WHEREAS, _.Tpilf� pg a Toby {ncy%�, i�6 are the fee simple owners
of that certain property located on 916 34th Street
in the City of Anacortes, which is property is more particularly
described in the attached "Exhibit A" , which is hereby
incorporated into this agreement by reference, as if fully set
forth, and
WHEREAS, said property owner is presently applying for a
building permit, and
WHEREAS, ToDD A�* YbD11 McNau9826 acknowledge that
approval of a building permit will create some negative traffic
and drainage impacts in the area, and
WHEREAS, -Too-1 Mu7ue-u8e26 acknowledge that certain
requirements and/or improvements imposed on the development of
the property are reasonable and will serve to protect the public
needs and will also serve to neutralize expected negative
impacts from the development of the above referenced property as
stipulated in Ordinance No. 1954 .

PROMISE to perform the following improvements by
March 1 , 1996 if the City of Anacortes approves the
building permit request:
A. Improvements, and/or Requirements Agreed to Perform.

1 . Construction of curb and gutter, sidewalks and street
paving in accordance with the City of Anacortes
Sub-division Code and City of Anacortes design &
construction standards.
B. Binding Property.
That if a building permit is approved, Tpy p Y� Tby /Y/eA2'pj8erZ-
agree that the above referenced list of improvements,
and/or requirements shall run with the land. It is the
intent of -rai)l) Fwo npy 619 NBt to bind the future
successors and assigns of this property to this agreement.
It is agreed that upon a building permit approval for this
property being given, City of Anacortes will immediately
file this agreement with the Skagit County Auditor to
appear as a matter of record against the described property
as evidence of the intent to bind the property.

C. Enforceability of Agreement.

approval of a building permit by the City on this property
constitutes acceptance and consideration for this agreement
and that this agreement will constitute a valid contract
enforceable by the City in a court of law.
. That should the City disapprove the building permit of this
property, the promises and agreements contained herein shall be
and remain unenforceable and of no legal force and effect, and
that any obligation created hereunder shall be terminated.
