This solicitation and review is conducted annually. Y Dakota Creek Rezone Findings of Fact (T, 2.2 The City has established a separate process for property owners to petition for a zone change. Such a zone change will involve changing both the Zoning Map set forth in the Development Regulations and the Comprehensive Plan Map, as these maps are now identical. 2.3 Sentence 3 of the Scope Section of Appendix E of the Comprehensive Plan (Administrative Procedures for Comprehensive Plan Amendments or Revisions) requires elaboration as follows: "A Comprehensive Plan (MAP) amendment must accompany any rezone application. (THIS IS TO BE DONE BY COMPLETING A PETITION FOR ZONE CHANGE IN THE FORM PRESCRIBED BY THE CITY PLANNING DIRECTOR AND FILING THIS WITH A SEPA CHECKLIST.) 2.3.1 The text of Comprehensive Plan Appendix E should be clarified as set forth in Attachment 4. 3.0 Zone Change Proposal 3.1 The Rezone Petition is Attachment 1. 3.2 This Petition identifies the size of the subject property as 1.5 acres and the existing condition of the property as: One administration and two engineering buildings, heavy equipment repair facility, and one vacant and one occupied residential building. 3.3 The Petition includes the required maps and description of the area and surrounding uses in terms of Comprehensive Plan, and Zoning, and Shoreline designations and of existing buildings and roads. II L 4.0 State Environmental Policy Act (SEPAL 4.1 The Planning Director has been designated the responsible official for those proposals for which the City is the Lead Agency. 4.2 The SEPA Checklist that accompanied the Rezone Petition is Attachment 5. 4.3 The SEPA Checklist states that "no changes are likely to occur due to this proposed rezoning..." (D1), that "this proposal does not affect existing utilities and services..." (B16b), and that "rezoning would assure compatibility between permitted and actual uses..." (B81). (j/ 2 Dakota Creek Rezone Findings of Fact 4.4 A Determination of Nonsignificance (hereinafter "DNS") was issued for this project on May 3, 1996 and published in the Anacortes American on May 8, 1996. Attachment 6. The Planning Director has evaluated the impacts of this proposal and determined that this project does not have a probable significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.22C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public on request. 4.5 No comments were received during the SEPA public comment period which ended May 20, 1996. 5.0 Notice 5.1 The Anacortes City Zoning Ordinance, contains public notice requirements for Rezone Applications. The Ordinance requires the Planning Commission to hold public hearings on Rezone Applications, Section 17.10.090 B(1), with public notice being given as follows: "Except where specified otherwise in the Ordinance Notice of Public Hearings shall be given at least fifteen days in advance of the hearing by posting copies of the Notice of Hearing at the Anacortes Municipal Building, at the United States Post Office in Anacortes, and if applicable, on the property proposed; to be changed. Notice shall also be published once in the official City newspaper at least fifteen days in advance of the hearing. For all Public Hearings Notice of Hearing shall be sent to all property owners within 300 feet of the exterior boundaries of the subject property. Expense of such posting and publication shall be borne by the applicant." Anacortes Zoning Ordinance Section 17.62.010 5.2 On April 19, 1996, a Notice of Application for. the Rezone Permit Application and a Notice of Public Hearing before the Anacortes Planning Commission for a hearing on May 22, 1996, were posted at the Anacortes City Hall and the Anacortes Post Office. The property was posted with both notices on April 30, 1996. All of the posting was done at least fifteen days in advance of the public hearing date. 5.3 On May 1, 1996, May 8, 1996 and May 15, 1996, the Anacortes American published a copy of the Notice. The first publication took place more than fifteen days in advance of the hearing. 0 3 Dakota Creek Rezone Findings of Fact fl 5.4 Because the public hearing involved a Rezone, copies of both notices were mailed to property owners within 300 feet of the exterior boundaries of the subject property on April 29, 1996. 5.4.1 Written staff comments were received and incorporated into these Findings 5.5 A Public Hearing was held before the Anacortes Planning Commission on May 22, 1996. At that meeting the Planning Commission voted to recommend approval of the Rezone Request to the City Council as being/not being desirable and consistent with the Comprehensive Plan (See 8.1). The Planning Commission minutes are Attachment 7. 5.6 After the Planning Commission's hearing, the City Council scheduled a public hearing on the Rezone for June 17, 1996. 5.7 On May 17, 1996, a Notice of Application for the DCI Rezone project and a Notice of Public Hearing before the Anacortes City Council for a hearing on June 17, 1996 were posted at the Anacortes City Hall and the Anacortes Post Office. This posting occurred more than fifteen days before the hearing. 5.8 Copies of both notices were posted on the property on May 17, 1996, more than fifteen days before the hearing date. 5.9 On May 22, 1996, the Anacortes American published copies of both notices. The publication occurred more than fifteen days before the hearing. 5.10 Because the public hearing was for a Rezone, copies of both notices were mailed to property owners within 300 feet of the exterior boundaries of the subject property on May 17, 1996. 5.11 A public hearing was held before the Anacortes City Council on June 17, 1996, pursuant to the notices. 6.0 GMA and Countywide Planning Policies 6.1 All Comprehensive Plan text revisions and map amendments must be consistent with the Growth Management Act Goals and Policies as formulated in the "Countywide Planning Policies, 1992" (Appendix C of the City Comprehensive Plan)(CPPs). 