We are your neighbors located at 1800 Down Jones Way. For the past year now we have had a great increases in wet, Soggy ground all around our property. We even have standing water from time to time. We are trying to assess and see if anyone else on the street is experiencing any water problems on or around their property at anytime this past year. If so, we hope to put together a notice to the city regarding this problem. We have information that an 8" perf drain was to be put in by the developer/contractor of the new development in Jones field. This particular drain,'which was in the blue print according to Speed Garrett, Public Works inspector for the city, was to be put along the fence line running East to West behind the North side of Down Jones Way. As many of us know, it was not put in. Thus, water problems. Again, if you are having ANY problems, please sign your name, address and a description of any new water/wet areas on your property and bring it by our place. (Note to all of you with backyards attached to the new development, walk along the backside and see if you are getting a"squish" of water when you step on the ground). WE WANT TO THANK THE 6 OF YOU WHO REPONDED TO OUR LETTER. WE HOPE ALL NEIGHBORS ON DOWN JONES WAY WILL RESPOND. IN THE MEAN TIME,IT WILL BE IMPORTANT FOR US TO MOVE ON WITH SOME ACTION. LYLE DAVIS, THE HEAD ENGINEER/(STORM MANAGEMENT), TOOK OVER AND WE WERE ENCOU- RAGED BY LYLE TO SPEAK DIRECTLY TO HIM ABOUT THIS CASE. HOWEVER, I CALLED SPEED ON FEB. 14,1997 (a year after our first talk and walk around our property),AND HE WAS VERY SUPRISED TO HEAR THAT THIS HAD NOT BEEN TAKEN CARE OF. HE AGREED, "IF IT'S IN THE BLUE PRINT,LET'S GET IT DONE." HE THEN SAID THAT HE WOULD"LOOK BACK INTO IT.." GIVE SPEED A CALL AND LEAVE EITHER VM ON THE FIRST NUMBER LISTED OR CALL HIS CELL PHONE NUMBER AND SPEAK TO HIM IN PERSON. PLEASE REALIZE BE HAS BEEN "REMOVED FROM THE CASE" BUT HE REALLY IS THE ONLY UP FRONT CONTACT WE HAVE. AFTER CALLING SPEED, THEN CALL LYLE DAVIS . LYLE DAVIS IS THE ONE WHO IS REALLY"IN CHARGE" OF THIS PROBLEM. IT WAS A REAL CONTRAST TO HAVE SPEED ON OUR PROPERTY AND HAVE HIM SAY, "IN THE BLUE PRINTS, (for the new development), THEME IS TO BE A 8"PERF DRAIN PUT IN ALONGSIDE ALL OF YOUR FENCES RUNNING EAST TO WEST THE WHOLE DISTANCE OF THE DEVELOPMENT." THEN LYLE CAME AND TOLD US, "YOU NEED TO DIG AND PUT IN 2 PERF DRAINS ON YOUR PROPERTY." b WE DO NOT WANT TO GET"UGLY" OR MAKE A"SCENE". WE JUST WANT THE DEVELOPER/CONTRACTOR TO BE HELD RESPONSIBLE FOR PUTTING IN THE PERF DRAIN AS PER HIS INITIAL AGREEMENT. IF THE BLUEPRINTS HAD THIS IN IT...THIS NEEDS TO DONE NOW. He stated that "a perf drain was actually the request of the city to the contractor, that the drain was in the original blueprints, and that the dev./contractor should have put a drain in..." He also stated that the dev./contractor said that"...the development area was draining fine until he put homes on it and now it is the new homeowners responsibility to dig a drain." Lyle suggested that we see if we can "...get the individual neighbors to do something,i.e., dig and put in drains". We then said that it was NOT draining well prior to ground breaking because the developers had brought in so much soil or moved it so that the topography was a lot higher than previously, and at that point the trouble began. We said it had nothing to do with the new homeowners and stated that we would not ask our new neighbors to "clean up" after the developer/contractor. It was his responsibility and it still is. Lyle was very suprised that the developer had brought in or moved soil, thereby building up the topography. He said he will check into that. We are your neighbors. We live at 1 800-Down Jones Way. We have a concern and would like to discuss it with you and hear your opinions and or remarks. As you all know, the new development is now well on its way behind us. We were the"new kids on the block" and we were only able to enjoy the pasture/field behind us for 6 months before they started to break ground. Despite all of our collective efforts as residents behind the development we went unheard at the city council meeting. I know several of you, as were we,disgusted with our treatment at those meetings. The point of this letter is this: Last February we called the city and started reporting large amounts of standing water and very soggy ground all around our property. A