFW habitat biologist, and Olivia
Romano, U.S. Army Corps of Engineers. Our work will be performed according to the work
window allowed by the Hydraulic Projects Approval,USFWS and NMFS.

This is the Skagit County Guemes Ferry Terminal,Anacortes side. The facility includes a dock, dolphin wingwalls, a
breakwater, piling dolphins and a steel headframe and transfer span to the ferry slip. The marine structures located in the
channel guide the ferry to the landing slip. These include seven pile-dolphin fenders and a 202'longpilingbreakwater
e that
runs north-south.There is an Aid to Navigation at the north end of the piling breakwater, at the Outer Harbor line.
The breakwater deflects the strong current,wind and waves from the ferry slip,which aids the ferry landings.

The project includes the following activities:
Mobilization of tug and barge with crane to the ferry terminal.
Replacement of the north 77 feet of treated timber breakwater(hanging pilings)and wales with reinforced plastic'timbers' and
steel W-beams wales: including welding new steel W beams to the existing steel pilings and bolting plastic timber hanging
piles to the steel W-beam wales. The crane will be used to hoist the steel wales and timbers into place.
All material for the wales will be steel; no creosote treated timber will be used. Divers will be used to weld the lower wale to
the steel piling and to bolt the timbers to the wales.
All timbers to be reinforced 12"square plastic, replacing creosote timber piles in their original location. All wales to be 9"x 9""
steel w-beam.
lb. DESCRIBE THE PURPOSE OF THE PROPOSED WORK AND WHY YOU WANT OR NEED TO PERFORM IT AT THE SITE. PLEASE EXPLAIN ANY SPECIFIC NEEDS THAT HAVE INFLUENCED
THE DESIGN.
This is maintenance and repair. Marine facilities require periodic replacement of the elements of the structures that are
susceptible to weathering and decay. The treated timber part of the structure is at life expectancy,with insect damage and rot
in the wales and timbers. The bottom wales have substantial section loss and are crushing causing the hanging piles to fail.
An aid to navigation with solar panel, light and battery are mounted on the end steel piling. The steel pilings are in good
condition and do not require maintenance at this time.
7c DESCRIBE THE POTENTIAL IMPACTS TO CHARACTERISTIC USES OF THE WATER BODY. THESE USES MAY INCLUDE FISH AND AQUATIC LIFE,WATER QUALITY.WATER SUPPLY,
RECREATION,and AESTHETICS. IDENTIFY PROPOSED ACTIONS TO AVOID,MINIMIZE,AND MITIGATE DETRIMENTAL IMPACTS.AND PROVIDE PROPER PROTECTION OF FISH AND
AQUATIC LIFE.ATTACH A SEPARATE SHEET IF ADDITIONAL SPACE IS NEEDED.
The barge will not be grounded on the bottom. The duration of the project is short,and the barge will not shade eelgrass
beds for period of time sufficient to cause damage. There will be no permanent impacts to the waters or aquatic life in
Guemes Channel. No changes will be made to the length, breadth or depth of the structure being repaired.

Shoreline Permit#266
Development pursuant to this permit shall be undertaken pursuant to the following terms and
conditions:
1. The scope of this project not exceed that as set-out in the shoreline application
(including attachments), the accompanying SEPA checklist(including attachments).
2. Silt fencing shall be installed during construction. Vegetation removed during
construction shall be replanted with vegetation chosen for its value as bird habitat.
3. Grade and Fill and Building Permits shall be secured from the City of Anacortes prior
to any filling or construction.
4. This project is subject to applicable water, sewer, and stormwater hookup fees and
transportation, fire, school, and park impact fees. These fees are payable at levels in
effect at the time of building permit issuance and may differ from those fee levels
currently in effect.
5. There shall be no impediment to hand launch boats under 20 feet.
6. The Park and Recreation Department shall bring back the landscaping plan to the
Planning Commission for approval.
7. Any violation of this permit and its conditions shall constitute a violation of the State
Shoreline Management Act and its regulations and be subject to its penalties
This permit is granted pursuant to the Shoreline Management Act of 1971 and nothing in this permit
shall excuse the applicant from compliance with any other federal, state, or local statutes, ordinances,
or regulations applicable to this project, but not inconsistent with the Shoreline Management Act
(Chapter 90.58 RCW).
This permit may be rescinded pursuant to RCW 90.58.140(8) in the event the permittee fails to
comply with the terms or conditions hereof.
Construction pursuant to this permit will not begin or is not authorized until thirty days from the date of
filing as defined in RCW 90.58.140(6) and WAC 173-14-090, or until all review proceedings initiated
within thirty days from the date of such filing have terminated: Except as provided in RCW
90.58.140(5)(a)(b)(c).

