The project will be within shorelines of statewide significance (RCW 90.58.030). The project will be located within an Urban II (shoreline area) designation. I The following master program provisions are applicable to this development (state the master program section or page number.) If a conditional use or variance, also identify the portion of the master program which provides that the proposed use may be a conditional use, or that portion of the master program being varied. (See Shoreline Administrator's "Findings of Fact") I Shoreline Permit#235 Development pursuant to this permit shall be undertaken pursuant to the following terms and conditions: 1. The scope of this project not exceed that as set-out in the shoreline application (including attachments) and the accompanying SEPA checklist (including attachments). 2. Disposal of construction debris shall be on land in such a manner that it cannot enter the stream channel or water body, or cause water quality degradation of State waters. 3. An Erosion and sediment control plan shall be approved by the Director of Public Works and implemented on the construction site and adjacent areas so as to prevent upland sediments from entering the stream channel or water body. 4. All areas disturbed or newly created by construction activity shall be seeded and riprapped with clean durable riprap. 5. No later than August 1, 1998, and prior to improvement or addition to existing facilities, a waterline extension, fire hydrants and fire protection standpipe systems shall be installed as required by the building and fire codes and the fire chief to serve the entire site. 6. No construction shall begin prior to securing approvals from the Washington State Department of Fish and Wildlife and the U.S. Army Corps of Engineers. 7. No activities can take place in the leased area or on any other State-owned aquatic lands without prior written authorization from Washington State Department of Natural Resources. 8. As part of a building permit application for any work covered by this Shoreline Permit, the applicant shall submit a detailed parking plan showing parking, circulation, and fire lanes adequate to meet code requirements for both the existing uses and the uses for which the building permit is being sought. 9. As part of a building permit application for the proposed floats along the eastern part of the existing 1993 pier, the applicant shall demonstrate that adequate clearance is available between the proposed floats and the property line of the harbor area lease, to permit adequate maneuvering room for vessels. I 10. The height of the proposed buildings shall not exceed that of the highest existing building. 11. This project is subject to applicable water, sewer, and stormwater general facility and hookup fees and transportation, fire, school, and park impact fees. These fees are payable at levels in effect at the time of building permit issuance and may differ from those fee levels currently in effect. 12. Any violation of this permit and its conditions shall constitute a violation of the State Shoreline Management Act and its regulations and be subject to its penalties. This permit is granted pursuant to the Shoreline Management Act of 1971 and nothing in this permit shall excuse the applicant from compliance with any other federal, state, or local statutes, ordinances, or regulations applicable to this project, but not inconsistent with the Shoreline Management Act (Chapter 90.58 RCW). 2 Shoreline Permit#235 This permit may be rescinded pursuant to RCW 90.58.140(8) in the event the permittee fails to comply with the terms or conditions hereof. Construction pursuant to this permit will not begin or is not authorized until thirty days from the date of filing as defined in RCW 90.58.140(6) and WAC 173-14-090, or until all review proceedings initiated within thirty days from the date of such filing have terminated: Except as provided in RCW 90.58.140(5)(a)(b)(c). Findings of Fact and Conclusions of Law and Decision Thereon FINDINGS OF FACT I. General Background 1.1 The City of Anacortes Planning Director has been designated the Shorelines "Administrator" and "Environmental Officer" for the City of Anacortes Shoreline Management Master Plan, Section 5 - Definitions, Appendix C. 1.2 Under Section 11: Permit Procedure, d) "Not more than 5 working days after the 30 day review period, or following a hearing, if necessary, the Environmental Officer shall recommend approval or denial of the permit to the Planning Commission who shall approve or deny the permit at their next meeting. If the Planning Commission does not act on the permit the decision of the Environmental Officer shall stand." 1.3 Application was made on May 7,1997 for a Shoreline Substantial Development and Special Use Permit for site improvements at Lovric's Sea-Craft including: installation of a boat lift, boat houses, floats, and dredge sloughed material in marina. The property is located at 3022 Oakes Avenue. The JARPA application is shown as Exhibit 1. 