HomeMy WebLinkAbout2019-07-22 City Council Minutes Approved City Council Minutes—July 22,2019 Mayor Laurie Gere called to order the Anacortes City Council meeting of July 22, 2019 at 6:00 p.m. Councilmembers Eric Johnson,Anthony Young,Ryan Walters,Brad Adams, Carolyn Moulton,Bruce McDougall and Matt Miller were present. The assembly joined in the Pledge of Allegiance. Announcements and Committee Reports Planning Committee: Mr. Walters reported from the committee meeting earlier in the evening. He indicated that those present discussed updating the city's land use fees to remove from them from the AMC and to adopt new fees as part of the unified fee schedule. He said the committee also discussed the multifamily property tax exemption which had expired but would be presented in revised form for a public hearing in August. Mr. Young commented on the noose that had recently been found in an Anacortes park and thanked the mayor for acting expeditiously in response. Mr. Young spoke movingly about growing up in the south and witnessing racial violence. Reflecting concern expressed by his constituents,Mr. Young urged using this event as a reminder of the need to speak up in support of inclusion and tolerance for all members of the community. Public Comment No one present wished to address the Council on any topic not already on the agenda. Consent Agenda Mr. Walters removed Item 5g,Noise Variance: 2019 Asphalt Overlay—Commercial Avenue-Fidalgo Ave to SR20, from the Consent Agenda. Mr. Johnson moved, seconded by Mr.Young,to approve the following Consent Agenda items. The motion carried unanimously by voice vote. a. Minutes of July 15,2019 b. Approval of Claims in the amount of: $264,548.92 c. Contract Award: 14th Street Waterline Replacement#19-100-WTR-001 d. Contract Modification: Sewer Cost of Service and Rate Design Study#18-099-SEW-001 e. Interlocal 232 with NoaNet-Modification 04: Fiber Optics Project f. Contract Award: PSE Lighting Orders for SR20& Ship Harbor RAB#19-123-ENG-001/002 The following vouchers/checks were approved for payment: EFT numbers: 93951 through 93978,total$51,332.69 Check numbers: 93979 through 94023,total $212,343.99 Wire transfer numbers: 253109 through 25315,total$871.83 g.Noise Variance: 2019 Asphalt Overlay—Commercial Avenue-Fidalgo Ave to SR20 Mr. Walters moved, seconded by Mr. Adams,to approve the noise variance request based on a finding that immediate compliance with the noise limits between the hours of 10 p.m. and 7 a.m. cannot be achieved in light of economic and physical factors. The motion carried unanimously by voice vote. OTHER BUSINESS Ordinance 3046: Amending AMC Chapter 18.04 State Environmental Policy Act Planning Director Don Measamer introduced Ordinance 3046 which would amend AMC Chapter 18.04 to remove outdated Washington Administrative Code(WAC)citations and add a new section 18.04.120 C clarifying when exemptions to SEPA apply consistent with WAC 197-11. Mr. Measamer summarized the Anacortes City Council Minutes July 22,2019 1 ordinance as reflected in the packet materials for the meeting. He added that the city had met the requirements for submittal to the Washington State Dept. of Commerce for expedited review,was granted the expedited review, and that Dept. of Commerce had had no comments. Mr. Miller confirmed with Mr. Measamer that all changes from the current code were reflected in the strikethrough/underline version of the ordinance that had been included in the packet materials. Mr. Walters moved, seconded by Mr. Miller,to approve Ordinance 3046 as presented. Vote: Ayes—Young, Walters,Adams,Moulton,McDougall,Miller and Johnson. Motion carried. Ordinance 3040: Development Regulations and Zoning Map Amendments Planning Manager Libby Grage presented Ordinance 3040 for adoption with revisions as requested by City Council at its meeting on July 15,2019.Ms. Grage's brief slide presentation was added to the packet materials for the meeting. She recommended adoption of the ordinance as presented. Ms. Grage responded to councilmember questions clarifying aspects of the ordinance and the process of codification once it was adopted. Ms.Moulton requested that staff add a table of contents for ease of use by the public between adoption and codification. Ms. Grage agreed to do so and said she would alert Council when codification was complete. Mr. Walter moved, seconded by Mr. Johnson,to approve Ordinance 3040 Amending the Development Regulations Contained in Anacortes Municipal Code Title 16 Subdivisions, Title 17 Zoning,Title 19 Unified Development Code, and the Official Zoning Map.Vote: Ayes—Walters,Adams,Moulton,McDougall,Miller, Johnson and Young. Motion carried. Mayor Gere extended the Public Comment section of the agenda to late arriving members of the public. Reverend Terry Kyllo urged the community to stand up together against hate crime, defamatory language, and threats to any member of the community. Rev. Kyllo noted vandalism at the local golf course, a swastika for sale at Shipwreck Days and a noose was recently staged in a city park. He said it is important to speak out against free speech that is fear raising, dehumanizing or otherizing.He urged City Council to stand up for each and every citizen.
