SECOND STREET,ROOM 202 MOUNT VERNON,WA 98273 Page 1 of 5 DOCUMENT TITLE: INTERLOCAL COOPERATIVE AGREEMENT FOR LIBRARY SERVICES DATE SIGNED: GRANTOR: SKAGIT COUNTY GRANTEE: MUNICIPALITIES OF MOUNT VERNON,ANACORTES, BURLINGTON,SEDRO WOOLLEY AND CONCRETE COUNTY CONTRACT NO: SKAGIT COUNTY INTERLOCAL COOPERATIVE AGREEMENT Contract# C20020314 FOR LIBRARY SERVICES Page 2 of 5 This Interlocal Cooperative Agreement for Library Services is entered into between Skagit County,hereinafter referred to as"County",and the municipalities of Mount Vernon, Anacortes,Burlington, Sedro Woolley and Concrete,hereinafter referred to as"City(ies)and Town(s)"and pursuant to RCW 39.34. This Agreement is based upon the following facts and circumstances: The County does not,nor is it required by statute to,provide general library services to the citizens residing in unincorporated Skagit County. Historically,each of the Cities and Towns has provided library services to residents and nonresidents alike. Depending upon the policies in each of the Cities and Towns,non-residents have paid a fee for library services. Due to increasing competition for funding and increasing library usage,the Cities and Towns are having difficulty providing services to residents and non-residents alike. The County, in 2002,has made funding available for a portion of the costs to provide services to non-resident users of libraries located in the Cities and Towns. In consideration of the facts listed above,the parties agree as follows: 1. During 2002 the County will provide the Cities and Towns a total sum of$100,000 to assist in providing library services to the citizens of unincorporated Skagit County. The sum will be distributed to the Cities and Towns based upon the library book,audio,film, video and subscription collection and circulation of each municipal library,except Concrete,which shall receive a flat sum of$4,000. 2. Based upon circulation and collection figures provided by the Cities and Towns,the $100,000 will be distributed as follows: Anacortes $27,200 Burlington $13,264 Concrete .$4,000 Mount Vernon $40,619 Sedro Woolley $14,917 0° TOTAL $100,000 3. None of the County funds received by the Cities or Towns may be used to supplant ammo funding that the City or Town would otherwise provide for library services by each City r: or Town. Each of the Cities and Towns will receive its payment for library services when 1° o and only when the following information has been provided to the County: cn� a) Documentation that non-resident library users,except in the Town of Concrete,pay p at least$10 per library card; u Q. ciogoM b) Documentation in the 2002 Cities or Towns library budget indicating the County o a llmmm services payment will be used for 2002 library activities for the express benefit of non-resident library users; !s c) Documentation that shows the City's or Town's a budget amendment expressing the caa addition of these funds to the present 2002 adopted City or Town budget. If this allocation was incorporated into the current fiscal year budget,documentation that shows that this allocation is an increase from the 2001 budget;and d) Final Audited Financial records to show that these funds are being used in the manner specified. 4. It is agreed that any portion not used for its intended purpose will be returned to the County within a reasonable time period after the close of the fiscal year. 5. All assets acquired as a result of this funding will become the property of the respective City or Town. Each City or Town will be responsible for all aspects of library operation. 6. Administration: The following individuals are designated as representatives of the respective parties. The representatives shall be responsible for administration of this Agreement and for coordinating and monitoring performance under or greater than this Agreement. In the event such representatives are changed,the party making the change shall notify the other party. 4.1 The County's representative shall be the Budget and Finance Director. 4.2 City or Town's representative shall be the Library Director. 7. Indemnification: Each City or Town agrees to be responsible and assume liability for its own wrongful and/or negligent acts or omissions or those of their officials,officers, agents,or employees to the fullest extent required by law,and further agrees to save, indemnify, defend,and hold the County harmless from any liability. It is further provided that no liability shall attach to the County by reason of entering into this contract. 8. Changes,Modifications,Amendments and Waivers: The Agreement may be changed, modified,amended or waived only by written agreement executed by the parties hereto. Waiver or breach of any term or condition of this Agreement shall not be considered a waiver of any prior or subsequent breach. 9. Severability: In the event any term or condition of this Agreement or application thereof to any person or circumstances is held invalid, such invalidity shall not effect other terms, conditions or applications of this Agreement,which can be given effect without the invalid term,condition,or application. To this end the terms and conditions of this Agreement are declared severable. 10. Entire Agreement: This agreement contains all the terms and conditions agreed upon by the parties. All items incorporated herein by reference are attached. No other understandings, oral or otherwise,regarding the subject matter of this Agreement shall be deemed to exist or to bind any of the parties hereto. 11. The term of this agreement is January 1,2002 to December 31,2002. THIS APPROPRIATION WAS INCREASED TO 75,000 IN 1989,$100,000 IN 1990 AND 1991.IN 1992,DURING THE TIME WHEN THE SKAGIT COUCIL OF GOVERNMMENTS WAS IN LIMBO,THE COMMISSIONERS DIRECTED THE NORMAL SCOG DUES TO LIBRARY SERVICES. THE SUM OF$120,000,INCLUDING$20,000 OF RE-ALLOCATED SCOG DUES,WERE DISTRIBUTED TO THE LIBRARIES IN 1992.