1.3.1 The Site Plan is shown as Attachment A to Exhibit 1. i 1.3.1 The following Shoreline Permits have been issued/denied for the Lovric Sea- Craft boatyard project: Shoreline Permit# 120, January, 1984 and amended; Shoreline Permit # 181, February, 1990; Shoreline Permit # 190, denied September, 1990; and Shoreline Permit # 194, January 1992 for bank stabilization and road development. 1.4 The proposed project is located on Guemes Channel. 2. State Environmental Policy Act I 2.1 A Mitigated Determination of Nonsignificance (hereinafter "Mitigated DNS") was issued for this project on December 22, 1997 by the City of Anacortes, the SEPA lead agency. Exhibit 2 2.2 This lead agency determined that the Sea-Craft site improvement proposal does not have a probable significant adverse impact on the environment provided that the conditions set out below are satisfied. Accordingly, an environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public on request. These conditions are set-out again on page 8. 1. These fees are payable at levels in effect at the time of building permit issuance and may differ from those fee levels currently in effect. 2.3 The Mitigated DNS was made available for public comment on December 22, 1997 and mailed that same day to the following agencies with a deadline for comment of January 9, 1998: State Department of Ecology, Department of Fish and Wildlife and Department of Natural Resources. 2.4 The Mitigated DNS was published in the Anacortes American on December 31, 1997, again with a deadline for public comment of January 9, 1998. I 2.5 No letters of comment were received in response to this MDNS. I 3.0 Notice 3.1 Section 11: "Permit Procedure", page 6, item b) of the Shoreline Master Plan with regard to Public Notice states, in part: "Upon receipt of the application, the Environmental Officer shall instruct the applicant to publish notices of the application once a week for two consecutive weeks in a newspaper of general circulation in the City of Anacortes. in addition, the Environmental Officer shall post at least four copies of the notice prominently on the subject property or in conspicuous public places within 300 feet thereof. Within thirty days of the final publication of notice, any interested person may submit his views upon the application, in writing, to the Environmental Officer." 2 3.2 Notice of Shoreline Substantial Development/Special Use, Notice of Public Hearing and Notice of Completeness were published in the Anacortes American on December 3, 1997 and December 10, 1997 Exhibit 3 and four copies of the Notice were posted on the site and copies were also posted at the Municipal Building, Library and Post Office on December 10, 1997 Exhibit 4 . 3.3 One letter of comment were received in response to these Notices: Exhibit 5: January 6, 1997 fax from Washington State Department of Natural Resources 3.4. Written comments were received from staff and incorporated into these Findings as follows: The application was received on May 7, 1997 and distributed to City staff on May 8, 1997 requesting that the Planning Department be notified of any additional information needed to evaluate the application. On June 2, 1997 the applicant received copies of staff requests for additional information. On July 7, 1997 a revised SEPA checklist was submitted and distributed to staff. The applicant was also encouraged to meet with the Fire and Building Departments to conduct a more detailed review. A second letter dated July 28, 1997 was sent to the applicant requesting additional information on issues raised including Army Corps of Engineers and State Fisheries permits, uphill erosion, plan for stabilization of dredge materials and impacts of placing salt water dredging on dry land. The application was determined to be complete on December 10, 1997, the applicant notified, and recommendations on merits of the application solicited from city staff. The proposed conditions on page 8 address issues raised. 3.5 Section 25: "Shoreline Special Uses", states, in part, "Uses which are identified in this Master Plan as special uses may be authorized by the Planning Commission after a public hearing.." Notice of Application and Notice of Public Hearing were published in the Anacortes American on December 3, 1997 and December 10, 1997 and posted on the site, Municipal Building, Library and Post Office on December 10, 1997. 3.6 The 30 day review period for this project ended on January 9, 1997. The Environmental Officer forwarded Findings of Fact and Conclusions of Law to the Planning Commission. The Planning Commission reviewed this permit on January 14, 1998, continued the Public Hearing to the evening of February 11, 1998, and conducted a site visit on the afternoon of February 11, 1998. At the conclusion of the Public Hearing the Planning Commission voted unanimously to approve the project subject to conditions as outlined on page 8 below. 