Resolution No. 3061 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANACORTES SUPPORTING LITIGATION <br /> TO ABATE A PUBLIC NUISANCE BY WILLIAM COLEBURN AND DENISE COLEBURN <br /> WHEREAS, pursuant to Section 35A.21.160 RCW, the City of Anacortes has the same powers <br /> which any city of any class may have, including the power to abate nuisances provided to First <br /> and Second Class Cities by Sections 35.22.280(30) and 35.23.440(10) RCW; and <br /> WHEREAS, William Coleburn and Denise Coleburn ("Coleburn") are the owners of Skagit <br /> County Tax Parcel No. 128398, P4709 Welch Lane, Anacortes (the "Property"), located in <br /> unincorporated Skagit County just south of the City of Anacortes and abutting the Anacortes <br /> Community Forest Lands; and <br /> WHEREAS,the Property is zoned Rural Reserve ("RRv")pursuant to Skagit County Code <br /> ("SCC") 14.16.320; and <br /> WHEREAS, Coleburn maintains an Animal Preserve on the Property, including business <br /> invitation of the public onto the Property for tours, animal interaction and the like; and <br /> WHEREAS,the maintenance of an Animal Preserve requires a Hearing Examiner Special Use <br /> Permit pursuant to SCC 14.16.320(4)(c); and <br /> WHEREAS, Coleburn has failed to obtain a Hearing Examiner Special Use Permit for the <br /> Animal Preserve at the Property; and <br /> WHEREAS, in addition to the foregoing land use violation, Coleburn's maintenance of animals <br /> at the Property violates RCW Chapter 16.30 and/or SCC Chapter 7.04, governing potentially <br /> dangerous wild animals; and <br /> WHEREAS, animals from the Predators of the Heart Animal Preserve on the Property have <br /> escaped their enclosures and entered Anacortes Community Forest Lands and private property on <br /> several occasions, and have killed domesticated dogs accompanied by residents and created a <br /> threat to the health and safety of the Anacortes community; and <br /> WHEREAS, the Board of Skagit County Commissioners adopted Resolution R20210226 on <br /> November 8, 2021, authorizing the Skagit County Prosecuting Attorney to bring legal action in <br /> the name of Skagit County against William Coleburn, Denise Coleburn, the Property in rem and <br /> any other appropriate parties to abate a public nuisance; and <br /> WHEREAS, on November 8, 2021, the Skagit County Prosecuting Attorney filed a Complaint <br /> for Injunctive Relief and to Abate a Nuisance in Skagit County Cause number 21-2-00674-29; <br /> and <br /> Resolution Authorizing Litigation To Abate Coleburn Nuisance and Recover Costs- 1 <br /> Page 3 of 188 <br />
