HomeMy WebLinkAboutORD-1962-Zoning Classification Change - ORDINANCE NO. 1962 AN ORDINANCE AMENDING THE ZONING CODE TO CHANGE THE ZONING CLASSIFICATION OF A CERTAIN DESCRIBED AREA WITHIN THE CITY OF ANACORTES FROM RESIDENTIAL HIGH DENSITY TO COMMERCIAL, WITH CERTAIN RESTRICTIONS . WHEREAS, the PlanningCommission of the City of Anacortes has Y conducted a public hearing on the application of Marilyn Anderson for a change in zoning classification of a certain described area within the City of Anacortes, which area is more particularly des- cribed on the attached Exhibit A which is by this reference made a part hereof; and, WHEREAS, the City Council of the City of Anacortes has also conducted a public hearing on said application for zoning change and the Council having listened to all the testimony presented at said public hearing, and considered the exhibits presented, and the recommendations of staff; now, therefore, pursuant to said application the City Council makes the following findings: 1 . A change in circumstances has occurred since the subject property was originally zoned Residential High Density, in that a new bank has been erected on the adjacent property immediately to the east of the subject property, there is an insufficient number of suitable commercial sites for retail sales operations, and the overall development of surrounding Commercial District makes a zone change to Commercial compatible with good planning within the City of Anacortes. 2. The adjacent property to the north and to the east is zoned Commercial and the property to the west and south is zoned Residential High Density. 3 . The Comprehensive Plan for the City of Anacortes contem- plates flexibility in zone boundary and an extension of the Commercial District to include the subject property is consistent with said Com- prehensive Plan. 4 . The location of said property adjacent to a Residential High Density zone necessitates the imposition of certain conditions to minimize potential adverse impact on the surrounding neighborhood. 5. The change in zoning classification of the area described in Exhibit A is in the best interests of the community and is con- sistent with good planning for the City of Anacortes. -1- Y Based on the foregoing findings of fact, the City Council does hereby ordain as follows: Section 1. The zoning classification of that certain area des- cribed on the attached Exhibit A which is by this reference made a part hereof be and it is hereby changed from Residential High Density classification to Commercial classification subject to the following conditions and limitations: a) The only permitted uses in said area shall be retail and wholesale sales, not incuding eating and drinking establish- ments, automobile, farm machinery, boat sales operation; and auto service stations and repair facilities. Section 2 . ' Effective Date. This ordinance shall take effect from and after five (5) days after its passage and posting as required, by law. PASSED AND APPROVED this 22nd day of October, 1984 .
