At 7:00 p.m. Mayor Laurie Gere called the regularly scheduled Anacortes City Council meeting of
February 2, 2015 to order. Councilmembers Eric Johnson, Ryan Walters, Erica Pickett, Brad Adams, Liz
Lovelett, John Archibald and Matt Miller were present. The assembly joined in the Pledge of Allegiance.
Citizen Hearings
No one present wished to address the Council.
Mayor/Council Communication and Committee Reports
Mayor Gere observed the passing of Forest Advisory Board member Ric Boge on Saturday, January 31.
The mayor recalled Mr. Boge's public service in many capacities throughout Skagit County and invited
the community to keep his family in their thoughts.
Mayor Gere amended the agenda to remove the public comment opportunity indicated for Item 7a, Final
Plat Approval: Fidalgo Villas, because that item was a closed record hearing.
Mr. Johnson reported from the Community Leadership Forum held on January 29, 2015 at Whidbey
Naval Air Station. Mr. Johnson shared growth projections for the base and surrounding areas and
described squadron changes that may affect aircraft noise in the vicinity. He said that Captain Mike
Nortier had offered to provide Council with an overview of the flight operations as NAS Whidbey at an
upcoming Council study session and would contact the Mayor's office to schedule.
Ms. Lovelett reported from the Public Works Committee which had discussed upcoming changes to waste
management in the city including recycling and organics collection. Ms. Lovelett lauded the 61% recycling
rate in Anacortes.
Mr. Adams announced that on February 4, 2015 from 6:00 to 7:00 p.m. the Northwest Career and
Technical Academy, Anacortes Campus, would host a Career Manufacturing Industry Night to provide
information for high school students, their parents and community members about career opportunities in
Skagit County.
Mr. Walters reported from the Planning Committee which met earlier in the evening. He advised that staff
would be arranging a presentation on capital facilities planning from the State Dept. of Commerce later in
the month. Mr. Walters also reported on the Street Tree Phase II Project, possible south Commercial
Avenue improvements and opportunities for attracting and locating anchor tenants and businesses in the
downtown area.
Mr. Johnson reported constituent concerns about parking in Skyline and advised that Planning
Department staff would be meeting with residents at the Skyline Beach Club on February 3, 2015 at 6:00
p.m. to answer questions.
Proclamation of Anacortes as Home of the Original Seahawks: Bret Lunsford, Anacortes Museum
Education Coordinator, shared a recent KING-5 news video regarding the naming of the Anacortes
Seahawks. Mayor Gere then read a statement proclaiming Anacortes the home of the original Seahawks
90 years ago and encouraged the community to take pride in this distinction.
Skagit Valley Tulip Festival Presentation: Darene Follett, Skagit Valley Tulip Festival Treasurer,
introduced the Festival's Executive Director, Cindy Verge. Ms. Verge thanked the City for its continued
support of the festival. She presented Mayor Gere with a framed 2015 Tulip Festival poster by local artist
Teresa Saia. Ms. Verge shared festival brochures and said they looked forward to welcoming 300,000-
400,000 festival goers to the Skagit Valley in April.

Consent Agenda
Mr. Johnson moved, seconded by Ms. Lovelett, to approve the following Consent Agenda items. Vote:
Ayes—Walters, Pickett, Adams, Lovelett, Archibald, Miller and Johnson. Motion carried.
Approval of Vouchers/Cancellation of Checks
Council voted unanimously that the following vouchers/checks audited and certified by the City's Auditing
Officer(Finance Director) and subsequently reviewed and approved by the Council Finance Committee
on January 21, 2015 and January 28, 2015 are approved for payment as of February 2, 2015.
Claims
Check Numbers 75111 through 75216 in the total amount of$529,806.06
EFT Number 75109 through 75110 in the total amount of$3,158.00
In the same motion Council approved the minutes of January 20, 2015 and January 26, 2015 as if read.
NEW BUSINESS
Final Plat Approval: Fidalgo Villas
Planning Director Don Measamer presented a request from West Coast Land Investments Inc. and
LaVenture Group LLC for final plat approval for the 19-lot Fidalgo Villas subdivision in Skyline. Mr.
