City Council Study Session Minutes— December 9, 2013
At approximately 7:00 p.m. Mayor Dean Maxwell called the regularly scheduled Anacortes City Council
study session of December 9, 2013 to order. City Councilmembers Eric Johnson, Ryan Walters, Erica
Pickett, Brad Adams, Cynthia Richardson and Brian Geer were present. Bill Turner was absent.
Port of Anacortes Pier Two Work Hours Discussion
Port of Anacortes Executive Director Bob Hyde recapped the discussions leading to the 1997 Petroleum
Coke Transportation Environmental Agreement between Texaco (now Shell) and the City which prohibits
coke trucking between 10 p.m. and 7 a.m. to address concerns about noise and dust among other things.
Mr. Hyde asked Council to open a dialog with Shell and the Longshoremen about that agreement and
possibly revise the hour restrictions. He summarized current hauling activity and described how
equipment and street improvements since 1997 have addressed the noise and dust concerns. Mr. Hyde
presented and discussed with Council recent readings from a noise meter installed near 3rd Street and U
Avenue. Several councilmembers suggested a trial run of night hours before changing the agreement.
Municipal Court Diversion Program Update
City Prosecutor Craig Cammock described the intended use of the diversion program, to give offenders
with largely clean records who commit non-serious crimes an opportunity to avoid a criminal record by
complying with prescribed conditions for treatment programs or other appropriate interventions for a 6-12
month period and paying a fee, after which the charge is dismissed. Mr. Cammock explained that
offenders must have legal counsel to participate in the program. He reported that in the first year 47
offenders entered the program, 34 completed it successfully, 11 were still in process, and two failed. Mr.
Cammock said the program has worked very well and has been well received by the defense bar. He
described some minor revisions underway to address concerns of the court.
Ambulance Billing Policy and Draft Contract(Systems Design West LLC)
Finance Director Steve Hoglund presented a proposed contract for ambulance billing services. Mr.
Hoglund reminded Council that the County's EMS system consultant, ESCI, recommended consolidating
billing services among the three service providers. He said the City agreed with that recommendation and
was moving forward to engage the same billing service as Central Valley Ambulance (CVAA), Systems
Design West LLC out of Poulsbo, targeting a January 1 changeover. Mr. Hoglund noted that the Council
packet included the proposed contract which was currently being reviewed by legal counsel at Stoel
Rives, a Business Associates Agreement to guarantee security of patient personal health information,
and proposed billing and collection policy and procedures. Mr. Hoglund addressed questions from
councilmembers about the procedures. He advised that he would bring the contract and attachments
back to Council for approval on the Consent Agenda at the December 16, 2013 meeting.
Willette Business Park: Introduction of Walt Meagher
Planning Director Ryan Larsen introduced Walt Meagher of Fidalgo Commercial-Investment Real Estate
Services based in Anacortes. Mr. Larsen said staff had sent out a Request for Qualifications for
consultants to assist in marketing the Willette Business Park and received two proposals in response.
Those were evaluated by Mr. Larsen and Councilmember Turner who recommended that the City select
Mr. Meagher. Mr. Larsen said he would come back to Council at a subsequent meeting seeking approval
of a contract with Mr. Meagher. Mr. Meagher introduced himself and summarized his 35 years of
experience in commercial real estate including work for local public agencies. He briefly outlined his
strategy for marketing the Willette Business Park and said that would be refined during subsequent
discussions with staff. Councilmembers and the mayor briefly discussed the flexibility to sell or lease the
property and its potential to provide long term general fund revenue.
There being no further business, at approximately 7:45 p.m. the regularly scheduled Anacortes City
Council study session of December 9, 2013 adjourned.
