On April 1,2013 the applicant submitted a shoreline permit exemption application to PLED. 2. As conditioned, the proposal will be consistent with the policies and provisions of the Shoreline Management Act and the 2010 Anacortes Shoreline Master Plan(ASMP). 3. The project is exempt from the requirement to obtain a shoreline substantial development permit pursuant to WAC 173-27-040(2)(b) and ASMP Section 2.4.E2. 4. The lead SEPA agency for the action (City of Anacortes) determined that the project is categorically exempt from SEPA review pursuant to WAC 197-11-800(3). HL DECISION: APPROVED 1 of2 IV. Work below the ordinary high water line shall not occur from March 15 through June 14 of any year for the protection of migrating juvenile salmonids. 3. This approval is for replacement of the existing pier decking and associated support structures and shall not result in expansion of the structure. 5. The existing timber decking, stringers, and pile caps shall be removed using a barge mounted crane and disposed of upland such that they do not re-enter such waters. 6. Sawdust, drillings, and trimmings from treated wood shall be contained with tarps or other impervious materials and prevented from contact with the beach, bed or waters of the state. 7. New timber decking along the length of the 200 foot long by 16 foot wide rectangular shaped pier shall contain 50 percent grated area with steel grating running the length of the pier that has 60 percent open area, approved by WDFW. The grated area shall not be used for storage purposes.
