A site visit was conducted on January 14th, 2004 to evaluate conditions. The items listed below correspond by number with Mr. Rasmussen's letter. 1. The alley grades have been modified, currently sloping to the back yard of 2417 14th street. A rock wall has also been constructed in the alley right of way without the required encroachment agreement. The encroachment aareement could include conditions requiring re-grading of the alley, drainage behind the wall, and grass seeding the alley. The downspouts currently discharge to the surface, which slopes to the northwest, the lower property. The down snouts could be connected to the discharge tight line required for the rock wall, termination away from the downhill properties. yhe building department will be contacting' the owner of 2418 15th for an appointment to inspect the garage for confirmation of sewer connection and- alterations of the building. The owner will be informed of the necessary permits, as built requirements and construction requirements as needed. 4. After re-grading, the alley would need to be reseeded with grass. The encroachment agreement could include a condition regarding spraying weed or grass killer in the alley. 1 It appears there have been several changes to the alley grades and a rock wall constructed within the past few months, which are not noted in the address file. Anacortes City Attorney Post Office Box 547 Anacortes, Washington 98221 Re : Public Nuisance Dear Mr. Munce : I write on behalf of Mr. Samuel Holmes, who respectfully requests that the City of Anacortes take long-overdue action to abate a public nuisance in the alley behind his residence . Mr. Holmes and his spouse live at 2417 Fourteenth Street in Anacortes . The unabated nuisance of which Mr. Holmes complains is located in the alley bordering the Holmes property to the south. The actions of Mr. David Manz, who lives on the south side of the alley at 2418 Fifteenth Street, slightly uphill from the Holmes property, are the cause of the nuisance. Over the past few years, Mr. Manz has very significantly changed the grade in the alley at least two times, apparently without any authorization to do so. Mr . Manz began in 1999 by dumping several cubic yards of fill from his property into the alley, not only raising the grade of the alley by several inches, but also rolling several rocks into the Holmes backyard and leaving them there . Next, Mr. Manz graded the alley with a tractor, pushing dirt into the Holmes yard in the process . In its present unnatural form, at least 18 inches above original grade, the alley diverts excessive water runoff and erodes fill dirt into the Holmes back yard. This problem is exacerbated by downspouts on the Manz garage that are not connected to the storm system and are instead allowed to pour right into the alley. Mr . Holmes no longer has a level surface from which to Ian Munce, Esq. December 30, 2003 Page 2 of 4 maintain the fence and shrubbery along the southern border of his property. Denuded of its former ground cover of lawn grass, and appearing like a tailings pile, the alley has become a complete eyesore . Mr. Manz has also sprayed grass killer in industrial quantities into the alley (apparently without the required state permit) , eradicating all vegetation within the borders of the alley and also killing plants located fully within the Holmes yard. The fill that Mr. Manz deposited in the alley appears to have contained some form of persistent herbicide - several plants along the alley in the Holmes backyard, including a large shrub, have died because of Mr. Manz ' s over spray or because of runoff from Mr. Manz ' s toxic fill dirt . Having seen from Fifteenth Street a new room in the garage on the Manz property, and having also seen Mr. Manz install an underground sewer line connecting the garage to an adjacent private sewer, Mr. Holmes believes that Mr. Manz has constructed a bathroom in his garage. However, no permit has been issued for a bathroom or a sewer line, and no inspection has occurred. Because the illegal sewer pipe is situated uphill from his home, and does not appear to be properly embedded in drain rock, Mr . Holmes fears that it will eventually fail and drain raw sewage into his back yard. Mr. Holmes has reported his concerns both to the Street Department and the Building Department, and has received zero satisfaction. An official in the Street Department suggested that Mr. Holmes install a curtain drain or swale, on his own property and at his own expense, to prevent the increased runoff and its toxins from entering his backyard. An Anacortes building inspector informed Mr. Holmes that the City was "comfortable" with Mr. Manz ' s activities in the alley. The City has responded to complaints about Mr. Manz involving his construction and electrification of a five foot-high fence around his vegetable garden. As the electric fence was located only about fifteen feet from a city street, the City required Mr. Manz to remove it when other neighbors apparently complained that the fence was threatening the safety of their children. The City also investigated the downspouts on the Manz garage that are not connected to the storm sewer -- but did not follow up and the downspouts remain unconnected to this day. Mr . Manz ' s actions with respect to the alley have gone on for at Ian Munce, Esq. December 30, 2003 Page 3 of 4 least two years, sometimes noticed but at all times ignored by City officials . The City of Anacortes owns the alley to the south of the Holmes residence, making