This proposal is located at 1050 Dakota Avenue, Northeast Quarter of Section 23,
Township 35 North, Range 1 East W.M. I
within Guemes Channel and/or its associated wetlands.
The project will be within shorelines of statewide significance (RCW 90.58.030).
The project will be located within a Urban H (shoreline area) designation.
The following master program provisions are applicable to this development (state the master
program section or page number.) If a conditional use or variance, also identify the portion of
the master program which provides that the proposed use may be a conditional use, or that
portion of the master program being varied. (See Shoreline Administrator's "Findings of
Fact")

Development pursuant to this permit shall be undertaken pursuant to the following terms and
conditions:
1 . The scope of this project not exceed that as set-out in the shoreline application
(including attachments) and the accompanying SEPA checklist (including attachments).
2. A Building Permit shall be secured from the City of Anacortes prior to any construction
activity authorized by this permit being begun.
3. Prior to construction beginning any necessary approvals shall be secured from the State
Department of Fisheries and the US Army Corps of Engineers.
4. National Pollution Discharge Elimination System (NPDES) wastewater discharge permit
requirements will be adhered to.
5. Prior to construction beginning on this project a geotechnical investigation shall be
prepared and a temporary erosion and sedimentation control plan and a drainage and
bank stabilization plan approved by the City Director of Engineering and Development
Services.
6. The regulated slopes provisions of the City Zoning Ordinance shall be adhered to.
7. The stormwater management provisions of the City Zoning Ordinance shall be adhered
to.
8. The existing power pole and mail boxes located at the northeast corner of the
intersection of Dakota and Oakes shall be relocated to the east and the radius be
widened to accommodate right turns for incoming trucks and trailer units, all as required
by the Director of Engineering and Development Services.
9. On-site lighting shall be designed so as to have the minimum feasible impact on adjacent
residences.

10. Any violation of this permit and its conditions shall constitute a violation of the State
Shoreline Management Act and its regulations and be subject to its penalties.

This permit is granted pursuant to the Shoreline Management Act of 1971 and nothing in this
permit shall excuse the applicant from compliance with any other federal, state, or local
statutes, ordinances, or regulations applicable to this project, but not inconsistent with the
Shoreline Management Act (Chapter 90.58 RCW).
This permit may be rescinded pursuant to RCW 90.58.140(8) in the event the permittee fails
to comply with the terms or conditions hereof.
Construction pursuant to this permit will not begin or is not authorized until thirty days from
the date of filing as defined in RCW 90.58.140(6) and WAC 173-14-090, or until all review
proceedings initiated within thirty days from the date of such filing have terminated: Except as
provided in RCW 90.58./140(5)(a)(b)(c).

Findings of Fact and Conclusions of Law and Decision Thereon
FINDINGS OF FACT
I. General Background
1 .1 The City of Anacortes Planning Director has been designated the Shorelines
"Administrator" and "Environmental Officer" for the City of Anacortes Shoreline
Management Master Plan, Section 5 - Definitions, Appendix C.
1 .2 Under Section 1 1 : Permit Procedure, d) "Not more than 5 working days after the 30 day
review period, or following a hearing, if necessary, the Environmental Officer shall
recommend approval or denial of the permit to the Planning Commission who shall
approve or deny the permit at their next meeting. If the Planning Commission does not
act on the permit the decision of the Environmental Officer shall stand."
1 .3 Application was made on November 1 , 1993 for a Shoreline Substantial Development
Permit to reconstruct the dock, piers, and processing buildings, that were destroyed by
fire, in a new configuration. The property is located at Dakota and the Guemes Channel
waterfront. The application and attachments are shown as Exhibit 1.

1 .4 The proposed project is located on Guemes Channel.

2. State Environmental Policy Act
2.1 A Determination of Nonsignificance (hereinafter "DNS") was issued for this project on
November 15, 1993 by the City of Anacortes, the SEPA lead agency. Exhibit 2
2.2 This lead agency determined that the Shannon Point proposal does not have a probable
significant adverse impact on the environment. Accordingly, an environmental impact
statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made
after review of a completed environmental checklist and other information on file with
the lead agency. This information is available to the public on request.
2.3 The DNS was made available for public comment on November 15, 1993 and mailed
that same day to the following agencies and individuals with a deadline for comment of
December 3, 1993: State Department of Ecology, State Department of Fisheries, and
the State Department of Natural Resources.
2.4 The DNS was published in the Anacortes American on November 24, 1993, again with a
deadline for public comment of December 3, 1993.
2.5 The DNS was posted on the project site on November 19, 1993.

