City Council Minutes—March 12, 2012
At 7:00 p.m. Mayor Dean Maxwell called the continued Anacortes City Council meeting of March 5, 2012
to order. Roll call found present: Eric Johnson, Ryan Walters, Erica Pickett, Brad Adams, Cynthia
Richardson and Brian Geer. Bill Turner was absent.
Public Hearing: Ordinance Enacting a Moratorium Extension on Interim Ordinance 2861 (Medical
Marijuana Dispensaries, Collective Garden and Similar Uses/Facilities Moratorium)
Assistant Planning Director Don Measamer recalled that on September 6, 2011 City Council adopted
interim Ordinance 2861 establishing a 6-month moratorium on the establishment of Medical Marijuana
Dispensaries, Collective Gardens and similar facilities in any location in the City of Anacortes. This was to
give staff time to research and draft appropriate regulations for Council review. Mr. Measamer reported
that staff had reviewed state, federal and local regulatory issues and the issue is very complex. He
advised that there are so many alternatives that staff would like to bring all options to the City Council
Planning Committee for review and recommendation to the full City Council. However, because
Ordinance 2861 sunsets in March 2012 Mr. Measamer requested that the moratorium be extended
another six months to allow time to address outstanding issues.
At approximately 7:02 p.m. Mayor Maxwell opened the public hearing.
Arlene French, 1411 8th Street, said extending the moratorium was a good idea.
No one else wishing to speak, at approximately 7:03 p.m. Mayor Maxwell closed the public hearing.
Mrs. Richardson moved, seconded by Mr. Geer, to adopt Ordinance 2873 extending a moratorium on the
establishment of medical marijuana dispensaries; medical marijuana collective gardens; establishing an
effective date, and providing that the moratorium, unless extended, will sunset within six (6) months of the
date of adoption. Mr. Adams inquired how other jurisdictions are regulating such facilities. Mr. Measamer
gave examples of the range of responses from jurisdictions in the state. Vote: Ayes—Walters, Pickett,
Adams, Richardson, Geer and Johnson. Motion carried. City Attorney Brad Furlong advised that the
public hearing would be reopened at the March 26, 2012 City Council meeting for any supplemental
comments, discussion and potential action.
Contract Award: 2012 Waterline Replacements
Special Projects Engineer Gordon Bruchner provided councilmembers with aerial photographs illustrating
this agenda item. He advised that on March 7, 2012 the city opened bids on the 2012 waterline
replacement project which includes work at 18th Street, 28th Street, E Avenue and West 2nd Street. Mr.
Bruchner referred to the bid tabulation in the packet and recommended awarding to low bidder Welch
Brothers Construction of Anacortes in the amount of$214,275.84. He said the Engineer's Estimate was
$250,851.15. Mr. Adams complimented the thorough review of bids and bidders performed by staff prior
to recommending contract award. Mr. Geer moved, seconded by Mr. Adams, to award the contract to
Welch Brothers Construction in the amount of$214,275.84 including sales tax. Vote: Ayes— Pickett,
Adams, Richardson, Geer, Johnson and Walters. Motion carried.
Contract Award: Depot Site Plaza, Phase II
Assistant City Engineer Eric Shjarback described the project to extend the pervious pavers at the Depot
Plaza and install utilities and accessibility enhancements. Mr. Shjarback reported that the city opened
bids on March 7, 2012 and that the eight bids received ranged widely. He said the low bid of$187,676.96
was from Strandberg Construction and the Engineer's Estimate was$337,204.49. Mr. Shjarback
recommended awarding the contract to Strandberg Construction. Mrs. Pickett moved, seconded by Mr.
Adams, to award the contract to Strandberg Construction in the amount of$187,676.96 including sales
tax. Mr. Geer inquired about the project timeline. Mr. Shjarback said Phase II construction will be
complete by May 4, 2012. Mrs. Richardson asked the extent of the paver installation. Mr. Shjarback
responded and added that the city hopes to use the funds remaining on the $380,000 in funding from the

Department of Commerce to construct other amenities at the site once Phase II is complete. Vote: Ayes—
Adams, Richardson, Geer, Johnson, Walters and Pickett. Motion carried. Mayor Maxwell thanked Senator
Kevin Ranker for targeting the appropriation to make the project possible.
At approximately 7:17 p.m. Mayor Maxwell continued the meeting to 7:00 p.m. on Monday, March 26,
2012 for the purpose of holding a public hearing on an ordinance enacting a moratorium extension on
Interim Ordinance 2861 (Medical Marijuana Dispensaries, Collective Garden and Similar Uses/Facilities
Moratorium).