Findings of Fact and Conclusions of Law and Decision Thereon
FINDINGS OF FACT
1. General Background
1.1 The City of Anacortes Planning Director has been designated the Shorelines "Administrator"
and "Environmental Officer" for the City of Anacortes Shoreline Management Master Plan,
Section 5 - Definitions, Appendix C.
1.2 Under Section 11: Permit Procedure, d) "Not more than 5 working days after the 30 day
review period, or following a hearing, if necessary, the Environmental Officer shall
recommend approval or denial of the permit to the Planning Commission who shall approve
or deny the permit at their next meeting. If the Planning Commission does not act on the
permit the decision of the Environmental Officer shall stand."
1.3 Application was made on July 15, 2002 for a Shoreline Substantial Development/Conditional
UseNariance/Special Use Permit for: proposed upgrades to provide a passive recreation
park amenity on a 1.5 acre site generally at the end of 6th Street and "I" Avenue including, !
but not limited to, curbs and sidewalks, paved parking area for 13 cars, and a path to a
lookout point at 1706 6th Street, Section 13, Township 35 North, Range 1 East, Anacortes,
Skagit County, Washington. The application is shown as Exhibit 1.
1.3.1 The vicinity map and site plan are shown as Attachment A to Exhibit 1 (four
pages)
1.4 The proposed project is located on Guemes Channel.
1.5 The proposed project is designed so as to formalize and improve an area historically used
by the community for recreation and enjoyment of the shoreline.
2. State Environmental Policy Act
2.1 A Determination of Nonsignificance (hereinafter "DNS") was issued for this project on July
17, 2002 by the City of Anacortes, the SEPA lead agency. Exhibit 2 (includes
Environmental Checklist)
2.2 The DNS was made available for public comment on July 17, 2002 and mailed that same
day to the following agency with a deadline for comment of September 3, 2002: State
Department of Ecology.
2.3 The DNS was published in the Anacortes American on July 24, 2002 again with a deadline
for public comment of September 3, 2002.
2.4 No letters of comment were received in response to this DNS.
3.0 Notice
3.1 Section 11: "Permit Procedure", page 6, item b) of the Shoreline Master Plan with regard to
Public Notice states, in part:
"Upon receipt of the application, the Environmental Officer shall instruct the applicant to
publish notices of the application once a week for two consecutive weeks in a newspaper of
general circulation in the City of Anacortes. In addition, the Environmental Officer shall post
at least four copies of the notice prominently on the subject property or in conspicuous
public places within 300 feet thereof. Within thirty days of the final publication of notice, any
interested person may submit his views upon the application, in writing, to the
Environmental Officer."
3.2 Notice of Shoreline Substantial Development/Conditional UseNariance/Special Use
Application, Notice of Public Hearing, Notice of Completeness, and Determination of
Nonsignificance were published in the Anacortes American on July 24, 2002 and July 31,
2002 (Exhibit 3) and four copies of the Notice were posted on the site and copies were also
posted at the Municipal Building, Library and Post Office on July 19, 2002 (Exhibit 4).
3.3 Four letters of comment was received in response to this Notice of Application.

