NOTICE IS HEREBY GIVEN that the Board of Adjustment will hold a Public Hearing the evening of
i Thursday,July 5,2007 at 7:00 p.m. in the Municipal Building Council Chambers, 6th and "Q" Avenue.
The purpose of the Public Hearing is to consider a request for a variance at 101 U Avenue to reduce the
front yard setback to 1 foot 6 inches from 20 feet to construct an attached garage.
Anyone wishing to comment on the proposed variance request may do so at the above stated date,place

Minutes of July 5, 2007 were approved.
Lich Variance 001 U Avenue)
As a continuation of the July 5, 2007 Board Meeting reviewing this request for side-yard setback
variance from eight feet to 1' 6"to construct a garage addition to the present residence, the Board
conducted a site visit attended by Messrs. Snyder, Janke, Smith, Boubeau, Mahler, and City Staff
member Mr. Frank
Mr. Wilson, representing the applicant on site, addressed the issues raised at the July 5 meeting:
details about existing easements in the area, alternative garage configurations and designs to avoid
side-yard encroachment, and planned building elevations. At present the 16-foot paved easement
on the adjacent property that provides access to the applicant's residence also extends steeply to
another adjacent paved easement that provides access to a residence beyond the Lich residence.
The requested setback encroachment would place the proposed garage roof closely to this access
extension creating a potential problem for vehicular travel. In the project, the access extension
beyond the proposed garage will be removed and replaced by garden plantings to eliminate this
potential problem. The proposed two-car garage will have a gabled roof that will tie into the gabled
roof of the residence greatly improving appearance of the building; the proposed height of the
gabled garage roof will be about sixteen feet.
A motion was made (Smith/Janke) and passed with all ayes to grant the variance as requested. The
Board concluded that the proposed garage configuration is the only practical location on the site.
Skagit County Public Works Variance (Guemes Ferry Dock)
Mr. Cox reviewed this request for rear-yard setback variance from 10 feet to three inches to
construct a 10'X50' building to house a shop, storage, and office adjacent to the parking queue at
Guemes Island ferry. He stated that the Board at their Regular Meeting August 4, 2005 approved an
identical variance request but the project was stalled by inactivity.
Mr. Cox explained that the new building would consolidate these functions from several locations on
the dock to a single on-shore location. The project will facilitate passenger pickup, vehicle
turnaround, and delivery truck unloading and allow comfortable two standby car lanes for ferry
loading. The building will be 12 feet high and sided by painted galvanized metal similar to the
terminal building. A 10'X20' roofed caged area will be erected contiguously south of the new
building.
A motion was made (Boubeau/Mehler) and passed with all ayes to grant the variance request with
the stipulation that the fencing behind the proposed building/cage be removed.

Humula Variance (1703 32nd Street)
Mr. Humula reviewed this request for variance in fence height on a retaining wall from four feet to
six feet along his east side-yard property line; the 20-foot front section of the fence will be 4-foot,
non-sight obscuring.
Mr. Humula stated that the retaining wall is about three high, bringing the total height of the wall plus
fence to nine feet. He has constructed a similar fence along the west side-yard property line and a
portion of the front-yard property line; neither location includes a retaining wall. He noted that his
east-side neighbor had actually requested the fencing, and offered to help financially, to provide
some privacy from the elevated Humula site.
There were no City Staff comments/objections. A written memo from the east-side neighbors,
Mrs. Ham and Mr. Gwin, encouraged and supported the project.
A motion was made (Janke/Boubeau) and passed with all ayes to grant the variance request. The
Board determined that the fence benefited both parties with no impact on the surrounding
neighborhood.

NOTICE OF CONTINUED PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Board of Adjustment will hold a Public Hearing the
evening of Thursday, August 2, 2007 at 7:00 p.m. in the Municipal Building Council
Chambers, 6th and "Q" Avenue. The purpose of the continued Public Hearing is to consider a
request for variance at 101 "U" Avenue to reduce the front yard setback to V 6" inches from the
required 20 feet to construct an attached garage.
Anyone wishing to comment on the request may do so at the above stated date, place and time.

