DESCRIPTION AND LOCATION: PROJECT DESCRIPTION: The applicant has applied for a shoreline exemption to permit the removal and replacement of approximately 500 square feet of rusty siding and trim attached to the existing building owned and operated by Trident Seafoods, Corporation. No structural changes are proposed. ZONING DISTRICT: The subject proposal is located in the Light Manufacturing (LM) Zoning District of the City of Anacortes. SHORELINE ENVIRONMENT/DESIGNATION: The project site lies in the City of Anacortes's 2010 Shoreline Master Program's Urban Maritime shoreline environment/designation. Page 1 of 4 STATE ENVIRONMENTAL POLICY ACT(SEPA): The proposed work(repair, remodeling, and maintenance activities) has been determined to be exempt from SEPA environmental review pursuant to WAC 197.11.800(3) -"Repair, remodeling and maintenance activities. The following activities shall be categorically exempt: The repair, remodeling, maintenance, or minor alteration of existing private or public structures,facilities or equipment, including utilities, recreation, and transportation facilities involving no material expansions or changes in use beyond that previously existing; except that, where undertaken wholly or in part on lands covered by water, only minor repair or replacement of structures may be exempt(examples include repair or replacement of piling, ramps,floats, or mooring buoys, or minor repair, alteration, or maintenance of docks). The following maintenance activities shall not be considered exempt under this subsection:(a)Dredging of over fifty cubic yards of material; (b) Reconstruction or maintenance of groins and similar shoreline protection structures; (c) Replacement of utility cables that must be buried under the surface of the bedlandr or (d) Repair/rebuilding of major dams, dikes, and reservoirs shall also not be considered exempt under this subsection." IL FINDINGS OF FACT AND CONCLUSIONS OF LAW: 1. According to the City of Anacortes's 2010 Shoreline Master Program, water- dependent and water-related uses are permitted uses within the underlying Urban Maritime Shoreline Environment/Designation per SMP Section 5.12,Table 5.1. 2. The proposal will be consistent with the policies and provisions of the Shoreline Management Act and the 2010, City of Anacortes's Shoreline Master Plan (SMP). 3. The project is exempt from the requirement to obtain a Shoreline Substantial Development Permit (SSDP) pursuant to WAC 173.27.040(2)(b) — "Normal maintenance or repair of existing structures or developments, including damage by accident,fire or elements. "Normal maintenance"includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair" means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment." III. DECISION: IN APPROVED ❑ DENIED Page 2 of 4 IV. CONDITIONS OF APPROVAL: 1. Best Management Practices (BMPs) shall be implemented at all times during the proposed repair and maintenance construction activities. 2. The applicant shall adhere to the applicable policies and development regulations contained in the City of Anacortes's 2010, Shoreline Master Program including but not limited to those in: Section 5.11 Urban Maritime Environment; Chapter 6 Environmental Protection General Regulations; and other applicable provisions of the Shoreline Master Program. 3. Hours of construction /work are limited to 7:00 AM to 10:00 PM Sunday through Saturday. 4. Noise levels are not to exceed those standards as established by the state pursuant to Chapter 70.107 RCW and contained in Chapter 173.60 WAC. 5. If any artifacts or human remains are found upon excavation,the Samish Indian Nation;the City of Anacortes' Department of Planning, Community, & Economic Development; the City of Anacortes' Police Department;and the State of Washington's Department of Archaeology and Historic Preservation (DAHP) shall be immediately notified and the work in the immediate area cease. Pursuant to RCW § 27.53.060 it is unlawful to destroy any historic or prehistoric archaeological resources. RCW 27.44 and § 27.53.060 require that a person obtain a permit from the Washington State Department of Archaeology and Historic Preservations before excavating, removing, or altering Native American human remains or archaeological resources in Washington. 6. All applicable local, state and federal permits and authorizations shall be secured prior to work beginning on the site. Copies shall be provided to the city. 7. The applicant/landowner shall comply with federal statutes including but not limited to:The Endangered Species Act, Clean Water Act, Marine Mammal Protection Act, and other federal statutes.