Measamer displayed a plan view and pointed out the public access elements of the plat. He noted that
City Council had approved the preliminary plat in May 2008 and reported that permit approvals along the
shoreline had taken considerable time. Mr. Measamer said that all improvements had been completed
and inspected by the Public Works Department and as built drawings had been received. He said the
Planning Commission had recommended approval of the final plat at its January 14, 2015 meeting. Mr.
Measamer added that the developer had requested consideration of parking restrictions on Cabana and
Flounder Bay Lanes and said staff would address that request in the near future.
Mr. Walters confirmed with Mr. Measamer that the developer had complied with the timeline requirements
of Condition 3 of the conditional use permit. Ms. Pickett inquired if the public access was dependent on
the Homeowners' Association existing in perpetuity. Mr. Measamer said the public access element is an
easement in perpetuity and that its maintenance was written into the covenants and restrictions of the
HOA. Mr. Johnson inquired if the soft shore bank stabilization project (Beach Protection Project) had
been completed and related reports submitted. Mr. Measamer replied in the affirmative. He added that
the landscaping installed two years ago had been replanted based on monitoring results.
Mr. Measamer invited the developer's attorney to address councilmember questions.
Randall Olsen, attorney for the developer, described protections for the shoreline armoring outlined in the
CC&Rs and the separate obligation for the homeowners to maintain common areas including the
armoring. He mentioned the insurance requirements for the common areas. Mr. Johnson asked who pays
the assessments until the lots are sold to homeowner. Mr. Olsen said the declarant was going to pay for
that project as long as the declarant owned any property in the plat, until all the lots are sold, even though
that was not stated in the CC&R's, at which point homeowner assessments would pay for maintaining the
project. City Attorney Brad Furlong said he would like to see that obligation somewhere in writing and
suggested that he and Mr. Measamer could work with Mr. Olsen to include that in the final approval if
Council approved the final plat at the present meeting. Mr. Olsen agreed.
Mr. Walters moved, seconded by Mr. Adams, to approve the final plat subject to development by the City
Attorney and the Planning Director of additional language to ensure the developer continues to fund
maintenance of common areas including the shoreline armoring project until all the lots are sold. Vote:
Ayes— Pickett, Adams, Lovelett, Archibald, Miller, Johnson and Walters. Motion carried.
Mr. Walters clarified that the motion did not introduce any new plat conditions, only called for
documenting an existing condition.

Solid Waste Drop Box Collection
Public Works Director Fred Buckenmeyer presented a proposal for City forces to take on the drop box
service in the city limits. He began with an overview of the solid waste services provided in the city limits
and who provides each service, noting that the recycling and organics collection contracts would be
before Council in the near future. Mr. Buckenmeyer explained the nature of drop box service. He said that
service had been provided by Waste Management for many years but that the City gained control of the
service in 2010 through its contract with Waste Management.
Mr. Buckenmeyer recommended providing drop box service with City forces and said that was allowed for
in the proposed 2015 contract currently being negotiated with Waste Management. He advised that the
relatively simple service would require one new truck. Mr. Buckenmeyer said the decision was time
sensitive because the current Waste Management contract expires in September and is currently being
renegotiated. He reported that both Mount Vernon and Sedro-Woolley provide drop box service inside
their city limits. Mr. Buckenmeyer cited improved customer service, diversifying the services of the solid
waste utility, offering a single billing entity to Anacortes solid waste customers, and creating a self-
sustaining service as reasons to implement the change. He reported that there are currently fifteen
permanent customers and other temporary customers for drop box service.
Mr. Buckenmeyer summarized the costs of implementing the new service and the anticipated revenue
and said he projected a fifteen year return on investment. Mr. Buckenmeyer noted that the drop box
service would require .75 FTE of a new employee, the other .25 of which was needed by the stormwater
utility. Ms. Pickett questioned whether the new truck and drop boxes would still be usable after fifteen
years. Mr. Buckenmeyer said he anticipated they would last even longer than that. Mr. Miller questioned
whether government could provide the drop box service better than a private company and asked if the
drop box truck driver would be the only employee who could operate that truck. Mr. Buckenmeyer said
the entire solid waste crew would rotate through that truck and route. Ms. Lovelett asked if the solid waste
utility had fund balance to pay the start-up costs. Mr. Buckenmeyer said yes. Ms. Lovelett asked if any
other solid waste projects would be a higher priority use of the fund balance. Mr. Buckenmeyer said no.
