A. FINDINGS OF FACT AND CONCLUSIONS OF LAW:
1. Description of Proposal:
The applicant is requesting administrative site plan approval (Type 2) to construct a 22,500 ± square
foot, 5-story, 25-unit apartment building and associated site improvements including, but not limited
to, landscaping, parking, and stormwater facilities. The subject property is 13,207 square feet in area
and is located in the Residential High Density (114) Zone.
2. Project History/ Chronology:
The applicant /landowner formally submitted their land use permit application for site plan review
(Type 2) and SEPA environmental review on August 5, 2019. The subject application was deemed
complete on September 18, 2019. Notice of the application was provided in accordance with AMC
19.20.120.
3. Site Location:
The subject property is located within the City of Anacortes, west of Commercial Avenue, east of "0"
Avenue, and on the north side of 18 th Street. The site address is 1715 "0" Avenue (formerly addressed
as 1014 & 1020 18th Street) and the property is identified by Assessor's parcel number P55160 &
P55161.
4. Site Description:
The project site's topography is flat in elevation. There are no improvements currently located on the
subject properties; two homes were recently demolished. According to the USDA Soil National
Resource Conservation Services, onsite soils are classified as Bow-Urban land complex.
S. Surrounding Uses:
The subject property is zoned Residential High Density 4 (R4). Surrounding uses include a single-family
residence and commercial parking area across an alley to the north; a commercial development to
the east; single-family residences across 181h Street to the south; and single-family residences across
"0" Avenue to the west.
6. Critical Areas:
There are no critical areas located on the subject property or within 300 feet of the subject property.
7. Utilities:
There is a 6-inch ductile iron (DI) water main in 18th Street that runs east to west. Additionally, there
is a 12-inch sanitary sewer main in "0" Avenue that runs north to south in direction. A 6-inch sanitary
sewer main also runs east to west in direction through the alleyway that abuts the project site along
the northern property line. The applicant/landownerwill be required to hookup to these city services
prior to certificate of occupancy being issued. General facility charges (GFCs) for potable water,
sanitary sewer, and stormwater will be required to be paid for the new development at time of
building permit issuance. Additionally, the applicant will be required to pay for and hookup to a water
meter that is appropriate in size for the development.

9. Public Comments Received:
During the 14-day public comment period, numerous written /emailed comments from the public
were received. Primary topics of concern identified within the comments include the proposed
building's height and compatibility with the surrounding neighborhood, view impacts to existing
residences, traffic congestion, and quantity of parking spaces. The applicant submitted responses to
the comments on October 11, 2019.
In making its decision, the Department has considered the written comments and the applicant's
responses that were timely received, as required in AMC 19.20.130.C.
10. SEPA Environmental Review:
The proposal is subject to SEPA review. The City of Anacortes utilized the optional SEPA DNS process
provided in WAC 197-11-355. The 14-day public comment period ended on October 2, 2019. A SEPA
Mitigated Determination of Non-Significance (MDNS) was issued on January 15, 2020.

1. Application Review:
Per AMC 19.30.020, the development proposal is subject to site plan review. The review criteria for
site plan review are outlined in AMC 19.30.040. Below are the criteria, along with staff comments:
a. Conformance with all other applicable laws, ordinance and regulations.

. AMC Chapter 1 . 2, Underground utilities:

As conditioned below, all site utilities will be placed underground.
c. AMC Chapter 19. 2, oncurrency:
Staff Comments:
The application was routed to the City's Public Works, Police and Fire Departments for review and
comment. Based on this review it was determined that the capacity of concurrency facilities is
equal to or greater than the capacity required to maintain the level of service standard for the
impact from this development application. Therefore, the concurrency test is passed.
Through payment of impact fees and general facilities charges prior to building permit issuance
the development will pay for its proportionate share of new public facilities and infrastructure
needed to serve the new development.
d. AMC Chapter 19.41, Allowed Uses:
Staff Comments:
The subject property lies in the R4 Zone. The proposed 5-story 25-unit multifamily development
was "typed" as "multifamily." Multifamily developments that consist of five (5) or more units are
" permitted outright in the R4 Zone per AMC Table 19.41.040 provided they comply with AMC
19.43.010(H), which outlines standards for multifamily uses.
e. AMC Chapter 19.4 , Form and Intensity Standards:
Staff Comments:
The subject property is approximately 13,207 ± square feet in area. There is no minimum lot size
or maximum density for multifamily developments in the R4 Zone per AMC Table 19.42.020.
Per AMC Table 19.42.020, in the R4 Zone, the setbacks are: street = 10 feet; rear = 10 feet; side
street = 10 feet; and interior side =5 feet with upper floors having a minimum setback of 7.5 feet,
except on an interior side lot line along an alley. After reviewing the application material and
plans, it was determined that the proposal will conform to the setbacks for the R4 Zoning District.
According to AMC Table 19.42.020, the maximum base height in the R4 Zone is forty (40) feet
above average original grade. The maximum permitted height in the R4 Zone can be increased to

fifty (50) feet per AMC 19.42.050(C) when at least twenty-five (25) percent of the total dwelling
units contain no more than 600 square feet of gross floor area. Of the twenty-five (25) units
proposed, nine (9) are to be two-bedrooms while sixteen (16) will be one-bedrooms. Fifteen (15)
of the sixteen (16) one-bedrooms will be 600 square feet or less in gross floor area. This is
equivalent to sixty (60) percent of the units being 600 square feet or less in gross floor area. The
proposed development thus qualifies for the height bonus offered in AMC 19.42.050(C).
Per AMC 19.42.120(B)(1), roof structures housing or screening elevators, stairways, tanks, rooftop
wind generators, ventilating fans or similar equipment required for building operations and
maintenance may exceed the height limit by up to fifteen (15) feet on buildings that are over four
(4) stories in height where they allow access to a shared roof deck that meets the requirements
of AMC 19.62.040(B)(1)(e). The applicant proposes locating roof structures that house or screen
elevators and stairs consistent with this section along with a shared roof deck. After reviewing the
application material and plans, it was determined that the proposal will comply with the height
requirements in the R4 zone.
The maximum permitted lot coverage in the R4 Zone isfifty (SO) percent perAMCTable 19.42.020.
According to the application material and plans submitted, thirty-four (34) percent of the site will
be covered by the proposed structure thereby meeting this requirement.
According to AMC Table 19.42.020, the minimum percentage of landscaping required onsite is
twenty (20) percent. According to the application material and plans submitted, the project will
be meet this minimum landscape requirement.
f. The applicable use standards of AMC Chapters 19.43 through 19.48
'Staff Comments:
As a residential use, the proposed development was reviewed for conformance with the
applicable standards of AMC Chapter 19.43 Residential Uses. AMC 19.434.010(H) contains the
standards for multifamily development. The proposal conforms to these standards. AMC 19.44-
19.48 are not applicable to the subject application.
g. AMC Chapter 19.51, Public Street Improvements Required:
Staff Comments:
The site abuts 181h Street, 0 Avenue, and a public alley. The proposed development includes the
creation of new dwelling units, which will create additional demand and need for public
transportation facilities and infrastructure. Therefore, construction or provision of public right-
of-way improvements consistent with the requirements in AMC 19.51 and 19.52 are required as
a condition of approval. Typical required right of way improvements include paved roadway,
street lighting, sidewalks, curbs and gutters, utilities, street landscaping, traffic and safety control
devices, dedication of public right-of-way and conduit for new and existing utilities. The Public
Works Department reviewed the proposed development application for conformance with the
applicable standards /provisions of the Anacortes Municipal Code, including but not limited to
required public street improvements. As conditioned, necessary public improvements will be
constructed prior to project occupancy, including new sidewalks along the property frontage,
which will be extended to connect with the existing off-site sidewalk at the corner of 0 Ave. and
17 th Street, per AMC 19.51.040.

