Smith, Stuart Janke Staff present: Ed Frank Ward Variance (1210 6'h Street) Mrs. Richardson, architect representing the applicant, reviewed this request for a variance in the height of an accessory building from the maximum 16 feet to 18'8" in the construction of a new garage. Mrs. Richardson explained that the applicant has embarked on a project to enlarge their historic 1920 home in "Anacortes Old Town"; construction of a new garage replacing an existing garage and shed is included in the project. The basic design premise for the project is to maintain the original architecture of the home, primarily the 10/12 pitch of the roof on the new construction. This includes two new wings and the garage, the latter necessitating the increase in height; observing the 16-foot accessory building height limitation would yield an unacceptable (to the applicant) 7'%/12 pitch. The garage will be setback 1'7" and have a parallel entrance from the rear alley. Mrs. Richardson commented that it is the policy of the City and the Anacortes Historic Preservation Board to encourage modification to historic homes to respect their historic character. A memo from the latter encouraged decision makers to consider the benefits of historic preservation. The subject home is not registered nor on the 1987 historic survey; it was featured on a historic home tour in the 1990s. Written memos from Mr. McDermott and M/M Loughney both adjacent neighbors, and Mrs. Delourme supported the variance request; in verbal comment Ms. Gorzela and Mr. Revelle supported the request as important in the historical context of"Old Town". Mr. Snyder expressed concern about the historic designation, commenting that a large number of homes in Anacortes would qualify as historic basis Mrs. Richardson's definition. Mr. Janke noted that a less wide garage would reduce height with a 10/12 pitch. A motion was made (Curtis/Mehler) to grant the variance in accessory building height and passed with three ayes (Curtis, Wilson, Mehler), two nays (Snyder, Boubeau). The majority considered the historic significance of the proposal in their decision. Where the rear yard abuts a platted alley,a detached accessory structure,or that portion of the primary structure used as an accessory structure,may be built in a rear yard up to the alley property line,provided that it is set back a minimum of three feet from any side property line,and is no larger than one thousand square feet and no more than sixteen feet in height. If the accessory structure is a garage,built so that vehicles enter the garage from the alley in a direction substantially perpendicular to the alley, the garage doors shall be set back a minimum of ten feet from the alley property line to allow adequate turning distance for vehicles. 3.The lot coverage of any accessory structure exceeding one hundred forty-four square feet shall count as part of the percentage of lot coverage permitted in this zone. Chapter 17.48 ACCESSORY BUILDINGS, STORAGE,AND DOCKS 17.48.010 General provisions. A.Accessory buildings shall not be constructed prior to the commencement of construction of the main building. B.Accessory buildings shall not exceed one story or sixteen feet in height.Accessory buildings in all residential zones,except RI shall not exceed one thousand square feet in size. C. Uses and buildings customarily accessory to the established principal use shall be allowed in all cases unless specifically prohibited or restricted. Chapter 18.20 HISTORIC PROPERTIES 18.20.070 Relationship to zoning. Properties designated to the register shall be subject to the provisions set forth herein, as well as the bulk, use, setback and other controls of the zoning district in which they are located. Nothing contained herein shall be construed to be repealing, modifying or waiving any zoning provisions. 17.10.040 Powers and duties. The following steps are required for consideration of variance: a. Notice of public hearing shall be given.Written notice shall be mailed to property owners within three hundred feet of the boundaries of the subject property; b. The board of adjustment shall obtain reports from all affected city boards or departments as part of the information to be considered at the public hearing; c. The public hearing shall be held.Any party may appear in person, or by agent, or by attorney; d. The board of adjustment shall determine in writing whether all of the requirements of subsections (B)(1) and (2) of this section are met; e. The board of adjustment shall further make a finding whether or not the reasons set forth in the application justify the granting of the variance, and that the variance, if granted, is the minimum variance that will make possible the reasonable use of the land, building, or structure; f.The board of adjustment shall further make a finding whether or not the granting of the variance will be in harmony with the general purposes and intent of this title, and will not be injurious to the neighborhood, or otherwise detrimental to the public welfare. 4. In granting any variance, the board of adjustment may prescribe appropriate conditions and safeguards in conformity with this title. Violation of such conditions and safeguards, when made a part of the terms under which the variance is granted, shall be a violation of this title. 