Mr. Walters asked how much fund balance was in the solid waste utility. Mr. Buckenmeyer said it was far
in excess of the drop box start-up costs and said he would provide that information following the meeting.
Mr. Walters questioned what benefit the proposal would bring to the City. Mr. Buckenmeyer repeated the
list of benefits and claimed that the fifteen year ROI was conservative, it could be less. Mr. Miller
summarized Mr. Buckenmeyer's argument that the upside would be generating revenue for the solid
waste utility 10-15 years out and also filling the other portion of a new stormwater position. Ms. Pickett
observed that providing quick response to business customers is of value. Mr. Buckenmeyer added that
Waste Management was willing to provide a backup truck in the event the Anacortes truck were to break
down so the City would not have to purchase a backup vehicle. Mr. Walters observed that the Public
Works Committee had not provided any input or advice on the staff proposal. Mr. Buckenmeyer
concluded that the proposal would come back to Council for further consideration after it heard from
Waste Management at a future City Council meeting.
At approximately 8:03 p.m. Mayor Gere invited the public to comment on the proposal. No one present
wished to speak.
Resolution 1912: 2015-2016-2017 Collective Bargaining Agreement by and between the City of
Anacortes and the Anacortes Non Commissioned Police Guild
Administrative Services Director Emily Schuh presented for ratification a collective bargaining agreement
with the Non Commissioned Police Guild and its six employees. She referred councilmembers to the
cover sheet in the evening's Council packet outlining the terms of the agreement and the changes from
the prior agreement. Ms. Schuh briefly reviewed those provisions.
Mr. Miller pointed out that the January 28, 2015 cover sheet in the packet listed the Financial Impact as
6% over three years but said the 2.5% annual increase actually added to 7.5%. Ms. Schuh confirmed that
the cover sheet was incorrect but that the contract document in the packet reflected the accurate terms.

At approximately 8:09 p.m. Mayor Gere invited members of the audience to comment on the proposed
resolution. No one present wished to speak.
Mr. Walters said he did not support cost of living adjustments (COLA)which exceed inflation. He said the
other adjustments in the contract were appropriate and he would support it overall but he urged the City
to take a harder stand to tie COLAs to the actual rate of inflation. Ms. Schuh explained the historical
variation in CPI rates and options for structuring contract terms accordingly, particularly for multi-year
contracts. Mr. Miller, a member of the Personnel Committee, expressed his support of the proposed
agreement but also encouraged the use of a CPI-based model in the future.
Mr. Adams moved, seconded by Ms. Lovelett, to approve Resolution 1912 approving a 2015-2016-2017
collective bargaining agreement by and between the City of Anacortes and the Non Commissioned
Anacortes Police Guild. Vote: Ayes—Adams, Lovelett, Archibald, Miller, Johnson, Walters and Pickett.
Motion carried.
Resolution 1911: 2015-2016-2017 Collective Bargaining Agreement by and between the City of
Anacortes and the International Association of Firefighters Local 1537
Ms. Schuh presented for ratification a collective bargaining agreement with the firefighters. She reminded
that IAFF members are eligible for interest arbitration. Ms. Schuh said that councilmembers had been
briefed on the progress of the negotiations during a recent executive session and explained one change
since that most recent briefing, the one-time base wage adjustment in 2016 in acknowledgement of the
reduction in premiums of the new health insurance plans.
Ms. Lovelett moved, seconded by Ms. Pickett, to adopt Resolution 1911 approving a 2015-2016-2017
collective bargaining agreement by and between the City of Anacortes and the International Association
of Firefighters Local 1537.
At approximately 8:16 p.m. Mayor Gere invited members of the audience to comment on the proposed
resolution. No one present wished to speak.
Vote: Ayes—Lovelett, Archibald, Miller, Johnson, Walters, Pickett and Adams. Motion carried.
There being no further business, at approximately 8:17 p.m. the regularly scheduled Anacortes City
Council meeting of February 2, 2015 was adjourned.

Thank you for ratifying the collective bargaining agreements with the Non-Commissioned Police and IAFF 1537 last
night. This morning I became aware that there was an error in the implementation of the 2016 healthcare adjustment. I
agree with the Guild President that the wage scale does not reflect what we agreed to. I have attached a revised
contract with the corrected wage schedules. I will ask Marcia to include this information with the meeting minutes.