3.4. Written comments were received from staff and incorporated into these Findings as follows:
The application was received on July 15, 2002 and distributed to City staff on July 19, 2002
requesting that the Planning Department be notified of any additional information needed to
evaluate the application. No additional information was requested and the application was
determined to be complete and the applicant notified. On September 4, 2002 city staff met
to submit recommendations on merits of the application. Proposed conditions 1-5 are
standard conditions. It is noted that additional issues will be addressed in City staffs review
of the Building Permit Application that will follow on from approval, if granted, of this
application.
3.5 The 30-day application review period for this project ended on September 3, 2002 and the
SEPA review period ended on August 5, 2002. The Environmental Officer forwarded
Findings of Fact and Conclusions of Law to the Planning Commission on September 5,
2002. The Planning Commission reviewed this permit on September 11, 2002. The
meeting was continued to September 25, 2002 at 4:00 p.m. in order to conduct a site visit.
The Public Hearing was reconvened on September 25, 2002. At the conclusion of the
Public Hearing the Planning Commission voted to approve the project subject to the
conditions outlined on Pages 8 and 9.

4.0 Shoreline Master Plan
4.1 The subject property is in a shoreline area designated Urban I by the Shoreline Master Plan
for the City of Anacortes. This designation is primarily for those areas which are heavily
developed for industrial purposes and those which are appropriate for industrial purposes.
The intent of the designation is to provide for efficient utilization of suitable shoreline areas
for water dependent commerce and industry consistent with the Shoreline Management Act
of 1971, as amended. (Corresponds to Heavy Manufacturing Zones).
4.1.1 Appendix A, Use Activity Regulations states: "Recreation — Urban I Designation:
Permitted when meeting requirements for that use and shoreline area."
4.2 The applicable goals and policies of the Shoreline Master Plan have been addressed by this
application as described below.
4.2.1 GOALS AND OBJECTIVES
SHORELINE USE ELEMENT
GOAL Shorelines are to be managed and activities coordinated in order to preserve
long term multiple benefits of the various shoreline resources.
Objective: Identify and designate those shoreline areas suited for particular long term
uses, including conservancy, recreational, residential, commercial, and industrial.
4.2.1.1 As conditioned below, the proposed project will preserve both the long-term
recreational environment and water quality of the shoreline.
4.2.2. SECTION 20: Use-Activity Policies and Regulations
(18) RECREATION: Recreation and refreshment of body and mind through forms of play,
sports, relaxation, amusement or contemplation.
Policies
a. Public recreation facilities should be planned and designed to augment and enhance
private recreation facilities and vice-versa.
b. Unique shoreline recreational areas and vistas shall be preserved for future
generations. •
c. Recreational planning and development should recognize the wide variety of needs
generated by the diverse local and regional population. •
4.2.2.1 As conditioned below, the proposed project will protect and preserve the
shoreline.

Regulations
a. Commercial recreational developments shall conform to relevant regulations
contained in this Master Plan.
b. Recreational development shall not unduly burden or create conflicts with adjacent
shoreline uses.
c. Recreational developments, public and private, shall be located, constructed, and
operated so as not to be a hazard to public health and safety nor should they
materially interfere with normal public use of the water and shorelines.
4.2.2.2 This regulations are addressed in project conditions.
(19) GENERAL REGULATIONS FOR SHORELINE AREAS:
d) Street rights-of-way or utility easements which offer physical or visual access to the
shorelines or water body shall be preserved.
13) LANDFILL: The creation of upland areas or the elevation of existing upland by deposition
of soil, dredge spoil, or other solid material onto land or into shallow water bodies:
Policies
a. Landfills which reduce the area of marine surface waters should be permitted for
water dependent uses only.
4.2.2.3 The proposed use is a water-dependent one. Additionally, the only landfill
will involve an estimated 3,500 cubic yards of fill to be graded/moved in surface preparation.
b. Fill materials are not to contain pollutants which could cause an adverse impact
upon water quality.
4.2.2.4 This requirement is addressed in Condition#3.
c. Landfills should be landscaped to maintain or improve existing views and prevent
erosion where feasible.
4.2.2.5 This requirement is addressed in Condition# 3.
d. Landfill proposals should demonstrate a reasonable need and consistence with the
Act and this program.
4.2.2.6 The landfill proposed is necessary to provide parking and access for the
waterfront park, a water-dependent use.
e. Review of proposals for landfills should assess qualitatively and quantitatively the
overall value of the landfill site in its present state versus the proposed shoreline use
to be created and other future potential public or private shoreline uses; these
should be expressed in short and long range economic, social. and environmental
terms.

