The property in question has been in our family since 1974,when it was purchased by my father-in-law,
Winston Thomas. My father-in-law bought the property intending to hand it down to his son,Fred E.
Thomas,and his sons after him. Unfortunately,Fred passed away before this happened,so the land was
instead deeded to myself,Maria Thomas,and my son,Jeremiah Thomas,with the intent to secure our, -
financial future.
Even while Winston was alive,many discussions were had between us regarding the building of another '
home on the property,or the possible'division of the lots with the'intent of keeping a portion of the `"
property,while being able to sell the other. At no time were either Winston or'myself aware,that after 1978,
a code existed which would prevent us from acting on our future plans. Many homes in my,immediate
neighborhood sit on far smaller lots,and we made the mistake of assuming that we had plenty Of space to do
with what we saw fit,whether it was dividing the property and selling a portion of it,or building on the
vacant space in the lower lots. —
Winston passed away in a vehicle accident in October of 2001,and as the house became vacant,I offered
my daughter and her small family a purchase,option of the two lots that the home,and garage are situated
on. She agreed,and lived in the house with a monthly rental agreement until present day,at which time she
applied for a loan,and was approved. We were not even aware a problem existed until the financial
institution requested the title;at which time unveiled the ruling in 1978,stating that the lot sizes must be,..
7500 sq.ft in order to be sold,divided,or built upon. We had no idea that this code existed,even through a
sale of a single lower lot(lot 8)in 2004,this had never surfaced. We simply did not know.
My daughter and her family would like to buy the lots that the hone and garage sit on,as we had agreed '
upon in 2001. This has become her home for the last 3 years,and she has settled into the neighborhood,as
have her husband and children. Her loan is presently on hold until we can find some sort of solution to this
problem. I would like the option to either build,or sell,the remaining property once my daughter is able to
complete her purchase. Our request is that the variance to the ruling in 1978 be granted,allowing us
exception to the 7500 sq.ft.rule,so that my daughter and family can continue to live in our grandfather's
home,and that my sons and I will be able to utilize the rest of the remaining property.
I have attached photos of homes in our neighborhood,showing that our block has a several homes situated
on lots that fall short of the recommended square footage,and our inquiries regarding Zoning and possible
restrictions recently have led me to discover that we sit right on the edge of the R2 zone,where the square .
foot requirement increases from 6000 ft to 7500 ft. I have included a diagram of lots 4-7,showing the
current lot sizes. I have also included a copy of the County property appraisal,which will show the land • '> '
purchase in 1974 by Winston Thomas,and the ewes family ownership from that time to present.