city engineer, Speed Garrett, came to our home after a phone call. He stated on Feb. 14, 1996, that"there would be a,8"pert: drain behind all of our homes at the fence line (their side) by spring, that it was in the blue print." I was at this point very encouraged and trusted that it would happen. At that time, the first house behind all of us was not completed. On 3-22-96 I called the city again because the house was near completion.' They stated, "I will check into that." On 4-3-96, I called and left msg. Speed called back. He had talked to the contractor/developer and the contractor/developer had"agreed to a 6" perf drain." They would also"re-grade and see." On 4-23-96 I called again, and Speed said, "they had received. a letter from the contractor/developer that they will do the drain however, the weather conditions...." I stressed my concern that the people had begun landscaping unknowing that a drain would be.going in. I called again on 5-22-96 and stated once more we had a lot of standing water and soggy ground. I also told them that the new owners appeared like they knew nothing of a upcoming perf drain.!On 6-4-96 I left a msg. on Speeds VM, because the fence was us and still nothing had been done. 675-96 left another msg. on VM. 6-6-96 I spoke with Speed and heard"we will shoot some elevations." Within a week or so, I was told I needed`to talk to Lyle Davis, head engineer. Lyle came to our home and walk the property and said that we,would need to dig a perf drain in our yard. He stated all sorts of round-a bout statements and I kept trying to ask "was the pert drain in the blueprints'?" And he continually avoided the question. He/Stated something about water"not running uphill." It doesn't take a rocket scientist to see that the new development is NOT downhill from us. He also said that the city had the developer push a ledge of dirt up towards all our properties to stop the water from running off into our yards. I did get kind of sassy at that point because I asked him if he had ever heard of"erosion." This letter may not ever meet a need for you. You may or may not have a soggy yard than you had before the new development went in, but we need to hear from you. We are trying to form a letter to the city and we would like to know if this involves more than just a few of us. SO, if your yard is wetter than it has been in the past prior to the new development please let us know. March 15, 1997 To: Mayor Dean Maxwell Councilman Ken Brown Ffom: Various citizens on Down Jones Way(North side only) Regarding: Water/drainage problems arising from new Horizon Heights Development. Please fmd enclosed, per request from Alice Andrews and other citizens living on the north side of Down Jones Way, several letters and responses regarding this drainage problem. As these letters will establish, we are collectively agreed up the fact that the development of the land directly to the north of us is responsible for greatly increased water drainage problems on our properties. To compound the problem, the issue of the 8" perf drain as 6e4 requested by the city to the developer/contractor, has electively been 'Sa +a[ dismissed by the developer. id le/eirvig We as citizens are now requesting your assistance in permanently resolving this issue to the satisfaction of those of us at risk for damage to our properties due to the increased standing water problem. If the drain is installed as originally designed per the blueprints, this problem would be quickly resolved. If left unattended, as it has been since our first contact (Feb '96) with the City Public Works Inspectors' Office (Speed Garrett, Lyle Davis) , the problem will of course escalate and damages could be great. On March 20th at 10:10 a.m. we received a phone call from the mayor: "Mr. and Mrs. Burch, this is Dean Maxwell Mayor of Anacortes. I received your correspondence Monday and sent Don Messmer out. We are going to proceed to get this problem corrected within the next 10 days, with the developer, and I wanted to thank you for bringing this to my attention. We will see if we can't get this taken care of. If you experience any more difficulty here after this is fixed please give me a call. Again, we want to get this moved forward as quickly as we can. Thanks. The "correspondence ..." the mayor is referring to is the letter that you all signed last week-end. Let's all hold him accountable. 