the City the Holmes ' immediate neighbor to the south. As such, the City has a responsibility not to turn a deaf ear when Mr. Holmes informs it that a vexatious public nuisance is occurring there . The City expressly or implicitly assented to Mr. Manz ' s radical alteration to the grade of the alley, notwithstanding that no environmental analysis was performed and that no meaningful consultation with downhill neighbors occurred. It is understandable that building officials are reluctant to spark conflicts with homeowners, but in a case such as this, the City' s restraint comes at a direct and adverse cost to Mr. Holmes . Mr. Holmes is most reluctant to expend the large sums of time and money required to sue Mr. Manz over this nuisance on City property. This is especially so because nuisance abatement such F as this seems clearly to be the province and responsibility of the municipality, particularly in light of the fact that Mr. Manz ' s activities likely constitute a criminal public nuisance . Therefore, in the sincere hope that an amicable solution can finally be reached in this situation, Mr. Holmes respectfully requests that the City of Anacortes : 1 . Cause Mr. Manz to remove or pay for the removal of sufficient fill from the alley to return it to its original grade; 2 . Cause Mr. Manz to connect or pay for the connection of all his downspouts to the storm sewer, as required by the building code; 3 . Investigate the sewer line that Mr. Manz has constructed adjacent to the alley, determine if it conforms to all applicable building codes, and take further action on the matter as appropriate; and 4 . Admonish Mr. Manz to curtail his spraying activities in or near the alley and stop treating the alley as if it were his own property. Ian Munce, Esq. Public nuisance. 9.66.010.Public nuisance. A public nuisance is a crime against the order and economy of the state. Every place (1) Wherein any fighting between people or animals or birds shall be conducted; or, (2) Wherein any intoxicating liquors are kept for unlawful use, sale or distribution; or, (3) Where vagrants resort; and Every act unlawfully done and every omission to perform a duty, which act or omission (1) Shall annoy, injure or endanger the safety, health,comfort, or repose of any considerable number of persons; or, (2) Shall offend public decency; or, (3) Shall unlawfully interfere with, befoul, obstruct, or tend to obstruct, or render dangerous for passage, a lake, navigable river, bay, stream, canal or basin, or a public park, square, street, alley, highway, or municipal transit vehicle or station; or, (4) Shall in any way render a considerable number of persons insecure in life or the use of property; Shall be a public nuisance. A site visit was conducted on January 14th, 2004 to evaluate conditions. The items listed below correspond by number with Mr. Rasmussen's letter. 1. The alley grades have been modified, currently sloping to the back yard of 2417 14th street. A rock wall has also been constructed in the alley right of way without the required encroachment agreement. The encroachment agreement could include conditions requiring re-grading of the alley, drainage behind the wall, and grass seeding the alley. 2. The downspouts currently discharge to the surface, which slopes to the northwest, the lower property. The down spouts could be connected to the discharge tight line required for the rock wall, termination away from the downhill properties. 3. The building department will be contacting the owner of 2418 15"' for an appointment to inspect the garage for confirmation of sewer connection and alterations of the,building. The owner will be informed of the necessary permits, as built requirements and construction requirements as needed. 4. After re-grading, the alley would need to be reseeded with grass. The encroachment agreement could include a condition regarding spraying weed or grass killer in the alley. 1 It appears there have been several changes to the alley grades and a rock wall constructed within the past few months, which are not noted in the address file. Members present were: Mr. Charles Biel, Mr. Norwood Young, Mr. Ned Andrich and Mr. George Mehler. Absent: Mr. Charles Mason. Mr. ISie1 asked the boards pleasure on the minutes of the previous meeting of August 15, 1974. Mr. Young moved that the minutes be accepted as if read, Mr. Andrich seconded the motion. Mr. IKiel stated that there was only one varicance to be considered and that was Mr. M. Mc Glenn's request for a variance from 20 feet to 5 feet for a one room addition to his home. Mr. Kiel asked the Building Inspectors opinion on the variance. Mr. Ray Iversen, Building inspector said the Code asked for a 20 foot setback both in front and rear of the residence. Mr.McGlenn, speaking for himself, stated he has been living there for nine years and the living room is just too small, he wishes to build a room onto it. Mr. Andrich said they had looked favorably on these variances inthe past and • he feels that if it is granted and in the future the City of Anacortes wishes to put an alley through this area Mr. McGlenn must realize he has no recourse as he accepts this fact at this time. Mr. McGlenn said he did realize this and that he does not intend to put windows in that side of the house which will deter passing traffic from looking right into the house if in the future the City does decide on an alley in that area. Mr. Young questioned Mr. McGlenn regarding any objections from the neighbors. There have been none.