4.0 Shoreline Master Plan 4.1 The subject property is in a shoreline area designated Urban II by the Shoreline Master Plan for the City of Anacortes. This designation is primarily for those areas which contain a mixture of commercial, light manufacturing, and high density residential uses. It is the intent of this designation to maintain existing character of the area without substantially increasing bulk or scale of development, and to encourage location of water dependent or water related uses attractive to the public. Uses include, but are 3 I not limited to: Ferry terminals, urban parks and commercial recreation facilities, restaurants, resorts, convention centers and hotels, marinas, shops and markets. 4.2 The applicable goals and policies of the Shoreline Master Plan have been met by this r application. 4.2.1 GOALS AND OBJECTIVES I SHORELINE USE ELEMENT GOAL Shorelines are to be managed and activities coordinated in order to preserve long term multiple benefits of the various shoreline resources. II ECONOMIC DEVELOPMENT ELEMENT GOAL Provide opportunity for development of water dependent, commercial and industrial uses at appropriate locations. Objective: Assure that adequate deep water sites will be available for uses requiring such sites. GOAL Establish multiple-use commercial and industrial sites for compatible activities. 4.2.2. SECTION 20: Use-Activity Policies and Regulations 4. COMMERCIAL DEVELOPMENT: Developments having a primary use for retail or wholesale trade or other business activities. Policies a. Commercial developments on shorelines of the City should be shore dependent or provide an opportunity for a substantial number of patrons or the general public to enjoy the shoreline. b. Commercial development should be encouraged to locate near existing commercial sites or abandoned industrial or manufacturing sites. Regulations a. Except for marinas and related facilities and port facilities, business or commercial uses constructed over water are to be shoreline dependent and provide for regulated public access; this is not to be interpreted to restrict development or commercial uses upon existing docks and wharves. b. Warehousing is permitted on shorelines only as an accessory use directly serving a water-dependent use 11. PORTS AND WATER RELATED INDUSTRY: Public or private facilities for transfer of cargo or passengers from water-borne craft to land and vice versa; and facilities for processing manufacturing and storage of goods. 4 Policies a. Water-dependent industrial or port uses should be given priority for frontage on navigable waters over other industrial uses. b. Public access opportunities are encouraged at port and industrial sites, if such access would not interfere with operations or endanger public health and safety. C. Cooperative and complementary port and industrial activities are encouraged to locate in common areas. d. Shoreline industrial areas presently served with City utilities and transportation networks and zoned industrial should be considered for use before establishing additional industrial shoreline areas. Regulations a. Existing port or industrial development on shorelines which is neither shore nor water dependent or related shall be permitted to expand inland from, but not along the shoreline. b. Plans for industrial developments shall provide for screening and buffer areas. C. The Port of Anacortes and City shall coordinate the cooperative and multiple j use of piers, docks, and parking facilities. 14. DREDGING: Removal, displacement, and disposal of material from the bottom of water bodies, or natural wetlands. Policies a. Dredging shall be done in such a manner as to minimize adverse impacts on marine life and habitat. b. Polluted spoils should be deposited at upland sites and measures taken to contain runoff from the sites. C. Dredging and spoils disposal operations should comply with the water quality standards, guidelines, and regulations of applicable federal, state and local agencies. Regulations a. Dredge spoils shall be deposited in an approved submerged site only if the spoils meet EPA criteria for deposit in navigable waters. 5 b. Dredging shall be scheduled so as not to interfere with migratory movements of anadromous fish. C. Dredging shall be allowed only for those shore dependent uses consistent with this Master Plan, and where the applicant can show that impacts upon water quality and aquatic life are mitigable. d. Dredging of bottom materials for the single purpose of obtaining fill material is prohibited. e. Maintenance dredging of navigable channels and established boat basins is permitted without a shoreline substantial development permit provided such dredging is done in a manner which will minimize adverse impacts on water quality, marine life and habitat. Environments b. Urban II: Dredging is permitted in the Urban II shoreline area designations, subject to the policies and regulations, as provided below: 1) dredging involving removal of less than 1,000 cubic yards is a permitted use. 2) dredging in excess of the limits of subsection (1) is a special use. 4.2.2.1 These Shoreline Master Plan policies and regulations have been