The project would <br /> include the placement of 3,000 cu. yds. of fill and 500 cu. yds. of <br /> excavation/cut for a total of 3,500 cu. yds. The subject property is located <br /> within the Residential Low Density 2 (R2) zoning district. <br /> The City of Anacortes Department of Planning, Community & Economic Development has determined that <br /> this project does not have a probable significant adverse impact on the environment. Pursuant to WAC <br /> 197-11-350(3), the proposal has been clarified, changed, and conditioned to include necessary mitigation <br /> measures to avoid, minimize or compensate for probable significant impacts. <br /> An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). The necessary <br /> mitigation measures are listed below, the Environmental Checklist is attached, and additional project <br /> information is available at https://www.anacorteswa.gov/161/Planning-Community-Economic- <br /> Development. <br /> PUBLIC COMMENTS RECEIVED <br /> Notice of application with optional SEPA DNS process was published on May 26, 2021, with the comment <br /> period ending at 5:00 pm on June 9, 2021. Public comments were received with concerns over the hillside <br /> stability and down-slope risks. The concerns of these comments have been considered in this <br /> determination. <br /> CRITICAL AREA REVIEW <br /> Pursuant to AMC 17.70 regulating critical areas, the subject development was reviewed for proximity to <br /> critical areas. The subject property must comply with the following provisions: <br /> • AMC 17.70 Article IV: Geologically Hazardous Areas <br /> o Prior to the completion of the comment period, a Critical Area Assessment and Geotechnical <br /> Engineering Report, dated June 3, 2021, prepared by MTC, INC was provided. An addendum to <br /> said report, dated July 29, 2021, was provided upon the completion of the comment period. <br /> o Peer review was conducted for the original MTC report as well as the addendum report by <br /> GeoEngineers.
