City Council Minutes—May 3, 2010
At 7:32 p.m. Mayor Maxwell called the regularly scheduled Anacortes City Council meeting of May 3,
2010 to order. Roll call found present: Kevin McKeown, Nick Petrish, Erica Pickett, Brad Adams, Bill
Turner, Cynthia Richardson and Brian Geer. Roll call was followed by the Pledge of Allegiance.
Minutes of Previous Meeting
Mr. Adams moved, seconded by Mr. Geer, that the minutes of April 19, 2010 be approved as if read.
Vote: Ayes— Petrish, Pickett, Adams, Turner, Richardson, Geer and McKeown. Motion carried.
Citizen Hearings
Hershel Janz, 1120 King Street, addressed Council in reference to his March letter about English ivy and
butterfly bush being outlawed in the State of Oregon. Mr. Janz reported that volunteers have been
working on eradicating English ivy and other non-native invasive plants in the community forestlands for
years and are achieving results but need some help from the City. He suggested that the City designate
and advertise a day in the autumn on which residents could call in and request the services of a team of
volunteers that would remove invasive plants from private yards. Mr. Janz urged more effort to protect the
forestlands from invasive species such as holly, Scotch broom, Daphne and laurel by discouraging their
use in residential areas. He also suggested that the Washington State Dept. of Agriculture could take a
lead in banning the sale of such plants as has been done in Oregon. Mr. Janz noted with dismay that
retail nurseries in Skagit County are selling Scotch broom as a landscape plant. He reported that roughly
fifty volunteers a year have been working singly and at work parties for ten years now and have made
significant strides at removing invasive plants from the ACFL but he warned that their continued presence
in the surrounding community makes the battle an ongoing one. Mr. Janz asked for a City ordinance
prohibiting the sale or planting of invasive plants. He also suggested fines for dumping yard waste into the
forestlands or forestland buffers. Mr. Janz acknowledged that eradicating invasive species is a long
process but said the steps he suggested will help to slowly stem the tide.
Mayor Maxwell thanked Mr. Janz for his comments and his efforts and suggested he work with Parks and
Forestlands Manager Jonn Lunsford to set a work party date in the fall. Mr. McKeown asked if the City
has or could have an ordinance prohibiting planting of invasive species. Mayor Maxwell pointed out that
the City can't control what is sold outside the city so education will likely be the most effective strategy.
Mrs. Pickett elaborated on the reclassification strategy the Oregon Noxious Weed Board used to ban the
sale of invasive plants in their state. Mr. Janz added that a map is being prepared to indicate areas in the
ACFL that are still infested so future volunteers can target their efforts effectively. Mrs. Richardson noted
that educating school children about native plants and invasive species has been another step in the right
direction as they will be our future homeowners. Mayor Maxwell said that the City could work with the
Noxious Weed Board to sign on as a supporter were the Board to propose a statewide ban on certain
noxious plants. Mr. Adams said the City Council Parks and Recreation Committee will put this topic on its
agenda and bring back some suggested action items to Council.
Mayor/Council Communication
Mayor Maxwell reported that the next Port/City liaison meeting will be held May 4, 2010 at 8:30 a.m. at
the Port of Anacortes offices.
Mayor Maxwell announced a Special Meeting of the City Council on Friday, May 7, 2010 at 9:00 a.m. to
visit the marine trades businesses in town. No business will be conducted and no public testimony taken
at the Special Meeting.
Consent Agenda
Mr. Turner confirmed with the Mayor that the Street Fair application for the Anacortes Arts Festival
requests the same street closures as in recent years. Mr. Turner then moved, seconded by Mr. McKeown,
to approve the following Consent Agenda items. Vote: Ayes— Pickett, Adams, Turner, Richardson, Geer,
McKeown and Petrish. Motion carried.

Approval of Vouchers/Cancellation of Warrants
Council voted unanimously that the following vouchers/warrants audited and certified by the City's
Auditing Officer (Finance Director) and subsequently reviewed and approved by the Council Finance
Committee on April 22, 2010 and April 29, 2010 are approved for payment as of this date May 3, 2010.
Claims Warrants
April 2010: Warrant Numbers 55411 through 55574 in the total amount of$262,937.66
Cancellation of Warrants
Claims Warrant Number 34731 in the total amount of$157.12
In the same motion Council:
Approved the Street Fair Application for the Anacortes Farmers Market from 6:00 a.m. to 4:00
p.m. every Saturday from May 15 through October 16, 2010 except July 17th and August 7th;
Approved the Street Fair Application for the Splash-N-Dash kid's triathlon from 9:00 a.m. to 12:00
p.m. Saturday, May 22, 2010;
Approved the Street Fair Application for the 4th of July Parade from 8:00 a.m. to 3:00 p.m.
Sunday, July 4, 2010; and
Approved the Street Fair Application for the Anacortes Arts Festival from 10:00 a.m. to 8:00 p.m.
on August 6 and 7, 2010 and from 10:00 a.m. to 5:00 p.m. August 8, 2010.
Time Extension Request: Rock Ridge South Preliminary Plat
Mrs. Richardson stepped down from consideration of this item due to her business relationship with Rock
Ridge.
Planning Director Ryan Larsen explained that Anthony Malo, Jr. has requested a one time three-year
extension of the Rock Ridge preliminary plat. Noting that Section 16.12.030(B) of the Anacortes Municipal
Code required Council approval of such requests if made timely, Mr. Larsen recommended approval. Mr.
Turner moved to grant the extension, seconded by Mrs. Pickett. Vote: Ayes—Adams, Turner, Geer,
McKeown, Petrish and Pickett. Motion carried.
There being no further business, at approximately 7:48 p.m. Mayor Maxwell adjourned the regularly
scheduled meeting of May 3, 2010.

City Council Minutes—May 7, 2010
At approximately 9:00 a.m. acting Mayor Pro-Tem Erica Pickett called the special Anacortes City Council
meeting of May 7, 2010 to order. Present were Nick Petrish, Erica Pickett, Cynthia Richardson and Brian
Geer. Mayor Dean Maxwell joined the meeting in progress. The Council met at North Harbor Diesel, 720
30th Street, Anacortes, and toured North Harbor Diesel, Emerald Marine, Anacortes Marine Electronics,
Banana Belt Boats, Cap Sante Marine and New World Yachts. No action was taken. The meeting was
adjourned at approximately 11:40 a.m.