met 4.2.3 SECTION 23: Shoreline Special Uses The purpose of special use is to allow greater flexibility in varying the application of the use regulations in a manner consistent with the policies of this Master Plan. Uses which are identified in this Master Plan as special uses may be authorized by the Planning Commission after a public hearing and upon a showing by the applicant that the following conditions are satisfied: 1. The proposed use will not have a significant adverse effect upon the environment or other adjacent or nearby uses, or such adverse effects can be mitigated, or the public benefits of such use outweigh such adverse effects. i 2. The proposed use will be consistent with the policies and general intent of this Master Plan. 3. The proposed use will not interfere with the public use of public shorelines. i 4. The location, design and appearance of the proposed development will be f compatible with surrounding uses. In authorizing a special use, the Planning Commission may impose requirements and conditions in addition to those expressly authorized in the use regulations to prevent undesirable effects of the proposed use. 6 4.2.3.1 This application as conditioned below satisfies the Special Use criteria. 5.0 Zoning Ordinance I 5.1. The City Zoning Map establishes zone boundaries and the City Zoning Ordinance establishes (1) the permitted use of land in the various zones and (2) development standards. 5.2 The subject property is in a Light Manufacturing Use District (LM), Chapter 17.18 of the Anacortes Municipal Code, Title 17, Zoning. 5.2.1 Section 17.18.010 - "Purpose" states: The Light Manufacturing District (LM) is intended to accommodate those businesses which are not compatible with uses found in the Central Business District, and industrial and other uses which do not create noise, smoke, odors, or other objectionable nuisances or hazards detrimental to uses in the LM District or surrounding districts. 5.2.2 Section 17.18.020 - "Permitted Uses" states: "Any light manufacturing use or uses of involving processing or storage of goods provided the processes or equipment employed, or goods stored, processed, or sold shall be limited to those uses which are not objectionable by reason of hazards, odor, dust, smoke, cinders, fumes, noise together with vibration, refuse matter, or water carried waste; marinas together with related uses such as boat repair, boat sales, restaurants, and accessory sales; shipping and terminal facilities; and parks. Retailing other than accessory sales is not permitted except for neighborhood grocery stores through the Conditional Use Process. 5.2.3 These general purposes and uses as set forth in Section 17.18.010 and 17.18.020 have been met by this proposal. I 6.0 Findings of Fact 6.1 The requirements of the State Environmental Policy Act have been complied with. 6.2 The Public Notice requirements of the Shoreline Management Act have been complied with. 6.3 The project is consistent with the shoreline designation and general goals and objectives of the Anacortes Shoreline Master Plan. 7.0 Conclusions A Shoreline Substantial Development/Special Use Permit # 235 should be issued to Anton Lovric for improvements to Lovric's Seacraft at 3022 Oakes Avenue subject to the conditions that: I 7 1. An application for building permit will need to include two (2) full sets of plans drawn to a reasonable scale showing the proposed parking lot e layout, an erosion control plan, a rev gatation plan and other requirements as listed by the terms and conditions of Shorelines Permit No. 235. �i Please find attached a copy of Shorelines Permit No.235 and an application for Grade and Fill permit. All work related to the parking lot excavation shall cease until such time as the appropriate permits have been issued. This new Checklist appears to address the Building Department's concerns as to depth of information. In fact,the Building Department has gone on to make the attached eight substantive comments on your application. These should be read in conjunction with the June 2 memorandum from the Fire Department. I would strongly recommend that you meet with the Building and Fire Departments just as soon as possible to finalize the conditions that they will be recommending to the Planning Commission. Before we can move forward to the Planning Commission,though,the Public Works Department requires additional information on your application. Specifically,will you please provide us with copies of your most recent Army Corps of Engineers and State Fisheries permits. Further, on Section III(3)(a)(3) did all 3,000 cubic yards come from uphill erosion?Please detail in written form how you are following the best management practices required by the Department of Ecology for boatyards. Finally, Public Works needs the following information: a plan for stabilization of the dredge materials that will be placed on the steep slope together with a silt and erosion control plan, details as to how the dredge material is going to be moved 200 feet as described on