. AMC 1 .5 , Public StreetDesign:
Staff Comments
The proposed development abuts the intersection of both 18t" Street and "0" Avenue. Both 18tn
St. and 0 Ave. are designated as low volume local streets, have 80-feet of right-of-way width, and
are paved. The Public Works Department reviewed the proposed development for conformance
with the applicable standards /provisions of the Anacortes Municipal Code including but not
limited to public street design and the proposal, as conditioned, was determined to meet these
requirements.
i. AMC 19.53, Private Driveways and Access:
Staff Comments:
The site is proposed to access from 18t" Street via a one-way driveway and egress is provided via
the existing alley or through the shared parking area to 17t" Street to the north.
The Public Works Department reviewed the proposed development for conformance with the
applicable standards /provisions of the Anacortes Municipal Code including but not limited to
private driveways and access and the project was determined to meet applicable requirements.
j. AMC Chapter 19. 4, Subdivision Design and Block Structure
Staff Comments.
Subdivision of property is not proposed therefore this chapter is not applicable.
k. AMC Chapter 19.61, Block Frontage Standards:
Staff Comments:
Neither 18' Street nor 0 Avenue have a specific block frontage designation; therefore the block
frontages are subject to the provisions for"Undesignated" block frontages in AMC 19.61.110. The
proposed development was reviewed for conformance with AMC 19.61 regulating block frontage
standards and determined to meet these requirements.
I. AMC Chapter 19.6 , Site Planning:
Staff Comments:
AMC 19.62 contains standards for relationship to adjacent properties, internal open space,
internal pedestrian access and design, vehicular circulation and parking, and service areas and
mechanical equipment. The project's internal open space requirements are proposed to be met
through a combination of shared open space, ground level individual outdoor space, balconies,
and a shared roof deck. Proposed service areas, including trash dumpsters and recycling areas,
are sited for alley access per AMC 19.62.070.B.
The proposed development was reviewed for conformance with AMC 19.62 regulating Site
Planning standards and, as conditioned, was determined to meet these requirements.

m. AMC Chapter 19.63, Building Design:
Staff Comments:
Applicable standards for building character, massing and articulation, building details, materials,
and blank wall treatments are intended to result in development that is of high quality and
appropriate to Anacortes's character and context. The proposed development was reviewed for
conformance with AMC Chapter 19.63 regulating building design and was determined to meet
the applicable requirements.
n. AMC Chapter 19.64, Parking:
Staff Comments:
The applicant submitted a parking demand & supply study, dated December 18, 2019, prepared
by Gibson Traffic Consultants, Inc. According to this report, twenty-nine (29) off-street parking
spaces and six (6) guest parking spaces are required.
Of the twenty-five (25) multi-family units proposed, nine (9) will be two bedrooms while sixteen
(16) will be one-bedrooms. According to AMC Table 19.64.040, the minimum number of off-street
parking spaces required for multifamily developments is based on the number of bedrooms
proposed. For one (1) bedroom units, the minimum number of off-street parking spaces required
is one (1) space per unit. Therefore, the sixteen (16) one (1) bedroom units, sixteen (16) spaces
are required. For each of the nine (9) two bedroom units, the minimum number of off-street
parking spaces required is 1.4 spaces per unit. This equates to 12.6 spaces (rounded to 13) for
nine (9) two (2) bedroom units. Therefore, twenty-nine (29) off-street parking spaces are required
for the twenty-five unit multifamily development according to Table 19.64.040.
To meet minimum off-street parking requirements, the applicant proposes constructing a
seventeen (17) space parking lot east of the new building and providing the balance of parking
spaces in a shared parking area located immediately to the north of the site in an existing lot also
owned by the applicant. Per AMC 19.64.080 shared parking is allowed for two or more buildings
or uses to collectively provide required off-street parking when certain criteria are met. The
applicant submitted a parking study prepared by a professional engineer with expertise in traffic
and parking analyses that demonstrates conformance with said criteria. Prior to issuance of final
occupancy,the applicant must record a legally binding document, such as a covenant or reciprocal
easement agreement in the chain of title for the properties utilizing the shared parking. This
document must be provided to the city for review and approval prior to recording.
Guest parking is required per AMC 19.64.030. Guest parking for multifamily developments require
one (1) guest parking space per 4,000 net square feet of leasable floor area per AMC Table
19.64.030(B). According to the applicant's traffic report, this equates to the need for six (6) guest
parking spaces for a 22,500 square foot proposed building. The applicant proposes locating guest
parking adjacent to the development along both 18' Street and "0" Avenue, which is permitted
per AMC 19.64.030(B).
The development is required to provide short and long-term bicycle parkingfor residents perAMC
19.61.100.