10 days ( working days) from now would be APRIL 3rd. We had dealt with Lyle Davis several times and felt"put off" when we would ask for help. We would also like to commend Speed Garrett. This man is above reproach and has great amounts of integrity. He was the only one we dealt with(up until you) that was saying exactly what was wrong and what the blueprints said. Men of integrity are hard to find now days and we surely appreciate people like you and Speed. It boosts our confidence and respect for officials like you. Once again, thank you. We will continue to monitor the site conditions throughout construction on the affected lots as well as through the landscaping process to ensure that drainage requirements and agreements have been complied with. On April'.3rt, the day after.our meeting, we took measures to alleviate the storm water running from our lot 39 onto the neighbor on Down Jones Way. To address the issue of storm water running ftvntn the finished lots 39 through 46 of Ifolizon Heights Division 4 onto the adjoining neighbors on Down Jones Way, Pacific Sttrrlmits intention is to take it on a lot by Iot basis. We have so far been able to finish grade the lots with a northeasterly stope froM the hack of the hack yards to the back cast L;utttci' of the house where we put in a►tight line to catch the water. By doing this a number of the yards have a bank approximate! five feet wide that elopes towards the adjoining neighbors along Down Jones Way. I am writing concerning the erf drain we have been told several \s'' times is to be put in on the property directly behind us(which now has 3 newly constructed homes y :' standing on it). I On numerous occassions since February of this year,we have contacted your office and spoken with Speed Garrett concerning this issue. Speed even came out to our home and inspected the drainage problem being caused by the excavation behind us. On 2/14/96,in response to our phone call, Speed came to our house and after inspecting the problem in our back yard stated that"an 8 inch pert drain will be put in by spring of this year behind all houses to H Avenue bordering the new development." On 3/22/96 we phoned and spoke with Speed again stating that the owners of the (then 2)new homes behind us were starting to landscape their yards and that it would be"looked into". On 4/3/96 we called again and left message which Speed returned and stated that he had"talked to the contractor and he will do a 6 inch perf drain". On 4/23/96 we were told that a letter had been received from the contractor himself stating that he would do this drain,but that weather conditions have not permitted it. Meanwhile,of course,the new homeowners behind us continue to landscape their yards,unaware that the new perf drain will go through the middle of their back yeards. On 5/23/96 we left a message again for Speed,and again on 06/04 and 06/05. Today we received a call back from Mr.Davis who stated,among other things,that we are the only people calling and he has not heard of anyone else on our street having such problems. (Please see next paragraph and attached signatures for a response to this.) Mr.Davis is also planning a visit to our home today to"shoot some elevations",as he stated. Now we wish to express our appreciation for the help Speed has been thus far,but we are absolutely dumbfounded about when the new homeowners are going to find out about the drain,and especially when you are going to enforce the digging of this drain,(which may I remind you is in the contracter's blueprints and which he has already said he do via the letter received in April.) Every day that goes by means that another fence post has been erected,another yard landscaped,and NO drain has even been discussed with the new homeowners. With every rain,the standing water gets worse in my own back yard,which certainly hasn't been helped by the topographical build-up that took place behind us to prepare for the construction of these new homes. We are asking you,in all honesty to please require the contractor to do what he has already said and what he is obligated to do about this problem. We are not alone in these water problems**as people all along the border of this new development have been affected. Your prompt attention to this matter is greatly appreciated. I will contact my homeowner's insurance to check into coverage for any ensuing damage from lack of attention to this matter.