5. Under no circumstances shall the board of adjustment grant a variance to allow a use not permitted under the terms of this title in the district involved, or any use expressly or by implication prohibited by the terms of this title in said district. SITE CONDITIONS The existing structures are almost centered east and west on the 90 foot wide lot. The existing land coverage is about 20% and the proposed land cover is approximately 30%. The lot is substantially level and abuts an alley on the north side of the lot. This site is situated in the R3 zone and is surrounded by older single family residences. Many of the residences have single stow garages that abut the alley. STAFF COMMENTS A. Public Works: There is no impact on the public infrastructure. B. I am responding as a member of the community, as a realtor, and as a resident of "Old Town. " I would like to share my personal reaction to the information received for the Ward remodel and the necessity for the Board of Adjustment to review a request for variance to specifically address the height issue of the intended garage design. While the design variance may be subtle from the allowed height, I feel it is important that an approval be considered in that the home owner and architect are attempting to preserve the integrity of the original historic home by replicating the original pitch. I sympathize with homeowners who are making effort to harmoniously maintain the elements of their vintage homes while accommodating contemporary uses, such as multi-use rooms and garages. So many homes in "Old Town" do not have garages or once had one car garages that have been torn down and do not accommodate the needs of a contemporary use. I feel the Planning Department and Board of Adjustment would do well in allowing a variance to have the Ward home respectfully remodelled to the highest level of sensitivity. Case-by-case approvals prevent historic homes from being ultimately demolished. With the intended project, there has been a careful evaluation to maintain asethetic symmetry which enhances the subject property and preserves the unique character representative of the original home. Variance is requested to allow the roof pitch of the new garage to match the roof pitch of the existing house. This would permit the new construction to closely match the existing historic structure. Provisions of Zoning Ordinance from which variance is requested: 17.48.010 limits accessory buildings to 16 ft. in height. An 18'-8" height limit is requested to match the roof slope of the historic home. Justification for variance per the Zoning Ordinance: a. That special conditions and circumstances exist which are peculiar to the land, structures, or buildings involved and which are not applicable to other lands, structure, or buildings in the same district. This home is nearly 100 years old, and is in the "Old Town" area of Anacortes. It is the policy of the City and of the Historic Preservation Board to encourage additions and modifications to historic homes that are designed in a manner which respects their historic character. The slope of the roof is an important element of that historic design character. The historic nature of the home and the steeply pitched roof of the existing house are special conditions which do not apply to all houses in this district. Ward Variance Application Page 2 b. That literal interpretation of the provisions of this title would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this title. Meeting the 16 ft. height limit would require a lower roof pitch than the existing house. This would deprive the applicant of the right to build a garage that matches the proportions of the existing historic house. c. That the special conditions and circumstances do not result from the actions of the applicant. The house was built in 1920, long before the applicants were born, and they have not altered the basic structure of the original house. d. That granting the variance requested will not confer on the applicant any special privilege that is denied by this title to other lan4 structures, or buildings in the same district. Matching the design of a garage to the design of the house adds to the visual harmony of a neighborhood. Other houses which do not have steeply pitched roofs can easily build a garage with a roof pitch that matches the house, and not exceed the 16 ft. height limit. Thus, this variance would allow the applicant to have similar privileges to other properties, and not confer a special privilege. Ward Variance Application Page 3 Project Narrative The applicants own a historic home built in 1920 in the "Old Town" area of Anacortes. It is a two-story building with a small front porch. The primary structure remains virtually unchanged from the original construction. At the rear of the building, a small garage, shop, and rear entry were added at some time in the past. These are in poor condition and will be removed. The owners propose to enlarge the home to accommodate their needs for raising 3 active young boys. They are sensitive to the fact that they own a historic house, and engaged an architect to design the additions in a way that respects and compliments the original architecture. A small one-story guest room wing will be added on the west, and the two- story main structure will be extended toward the north to provide a larger master bedroom upstairs and a family room below. Each of these additions will match the existing house in width, in siding and trim detailing, and in the slope of the roof. The remodeled home and garage will cover 2,483 sq. ft. of a 9,000 sq. ft. lot, for a modest 27.6 % lot coverage. A 50% lot coverage is allowed in this R3 zone. The old garage will be replaced with a new one accessed from the alley. Because it will extend into the rear yard setback it is governed by the code provisions for accessory buildings, limiting the height to 16 ft. That height limit would require the new garage roof to have a lower pitch than the other roofs, thus creating a mis-match between the old and new construction which would be detrimental to the historic character of the home. The proposed garage roof will be only 2'-8" higher than the allowable 16 ft. It will not block neighbors' scenic views.