4.2.2.7 In economic terms, the project will bring the project site into use as an
important recreational site that is compatible with the surrounding neighborhood and adjacent
marine environment.
f. Landfills should be designed no larger than necessary for the proposed use.
4.2.2.8 The proposed landfill is designed to support the proposed waterfront park
facility.
g. Landfills should minimize and mitigate, by design and construction adverse impacts
to the shoreline and aquatic environment and to nearby land and water uses.
4.2.2.9 The proposed waterfront park is designed to protect the shoreline.
Regulations
a. Landfills shall comply with "Criteria for Governing the Design of Bulkheads, Landfills,
and Marinas in Puget Sound, Hood Canal, and Strait of Juan de Fuca, for Protection
of Fish and Shellfish Resources," State of Washington, Department of Fisheries,
February 5, 1971.
4.2.2.10 This regulation is included in Conditions#3.
b. Landfill materials shall be of such quality so as to not significantly degrade existing
surrounding levels of water quality.
4.2.2.11 This regulation is included in Condition # 3.
c. All perimeters of fills shall use vegetation, retaining walls, or other means for erosion
control.
4.2.2.12 This regulation is addressed in Condition # 3.
d. Landfills which reduce the area of marine surface waters shall be allowed only for
those water dependent uses consistent with this Master Plan.
4.2.2.13 The fill proposed is for the purposes of developing a transition area
between the gravel parking area and the ordinary high water line.
e. Landfills may be constructed if the applicant can demonstrate the following:
1) the proposed landfill location and design will minimize the interference with
water flow and circulation, and disruption of natural shore processes.
4.2.2.14 No significant interference with water flow and circulation or disruption of
natural shore processes has been identified.
2) the proposed landfill will not be located on a site important for wildlife,
shellfish, or finfish, including feeding, reproduction, and rearing areas, or that
impacts to such habitat areas are mitigable.

4.2.2.15 The proposed landfill site will not be located so as to impact habitat areas.
3) the proposed landfill will not pose significant restrictions on navigation or loss
of public access.
4.2.2.16 The proposed landfill will enhance public access by reducing the grade
from the parking lot to the water.
4) the proposed landfill location and design will blend with the existing shoreline
features and adjacent properties.
4.2.2.17 The proposed landfill will enhance public access by reducing the grade from
the parking lot to the water.
Environments
a. Urban I: Landfill is permitted in the Urban I shoreline area designations, subject to
the policies and regulations, as provided below:
1) landfill involving placement of less than 1,000 cubic yards is a permitted use.
2) landfill in excess of the limits of subsection (1) is a special use.
SECTION 23) Shoreline Special Uses. The purpose of special use is to allow greater flexibility in
varying the application of the use regulations in a manner consistent with the policies of this Master
Plan. Uses which are identified in this Master Plan as special uses may be authorized by the
Planning Commission after a public hearing and upon a showing by the applicant that the following
conditions are satisfied:
4.2.2.18 "A public hearing has been held on this application."
1. The proposed use will not have a significant adverse effect upon the environment or
other adjacent or nearby uses, or such adverse effects can be mitigated, or the
public benefits of such use outweigh such adverse effects.
4.2.2.19 The proposed use as described above and conditioned below will not
have a significant adverse impact on the environment. As conditioned the waterfront park and site
development will add public benefit.
2. The proposed use will be consistent with the policies and general intent of this
Master Plan.
4.2.2.20 This requirement has been addressed in these Findings of Fact and
Conclusions of Law.
3. The proposed use will not interfere with the public use of public shorelines.
4.2.2.21 The proposed use will improve public access to the shoreline in and around
the project site.