the drawing, finished contours and section for the proposed fill area, and an assessment as to the impacts of placing salt water dredging on dry land. If you have any questions about these requirements,please contact Mr. Gordon Bruchner, City Engineer. I regret that we are not moving forward faster on this project. As you know, Shoreline Permit #190 for bank stabilization and road improvements was denied by the Anacortes Planning Commission because the necessary engineering work regarding bank stability had not been submitted. I understand from you that you have reached an understanding with the Trafton Estate. . However, this will not change the need for the City to have detailed engineering and soils analysis regarding bank stability before you do any work whatsoever within 200 feet of the ordinary high water mark. Again, as you know, violation of the Shoreline Management Act carries with it the potential for a $1, 000 per day fine for any violations. Beyond the 200 ' shoreline zone, I anticipate that the City Council will adopt regulations affecting slopes such as yours effective by the end of August. I attach a copy of these proposed changes. You should be aware part of your property may be listed as geologically hazardous on our sensitive areas maps as mandated by the Growth Management Act. The following is a brief listing of code requirements that apply to any projects within the City of Anacortes and then specifically to the projects , at your site , that we have discussed that are either in progress or will be in progress in the near future. GENERAL NOTES II Section 103 provides that the Uniform Building Code shall apply to the construction, alteration, moving , demolition, repair and use of any building or structure within the city. Section 104 goes on to state that alterations or repairs made to existing buildings and structures shall comply with the provisions of the building code . Such alterations and additions would not require the remainder of the strutures to be modified unless an unsafe condition were created. Existing buildings and structures constructed prior to the adoption of the current code may have their use or occupancy continued if they are maintained in a safe and sanitary condition. Moved and temporary buildings must also meet the provisions of the Uniform Building Code. Temporary buildings must be removed on or before a date agreed to at the time a permit is issued. Section 105 allows for alternate materials and methods of construction provided that the proponent provides sufficient evidence or proof to substantiate any claims that may be made regarding use of such materials. Section 106 allows for modifications to the provisions of the building code when practical difficulties are involved in carrying out the provisions of the code. Documentation must be provided by the proponent specifically delineating the difficulties and such document must indicate specifically how the modification is in conformanace with the intent and purpose of the code and that such modification does not lesson any fire protection requirements or degree of structural integrity. Lovric ' s Seacraft December 7, 1990 Page 2 j Section 107 specifies that whenever there is insufficient evidence of compliance with any of the provisions of this code or evidence that any materialor construction does not conform to the requirements of this code, the building official may require tests as proof of compliance to be made at no expense to this jurisdiction. Test methods shall be as specified by the code or other recognized test standards. All tests shall be made by an approved agency, and retained by the building official for public record. Section 301 requires that no building or structure regulated by the code shall be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a separate permit for each building or structure has first been obtained. Section 302 specifies the information that must be presented for application. For your reference a copy of section 302 is attached. Section 305 lists the general inspections that must be performed on each project . Basically any work must be inspected before it is covered. Section 306 specifies work that requires qualified special inspectors. Special inspection is required for foundation and other high strength concrete , welding , high strength bolting , spray applied fire proofing, piling, drilled piers and caissons , and other specific areas of work. Special inspectors are licensed and approved for the type of inspections that they handle and are employed by an approved independent testing agency. Section 307 states that no building or structure shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion there of shall be made until the building official has issued a certificate of occupancy. Changes in the character or use of a building shall not be made except in compliance with the building code. The Sate of Washington requires that structures in excess of 4 , 000 SQ. FT shall be designed by a license architect or engineer. Chapter 18. 