The proposed development was reviewed for conformance with AMC Chapter 19.64 regulating
parking and was determined to meet these requirements.
o. AMC Chapter 19.65, Landscaping:
Staff Comments:
A landscape plan prepared by a Washington State licensed landscape architect was submitted
with the application materials. The landscaping plan was reviewed for conformance with
AMC Chapter 19.65 regulating landscaping and was determined to meet the applicable
requirements. Landscaping must be installed prior to building occupancy per AMC 19.65.100.
p. AMC Chapter 1 .66, Fences, Walls, and edges:
Staff Comments:
The proposed development was reviewed for conformance with AMC 19.66 regulating
Fences, Walls, and Hedges and determined to meet these requirements.
. AMC Chapter 19. 7, Signs:

No signage is proposed at this time; future signage will be required to obtain a sign permit
and will be reviewed for conformance with this chapter.
r. AMC Chapter 19.69, Standards, Generally

AMC Chapter 19.69 contains standards for exterior lighting. Prior to building permit issuance, the
applicant must provide a lighting plan that demonstrates compliance with these standards. As
conditioned, all exterior lighting will be required to be down-shielded thereby preventing or
lessening light trespass and glare.
The proposed development was reviewed for conformance with AMC 19.69 regulating general
standards in the City of Anacortes including but not limited to noise, air pollution, glare, exterior
lighting, and the vision clearance triangle. The proposed development was determined to meet
these requirement as conditioned below.
s. AMC Chapter 17.70, Critical Area Regulations:

No critical areas are present on the subject property or within 300 feet.
t. AMC Chapter 18.04, State Environmental Policy Act:

As stated above, the proposed development is subject to SEPA environmental review per AMC
18.04.120. A SEPA Mitigated Determination of Non-Significance (MDNS) was issued on
January 15, 200 after using the Optional DNS process in WAC 197-11-355.

The proposed development does not lie within close proximity to a shoreline of statewide
significance.
v. AMC Chapter 19.76, Stormwater:

The applicant submitted a stormwater drainage analysis that addresses the project site's soils,
impervious surfaces proposed, and stormwater that would be generated onsite along with how
the proposed development will comply with Anacortes Municipal Code Chapter 19.76 and the
Department of Ecology's 2012 Stormwater Management Manual for Western Washington (as
amended in 2014) that was adopted by the City of Anacortes. The city utilized the consultant Gray
and Osborne for third party review of this stormwater drainage analysis. On November 19, 2019,
the City of Anacortes Public Works Department accepted the October 16, 2019, revision to the
stormwater drainage analysis. Runoff during construction and future use of the site will be
handled in conformance with the City's regulations and standards. A NPDES permit from the State
of Washington Department of Ecology for construction activities may be required and is the
applicant's responsibility to obtain.
w. AMC Chapter 19.78, Clearing & Grading:

Conformance with this Chapter will be reviewed upon submittal of detailed clearing and grading
plans prior to building permit issuance.
12. 120-Day Clock:
Pursuant to AMC Table 19.20.160, a decision on the application shall be made within 120 days from
the date of the letter of completeness. As of the date of this decision, 68 days have elapsed on the
120-day clock.
1 . Conclusion:
The proposed development, as conditioned below and in the issued SEPA mitigated determination of
non-significance (MDNS), will make appropriate provisions for the public use and interest, health,
safety, and general welfare, and will be in conformance with the criteria in AMC 19.30 Site Plan
Review.
B. DECISION:
Based on the foregoing findings and conclusions of law, and review of the City's regulatory authority to
implement the policies, standards, and regulations of the Anacortes Municipal Code, the Planning Director
hereby grants approval of the site plan subject to the following conditions:
1. The site plan date stamped "approved" January 15, 2020 is the approved site layout.

2. The landscape date stamped "approved" January 15, 2020, is the approved landscape plan.
3. Development shall comply with the approved Stormwater Drainage analysis reviewed and accepted
by the City of Anacortes Public Works Department. Best management practices shall be employed
and in use at all times during construction activities [grading, cut, fill, construction, etc.].
4. Prior to building permit issuance, the associated boundary line adjustment consolidating lots shall be
recorded with Skagit County Auditor's office.
5. The development is subject to applicable water, sewer, and stormwater general facility and hookup
fees and transportation, fire, and park impact fees. These fees are payable at levels in effect at the
time of building permit issuance.
6. Prior to any construction activities (grading, cut, fill, etc.) taking place onsite, the applicant shall have
the subject property surveyed by a Washington State licensed surveyor. The surveyor shall place the
property corners onsite visible to all unless it has already been done.
7. Prior to work beginning, the applicant/landowner shall obtain all required local, state, and federal
permits, including a building permit from the City.
8. Prior to work beginning, orange construction fencing shall be installed at the project boundary's
clearing limits and property lines.
9. The project shall comply with the mitigation measures outlined in the SEPA MDNS issued on January
15, 2020:
a. If any artifacts or human remains are found upon excavation, the Samish Indian Nation; the
Swinomish Indian Tribal Community; the City of Anacortes' Department of Planning, Community,
& Economic Development; the City of Anacortes' Police Department; and the State of
Washington's Department of Archaeology and Historic Preservation (DAHP) shall be immediately
notified and all work in the immediate area cease. Pursuant to RCW § 27.53.060 it is unlawful to
destroy any historic or prehistoric archaeological resources. RCW 27.44 and § 27.53.060 require
that a person obtain a permit from the Washington State Department of Archaeology and Historic
Preservations before excavating, removing, or altering Native American human remains or
archaeological resources in Washington. (MDNS #1)
b. Erosion control, dust control, and best management practices shall be employed during
construction /development activities as required by both the Building and Public Works
Departments. (MDNS #2)
c. Track out of mud and debris on to 18' Street or "0" Avenue is prohibited. The applicant shall
sweep the street as needed to prevent track out. (MDNS #3)
d. Work hours for the development /construction activities onsite are limited to 7:00 AM to 10:00
PM, Sunday thru Saturday excluding national holidays observed by the City of Anacortes. No work
outside of these hours is permitted. (MDNS #4)
e. Grading shall not adversely impact adjacent properties. (MDNS #5)