4. The location, design and appearance of the proposed development will be
compatible with surrounding uses.
4.2.2.22 Development of the site to productive use will improve compatibility with
surrounding public facilities and neighborhoods.
In authorizing a special use, the Planning Commission may impose requirements and conditions in
addition to those expressly authorized in the use regulations to prevent undesirable effects of the
proposed use.
4.2.2.23 The Planning Commission in its conditions has addressed potential
undesirable affects of the proposed use.
5.0 Zoning Ordinance
5.1 The City Zoning Map establishes zone boundaries and the City Zoning Ordinance
establishes (1) the permitted use of land in the various zones and (2) development
standards.
5.2 The subject property is in a Light Manufacturing (LM) Use District, Chapter 17.18 of the
Anacortes Municipal Code, Title 17, Zoning.
5.2.1 Section 17.18.010 - "Purpose" states: The Light Manufacturing District (LM) is
intended to accommodate those businesses which are not compatible with uses found in the
Central Business District, and industrial and other uses which do not create noise, smoke, odors, or
other objectionable nuisances or hazards detrimental to uses in the LM District or surrounding
districts.
5.2.2 Given its small scale nature and the supporting function it provides in this zone, the
general purposes as set forth in Section 17.18.010 have been met by this proposal.
6.0 Anacortes Comprehensive Plan.
6.1 The City of Anacortes adopted a Comprehensive Land Use Plan (hereinafter
"Comprehensive Plan") in 1982. The Comprehensive Plan contains general policies and
goals which are to be followed for development in the City. Comprehensive Plan at 1. The
Comprehensive Plan contains general overall goals and specific policies for certain types of
land. The following portions of the Comprehensive Plan potentially apply to this project.
6.2 "General Goal #1. Create and maintain a healthy, aesthetically pleasing high quality
environment that maximizes the opportunity for all citizens to share the social,
psychological, physical and economic benefits of Anacortes/Fidalgo Island."
Comprehensive Plan, p. 8.
6.2.1• The project will further this General Goal #1 of the City of Anacortes Comprehensive
Plan by providing an attractive, safe waterfront park for the enjoyment of the community without
changing the outward appearance of the adjacent residential neighborhood.

6.3 "Recreation and Tourism Goal # 6, Policy (c): Implement the Waterfront Improvement
Program for the development of street-end parks. Comprehensive Park and Recreation
Plan, City of Anacortes, 1989."
6.4 "Recreation and Tourism Goal # 7,: Increase the opportunities for public access to and
enjoyment of the shorelines of Anacortes.
6.4.2 The project will further the Goals and Policies of the City of Anacortes
Comprehensive Plan by providing shoreline access utilizing a waterfront park.
7.0 Findings of Fact
7.1 The requirements of the State Environmental Policy Act have been complied with.
7.2 The Public Notice and Public Hearing requirements of the Shoreline Management Act have
been complied with.
7.3 The project is consistent with the shoreline designation, general goals and objectives of the
Anacortes Shoreline Master Plan.
7.4 The proposed use will not have a significant adverse effect on the environment or adjacent
or nearby uses, and in fact will bring additional benefits in line with the shoreline designation
of the site.
Conclusions
•
A Shoreline Substantial Development and Special Use Permit# 266 should be issued to the City of
Anacortes for the development of Guemes Channel Kiwanis Waterfront Park, 6th Street and "I"
Avenue, subject to the conditions that:
1. The scope of this project not exceed that as set-out in the shoreline application
(including attachments), the accompanying SEPA checklist(including attachments).
2. Silt fencing shall be installed during construction. Vegetation removed during
construction shall be replanted with vegetation chosen for its value as bird habitat.
3. Grade and Fill and Building Permits shall be secured from the City of Anacortes prior