08 RCW. Lovric' s Seacraft December 7 , 1990 Page 3 Uniform Building Code standard 25 . 14 requires that any piling must be free of damage such as breakage , marine borer damage , or defects . Piling that can not be adequatly inspected for physical requirements specified by the standard, due to barnacles or other adhering materials is also prohibited. The piling must be inspected by a certified inspector approved by the building official prior to installation. Chapter 23 of the Uniform Building Code sets up the general design requirements for structures. All buildings or portions thereof shall be designed and constructed to sustain, with the stress limitations specified in the Uniform Building Code , all dead loads and other loads specified within the code . Impact loads shall be considered in design of any structure were impact loads occur. Section 302 (b) requires plans, engineering calculations, � diagrams and other data to be submitted in one or more sets with each application for a permit. Submittals shall include construction and inspection requirements as defined in section 302 (c ) . As previously noted, plans and specifications are to be prepared by a license engineer who is schooled in the discipline relating to the structure. i Appendix 11-C of the Uniform Fire Code requires that all portions of floats exceeding 250 in distance from fire apparatus access and marine service stations shall be provided wet stand pipe system installed in conformance with applicable standards set forth in UBC standard number 32-2 and article 10 of the fire code. Piers and wharfs shall be provided with fire apparatus access roads and water supply systems with on site fire hydrants as may be required by the chief. Such roads and water systems shall conform to article 10 of the Uniform Fire Code. Index III-B of the Uniform Fire Code requires that an approved fire hydrant be located within 250 feet of the stand pipe connection. The fire .department is reviewing the plans submitted for the shorelines and will verify the j location of required hydrants and the size of the supply lines to the hydrants . i Section 10 . 207 of the Uniform Fire Code requires that an all weather 20 foot wide fire access road be provided to within 150 feet of any portion of any structure. It appears from the use of the buildings that is evident from the outside that fire sprinkler systems are required to protect the interior of each of the buildings. We will take a closer look at this at a later date . The preceeding is based on a preliminary review of the site. As noted above permits are required for all new construction, repair, or remodeling. Two complete sets of plans prepared by a qualified engineer for buildings or structures over 4 , 000 SQ.FT. in area and any structure which does not meet the prescriptive requirements of the code shall be submitted for review prior to issuance of a permit. A permit will be issued at such time that it is determined the project meets all applicable provisions of the codes. It is our determination that dock repair and extension work that has already commenced is in violation of the requirements of the ordinance . No further work is permitted until such time as the existing work has been examined by a professional engineer and/or an inspector certified for the type of inspection required. Based on their reports plans shall be provided showing the existing work which has been approved and that work which must be corrected. Regulations a. Existing port or industrial development on shoreline which is neither shore nor water dependent or related shall be permitted to expand inland from, but not along the shoreline. b. Plans for industrial developments shall provide for screening and buffer areas. C. The Port of Anacortes and City shall coordinate the cooperate and multiple use of piers, docks, and parking facilities. 14. DREDGING: Removal, displacement, and disposal of material from the bottom of water bodies, or natural wetlands. Policies a. Dredging shall be done n such a manner as to minimize adverse impacts on marine life and habitat. b. Polluted spoils should be deposited at upland sites and measures taken to contain runoff from the sites. C. Dredging and spoils disposal operations should comply with the water quality standards, guidelines, and regulations of applicable federal, state and local agencies. Regulations b. Dredging shall be scheduled so as not to interfere with migratory movements of anadromous fish. Environments b. Urban II: Dredging is permitted in the Urban II shoreline area designations subject to the policies and regulations, as provided below: 1. Dredging involving removal of less than 1,000 cubic yards is a permitted use. Findings of fact b 1. The requirements of the State Environmental Policy Act have been complied with. 2. The Public Notice requirements of the Shoreline Management Act have been complied with. 3. The marine boatyard and repair facility is a shoreline dependent use consistent with the City of Anacortes Shoreline Master Program.