2.6 The following comment was received in response to this DNS:
Exhibit 3 - A December 1 , 1993 letter from the State Department of Ecology
3.0 Notice
3.1 Section 11 : "Permit Procedure", page 6, item b) of the Shoreline Master Plan with
regard to Public Notice states, in part:
"Upon receipt of the application, the Environmental Officer shall instruct the applicant to
publish notices of the application once a week for two consecutive weeks in a
newspaper of general circulation in the City of Anacortes. In addition, the
Environmental Officer shall post at least four copies of the notice prominently on the
subject property or in conspicuous public places within 300 feet thereof. Within thirty
days of the final publication of notice, any interested person may submit his views upon
the application, in writing, to the Environmental Officer."
3.2 Notice of Application was published in the Anacortes American on November 3, 1993
and November 10, 1993 (Exhibit 4) and four copies of the Notice were posted on the
site and copies were also posted at the Municipal Building, Library and Post Office on
November 4, 1993 (Exhibit 5).
3.3 The following comments were received in response to the Notice of Application:
Exhibit 6 - A November 18, 1993 letter from Mr. Richard Grill - one part of the traffic
issue is addressed in Exhibit 9 and Condition 8. Bank stability is addressed in
Conditions 5 and 6.
Exhibit 7 - A November 29, 1993 letter from Mr. Richard Grill - the building
configuration will be discussed before the Planning Commission.
Exhibit 8 - A November 29, 1993 letter from Mr. Richard Ricks - this traffic issue is
addressed in Exhibit 9 and Condition 8.
Exhibit 9 - A December 3, 1993 Memorandum from Mr. Jim Pemberton
3.4 The 30 day review period for this project ended on December 10, 1993.° The
Environmental Officer forwarded Findings of Fact and Conclusions of Law to the
Planning Commission. The Planning Commission reviewed this permit on December 15,
1993 and voted to approve the project subject to conditions as outlined below.
4.0 Shoreline Master Plan
4.1 The subject property is in a shoreline area designated Urban 11 by the Shoreline Master
Plan for the City of Anacortes. This designation is primarily for those areas which
contain a mixture of commercial, light manufacturing, and high density residential uses.
It is the intent of this designation to maintain existing character of the area without
substantially increasing bulk or scale of development, and to encourage location of
water dependent or water related uses attractive to the public. Uses include, but are
not limited to: Ferry terminals, urban parks and commercial recreation facilities,
restaurants, resorts, convention centers and hotels, marinas, shops and markets.
4.2 The applicable goals and policies of the Shoreline Master Plan have been met by this
application.

I
4.2.1 GOALS AND OBJECTIVES
I SHORELINE USE ELEMENT
GOAL: Shorelines are to be managed and activities coordinated in order to preserve 1
long term multiple benefits of the various shoreline resources.
11 ECONOMIC DEVELOPMENT ELEMENT
GOAL: Provide opportunity for development of water dependent, commercial and
industrial uses at appropriate locations.
Objective: Assure that adequate deep water sites will be available for
uses requiring such sites.
GOAL: Establish multiple-use commercial and industrial sites for compatible activities.
4.2.2. SECTION 20: Use-Activity Policies and Regulations
4) COMMERCIAL DEVELOPMENT: Developments having a primary use for retail or
wholesale trade or other business activities.
Policies
a) Commercial developments on shorelines of the City should be shore
dependent or provide an opportunity for a substantial number for patrons or the
general public to enjoy the shoreline.
b) Commercial development should be encouraged to locate near existing
commercial sites or abandoned industrial or manufacturing sites.
Regulations
a) Except for marinas and related facilities and port facilities, business or
commercial uses constructed over water are to be shoreline dependent and
provide for regulated public access; this is not to be interpreted to restrict
development of commercial uses upon existing docks and wharves.
b) Warehousing is permitted on shorelines only as an accessory use directly
serving a water-dependent use.
11) PORTS AND WATER RELATED INDUSTRY: Public or private facilities for transfer of
cargo or passengers from water-borne craft to land and vice-versa; and facilities
for processing manufacturing and storage of goods.
Policies
a. Water-dependent industrial or port uses should be given priority for frontage
on navigable waters over other industrial uses.
Regulations
b. Plans for industrial developments shall provide for screening and buffer areas.
5.0 Zoning Ordinance
5.1 The City Zoning Map establishes zone boundaries and the City Zoning Ordinance
establishes (1) the permitted use of land in the various zones and (2) development
standards.
5.2 The subject property is in a Light Manufacturing Use District (LM), Chapter 17.18 of the
Anacortes Municipal Code, Title 17, Zoning.

5.2.1 Section 17.18.010 - "Purpose" states: The Light Manufacturing District (LM) is
intended to accommodate those businesses which are not compatible with uses found in the
Central Business District, and industrial and other uses which do not create noise, smoke,
odors, or other objectionable nuisances or hazards detrimental to uses in the LM District or
surrounding districts.

5.2.2 Section 17.18.020 - "Permitted Uses" states: "Any light manufacturing use or
uses of involving processing or storage of goods provided the processes or equipment
employed, or goods stored, processed, or sold shall be limited to those uses which are not
objectionable by reason of hazards, odor, dust, smoke, cinders, fumes, noise, vibration, refuse
matter, or water carried waste; marinas and related uses such as boat repair, boat sales,
restaurants, and accessory sales; shipping and terminal facilities. Other commercial uses of
similar or less impact upon the District than the above, such uses as nurseries, veterinary
clinics, car wash, offices are permitted.
5.2.3 These general purposes and uses as set forth in Section 17.18.010 and
17.18.020 have been met by this proposal.
6.0 Findings of Fact
6.1 The requirements of the State Environmental Policy Act have been complied with.
6.2 The Public Notice requirements of the Shoreline Management Act have been complied
with.
6.3 The project is consistent with the shoreline designation and general goals and objectives
of the Anacortes Shoreline Master Plan.
6.4 Project impacts to public services will be mitigated through standard City charges for:
water and sewer hookups and transportation impacts.
7.0 Conclusions
A Shoreline Substantial Development Permit # 214 should be issued to Shannon Point
Seafoods for the reconstruction of a fish processing facility subject to the conditions that:
I. The scope of this project not exceed that as set-out in the shoreline application
(including attachments) and the accompanying SEPA checklist (including attachments).
2. A Building Permit shall be secured from the City of Anacortes prior to any construction
activity authorized by this permit being begun.