MINUTES JULY 5, 2007
REGULAR MEETING
Meeting called to order by Chairman Brad Snyder at 7:00 PM

Minutes of June 21, 2007 were approved.
Jolly Variance (3107 Oakes Avenue)
Mr. Boubeau noted that he had been present during discussions with Mr. Schemmer, who will
represent Mr. Jolly, about a Skyline project. He felt confident he could hear this variance petition
without prejudice; there were no objections to his presence by the applicant or the Board.
Mr. Schemmer, Schemmer Engineering representing the applicant, reviewed this request for a
variance to measure the building height of two residences proposed on this site from a final grade of
65 feet up from the present grade of 58 feet at the lowest spot on the site. Board approval of a
similar variance request at their Regular Meeting February 16, 2006 had lapsed because the
applicant had not filed a building permit application within 90 days. In this variance application Mr.
Jolly has requested an extension of the permit application filing time to one year.
Mr. Schemmer stated that with proposed fill the building sites would be roughly three feet below the
grade of Oakes Avenue. Access to the sites would be via the 16-foot platted alley from Georgia
Avenue and the sites, as determined by City Staff, would have a Georgia Avenue address. The
variance application included reports from ATSI indicating no wetland on the site and from Western
Geotechnical Consultants concluding that it would be feasible to build on the site.
February 16, 2006 meeting discussion addressed the site as a remnant ravine drainage from Little
Cranberry Lake that was filled at the lower end for the Oakes Avenue right-of-way; a 12-inch culvert
extends under Oakes Avenue to drain the ravine. A 4-foot drain located away from this site now
handles the Little Cranberry Lake outfall. A memo from City Engineering at the time detailed specific
conditions for site development including drainage, fill transition to the alley and the elevated
adjacent rear property, and geo-technical scrutiny of slope stability and hydrogeology of the site.
Mr. Schemmer stated that the 12-inch culvert would be modified with a riser to drain the raised
ground level. He contended that the existing topography of the site, nine feet below Oakes Avenue
is essentially impracticable for a building location and that the proposed finished grade would
actually be below that of the other properties in the neighborhood.
Comment from City Planning/Building recommended a thorough soils study of the site.
A motion was made (Snyder/Boubeau) and passed with four ayes (Snyder, Wilson, Boubeau,
Janke), one nay (Mehler) to grant the variance request specifying that the fill levels be those
specifically shown in the cross-section drawing submitted with the variance request application and
an extension of the permit application period to 180 days. The majority deemed site topography a
hardship for the applicant to develop residences; the minority considered approval inconsistent with
the conservation interests of the Community.

Lich Variance (101 U Avenue)
Mr. Wilson, noting acquaintanceship with the applicant, excused himself from the hearing: Mr. Smith
replaced him for this hearing
Mr. Zevely, representing the applicant, reviewed this request for side-yard setback from eight feet to
1' 6" to construct a garage addition to the present residence.
Mr. Zevely explained that the applicant wishes to expand the present single-car garage to a two-car
garage customary for a residence. The present garage was constructed at an angle to the
residence because of the irregularly shaped waterfront property site and, as such, the proposed
garage addition would encroach the side-yard setback. This proposed garage configuration is
considered the only practical location on the site. The side yard in question actually borders on a
16-foot paved easement on the adjacent property that provides access to the applicant's residence;
this easement is for beneficial use of the applicant's residence only.
Mr. Zevely mentioned that the present garage has a flat roof; the proposed two-car garage will have
a gabled roof that will tie into the gabled roof of the residence greatly improving appearance; the
proposed height of the gabled garage roof will be about sixteen feet.
In City Staff comments Engineering noted that the encroachment to the access easement would
create a hardship for vehicular travel, opining that it would be possible to configure the proposed
garage scheme to avoid this encroachment.
In discussion, the Board examined potential alternative reconfigurations of the garage scheme to
avoid encroachment. To this end, the Board found it very difficult to envision the layout of the
property, the easement, and existing access to other properties in the area.
A motion was made (Snyder/Smith) and passed with all ayes to continue the variance hearing to the
next Regular Board meeting August 2 with the request that the applicant provide more detail about
existing easements in the area, alternative garage configurations and designs to avoid easement
encroachment, and definitive building elevations. In addition the Board will conduct a site visit at
3:30PM the day of the August 2 Regular Meeting.
