DocuSign Envelope ID:30AAF4F8-C6E0-409D-9E9A-4D50CF9FC096 <br /> RESOLUTION 3005 <br /> A RESOLUTION UPDATING THE WORK PLAN ADOPTED IN RESOLUTION 3068 <br /> REGARDING BONUS HEIGHT PROVISIONS IN THE R4 ZONE WEST OF THE <br /> COMMERCIAL ZONE RELATED TO ORDINANCE 3076 <br /> WHEREAS, the Anacortes City Council adopted Ordinance 3054 October 21, 2019 a <br /> Moratorium on accepting certain land use permits in the R4 Use Zone west of the Commercial Use <br /> Zone that proposes to utilize the bonus height provisions of AMC 19.42.050; and <br /> WHEREAS, the City Council adopted Resolution 2068 on December 2, 2019, adopting a work <br /> plan for evaluating bonus height provisions in the R4 Zone west of the Commercial Zone; and <br /> WHEREAS, the City Council adopted Ordinance 3069 on April 20, 2020, which affirmed the <br /> moratorium and extended it for an additional six months through October 21, 2020; and <br /> WHEREAS, the City Council considered Ordinance 3076 at the September 28, 2020 meeting, <br /> which would extend the moratorium for an additional six months; and <br /> WHEREAS, the City Council held a public hearing on Ordinance 3076 on October 12, 2020; <br /> and <br /> WHEREAS, the City Council desires to continue working to review the maximum building <br /> height in the R4 Use Zone west of the Commercial Use Zone with public input; <br /> WHEREAS, a moratorium is a recognized technique to preserve the status quo while new <br /> plans and regulations are developed and avoid a rush for permits whenever a community desires to <br /> change its planning ordinances; and <br /> WHEREAS, RCW 36.70A.390 and AMC 19.16.110 authorize the City Council to adopt <br /> moratoriums, interim zoning ordinances, and interim official controls; and <br /> WHEREAS, RCW 36.70A.390 and RCW 35A.63.220 require cities to hold a public hearing <br /> within sixty (60) days of the adoption of such moratoria to develop a work plan; and <br /> NOW THEREFORE, BE IT RESOLVED BY THE ANACORTES CITY COUNCIL: <br /> Section 1. Findings of Fact. The City of Anacortes City Council makes the following findings: <br /> A. The above recitals are adopted as findings of fact. <br /> B. The City Council reaffirms Ordinances 3054, 3069, and 3076 establishing and extending a <br /> Moratorium on accepting land use or building permit applications in the R4 Use Zone west <br /> of the Commercial Use Zone that proposes to use the bonus height provisions of AMC <br /> 19.42.050. <br />