6.2 City staff concur with the applicant's assertion that "the proposal does not ( ` affect existing utilities and services" (Finding 4.3 above); The conclusions 4 Dakota Creek Rezone Findings of Fact cm,, of their analysis are on file with the City Planning Department. Accordingly, the proposal is consistent with the GMA's Urban Growth Goal of "encouraging urban development in urban areas where adequate public facilities and services exist or can be provided in an efficient manner" (CPP 1). 6.3 Future development on the rezone property will further the "infill" policies of CPP 1.5 and 2.6. 6.4 The proposed rezone will further the economic development policies of encouraging "a diversified economic base" (CPP 5.5) and "shoreline dependent" industries (CPP 5.14). 6.5 As the rezone property is currently used primarily for industrial activities and these activities can continue indefinitely no issues relating to the loss of 1.5 acres from the Central Business District are apparent. 7.0 Comprehensive Plan Policies 7.1 Shipbuilding and ship repair fit the Comprehensive Plan's definition of manufacturing as one of "those industrial or manufacturing activities which are engaged in the production of articles or a product from raw or prepared materials by giving them new forms and qualities" (p 10). 7.1.1 Manufacturing goal 1 should be clarified by adding at the end of sentence 3, "...e.g. oil refining and chemical plants." 7.1.2 Given the redesignation of the former "Heavy Manufacturing" zone on western Fidalgo Bay to "Industrial" in Manufacturing Goal 1 the word "heavy" should be deleted (Zoning Ordinance Section 17.16.010). 7.1.3 Based on current figures update sentence one of the Manufacturing Section to read as follows: "Anacortes/Fidalgo Island firms are estimated to be the source of 40% of the manufacturing jobs in Skagit County." 7.2 In that the rezone will facilitate the continued development of DCI's shipyard the proposal will further Manufacturing goal 4 ("Encourage and support water oriented manufacturing in shoreline areas -- fish processing, boat repair"), Policy 4a ("Manufacturing use activities which are most desirable to the City and Port decision makers should be given priority for shoreline manufacturing sites."), and Policy 4c ("Encourage the Port to develop marine oriented activities such as boat building and repair.) 5 Dakota Creek Rezone Findings of Fact C , 7.3 Manufacturing Goal 4 and Policies 4a and b refer interchangeable to boat building and repair and boat repair as water oriented manufacturing to be encouraged in shoreline areas. 7.3.1 Given the Commercial Marine emphasis on marine activities clarify that Commercial Marine Policy 3c covers both boat building and boat repair facilities and include boat building as an expressly permitted use in Zoning Ordinance Section 17.22.020. 7.4 As to Goal 2 of Commercial Goal 2 ("Improve economic growth and well being of the Central Business District"): As the rezone property is currently used primarily for industrial activities and these activities can continue indefinitely no issues relating to the loss of 1.5 acres from the Central Business District are apparent. 8.0 Zoning Ordinance Provisions 8.1 Section 17.14.050 requires that: Application for zone change will be submitted to the Planning Commission. Application shall contain (1) legal description of property proposed for rezoning, (2) reason for rezoning, (3) type of zone requested, (4) signatures of all owners proposing rezoning, (5) a map showing all property owners of the area being proposed for rezoning and (6) a statement of how this benefits the community and will relate to the City's Comprehensive Plan. (7) To facilitate notification of individuals who would be affected by the change, a list of names and addresses of all owners of property located in and within 300 feet of the area proposed for rezoning shall accompany the application. (8) The Commission shall consider at the public hearing whether the proposed zone change is desirable and consistent with the Comprehensive Plan. In the event that the proposed zoning change is not consistent with the Comprehensive Plan, the zoning shall not be changed unless and until the Comprehensive Plan has been reviewed and changed by the City Council. 8.1.1 . The City Council is to consider such proposals concurrently and no more frequently than once every year in order that the cumulative effects of the various proposals can be ascertained. However, at the discretion of the City Council, the Comprehensive Plan may be amended or revised whenever an emergency exists or for: 1) the initial adoption of a sub-area plan, or 2) the adoption or amendment of a shoreline master program, or 3) to resolve a comprehensive plan appeal. Any modifications or adoption of to the Comprehensive Plan and Development Regulations implementing-same are to must comply with the Growth Management Act. Scope: Contained herein and outlined below are administrative procedures that are to be used in amending or revising the Comprehensive Plan. It establishes who may initiate and when a Comprehensive Plan amendment or revision may be considered. A Comprehensive Plan amendment must accompany any rezone application. A Comprehensive Plan Map amendment must accompany any rezone application. This is to be done by completing a petition for zone change in the form prescribed by the City Planning Director and filing this with a SEPA Checklist. Purpose: The Comprehensive Plan is a document by which development, both public and private, is guided and is based upon State planning goals and City long-range goals and policies. The plan is used to assist decision makers and the public with land use issues when determining the nature and intensity of development within the City and the City's Urban Service Growth Area. An- map amendment or text revision to the plan is a procedure by which the City may modify its land use, development or growth policies in order to respond to changing circumstances or needs of the City. WHO MAY INITIATE: A. The City Council or the Planning Commission may by motion initiate consideration of an-map amendment or text revision of the Comprehensive Plan.
