Mike,

You will need an encroachment agreement for the private infrastructure in the Public Right-of-Way.

If and when they ever sell in the future, the title companies will be looking for the encroachment agreement so they are not held liable in the future. I can work with your clients on
the encroachment and recording.

Hope that helps,
Steven Lange
Senior Engineering Tech

From: Michael Trafton <>
Sent: Friday, February 26, 2021 3:50 PM
To: Lange, Steve <>; Frisinger, Rob <>; Grage, Libby <>
Subject: Re: 2602 17th Street

Thanks for this you guys, I may still need a little more explanation but I will look at trying to make this fit closer to the house and then if access is thru the public right of way
that would need to be added to the title?, correct?

Thanks, Michael

Telesis Design
Michael Trafton
4534 Sharpe Rd
Anacortes, Wa. 98221
360.420.1497 cell/text
<>

On Fri, Feb 26, 2021 at 1:59 PM Lange, Steve <<>> wrote:
Kellogg is an unimproved Right-of-Way.

To answer Rob’s question, the driveway can be constructed as part of an Encroachment Agreement with the City.