f. The applicant shall obtain from a WA State licensed surveyor a survey of the maximum height of
the proposed structure. This survey shall be submitted to the City of Anacortes Planning and
Building Departments before the framing inspection occurs to make sure development does not
exceed the maximum permitted height (50 feet for the building itself and 65 feet for the elevator
& staircase shafts that extend beyond it) for the underlying zoning district as measured from
average original grade. (M DNS #6)
g. All exterior lighting shall be down-shielded thereby preventing glare and light trespass. (MDNS
#7)
10. The project shall comply with the requirements of the Public Works Department including but not
limited to:
a. A Storm Water Quality and Quantity Plan consistent with City requirements shall be submitted by
the applicant for review and approval by the Planning\Building and Public Works Departments
prior to any construction activities taking place on or off-site.
b. Prior to any clearing\fill\grade work beginning, construction civil plans consistent with the City of
Anacortes Engineering Development Standards, including but not limited to, Clearing and Grading
Plan, Erosion Control Plan, Site utility\Infrastructure improvements Plan, Roadway Improvements
Plan, Signage Plan and other plans and\or information required by the City Planning\Building and
Public Works Departments shall be submitted for review and approval.
c. Engineering and Inspection fees in the amount of $500.00, plus 2% of the total estimated
construction cost shall be due upon civil plan approval. No construction activity is allowed until
the construction plans are approved, all fees have been paid and a preconstruction conference
held.
d. Prior to the Final Certificate of Occupancy, all infrastructure improvements shall be completed as
required by the City of Anacortes Public Works Director and a 2-year Maintenance Bond in place.
The 2-year Maintenance Bond is 10% of the actual construction cost.
e. Fire Lines, Fire Hydrants and related appurtenances are to be located as approved by the City of
Anacortes Fire Chief and Water Department. Fire flows shall be addressed in a manner acceptable
to the Fire Chief and the City of Anacortes Public Works Department.
f. Mailbox locations shall be reviewed and approved by the City of Anacortes Public Works
Department and the U.S. Postal Service.
g. Sanitation, recycling and compost collection will be internal to the project site.
h. Street Improvements along 18th Street and 0 Avenue:
L Installation of 6-foot Cement Concrete Sidewalks, located 6-feet from the back of curb.
Including, but not limited to, sidewalk ramps at both intersections and driveway
entrances to the project site and Public Alley Way and related appurtenances.
i i. Storm water conveyance both on-site and off-site shall comply with City Storm drainage
requirements.
i. For buildings serving over ten units, side sewers shall be a minimum of 8-inches in diameter and
must connect to a manhole.

j. All Sanitary Sewer structures shall have vehicular access, including but not limited to: 1) A 12-foot
minimum width access road with an approved all-weather surface asphalt road, or other
approved Low Impact Development Best Management Practice design, 2) Meeting the minimum
structural requirements for Access Road approved by the City of Anacortes.
11. Before a certificate of occupancy being issued, a legally binding document such as covenant or
reciprocal easement agreement concerning the proposed shared parking between buildings shall be
submitted to the City of Anacortes Planning Department for review and approval. Once the city has
reviewed and approved the legally binding document, it shall be recorded with the Skagit County
Auditor's office in the chain of title for the subject properties.
12. Before certificate of occupancy is issued, required parking areas shall be Constructed, parking stalls
striped, wheel stops installed, and directional signage installed.
13. Before certificate of occupancy is issued, short and long-term bicycle parking areas shall be
constructed/installed per the approved plans.
14. Before certificate of occupancy is issued, all required and approved landscaping and irrigation shall be
installed per the approved landscape plan.
15. All rooftop and ground level mechanical equipment shall be organized, proportioned, detailed,
screened, landscaped, and/or colored to be an integral element of the building and minimize visual
impacts from the ground level of adjacent streets and properties per AMC 19.62.070(E).
16. The dumpster/recycle storage area must be sized to accommodate the minimum clumpster sizes (as
provided by the Anacortes Engineering Design Standards) for garbage, recycling, and composting. The
enclosure surrounding the garbage /recycle area shall and constructed and in place before certificate
of occupancy can be issued.
17. If any sign is proposed advertising the development, a sign permit will need to be obtained first that
complies with AMC Chapter 19.67.
18. Provide a Traffic Control Plan (Current MUTCD Manual) prior to any construction taking place in the
public right-of-way for approval by the City of Anacortes' Public Works Department.
