CITY OF ANACORTES <br /> RESOLUTION NO. 2073 <br /> A RESOLUTION of the City of Anacortes, Washington, accepting the findings that an <br /> emergency exists which justifies the City entering into an emergency contract for the <br /> removal of the existing roof and installation of a new roofing system on the Anacortes <br /> Senior Activity Center building,without solicitation of bids. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANACORTES, <br /> WASHINGTON, AS FOLLOWS: <br /> Section 1. Recitals and Findings. The City Council of the City of Anacortes <br /> hereby makes the following findings: <br /> 1.1 The Anacortes Senior Activity Center serves as a physical location for the senior <br /> population to gather and attend specialized programs. <br /> 1.2 The roof on the Anacortes Senior Activity Center is a composite roof and over <br /> twenty-four years old. <br /> 1.3 The roof has deteriorated due to age and is currently leaking water in multiple <br /> places throughout the building. <br /> 1.4 Rain is frequent this time of year and it is imperative the roof is replaced <br /> immediately to prevent further damage to the building and protect the vulnerable <br /> population served by the Anacortes Senior Center from falls and mold exposure. <br /> 1.5 Replacement of the roof is"public work"as defined by RCW 39.04.010(4). <br /> 1.6 RCW 39.04.280 provides that the City, by resolution, may waive competitive <br /> bidding requirements for public works in the event of an emergency. For purposes <br /> of RCW 39.04.280, an "emergency" is any unforeseen circumstance beyond the <br /> control of the municipality that either (a) presents a real, immediate threat to the <br /> proper performance of essential functions; or (b) will likely result in material loss <br /> or damage to property, bodily injury,or loss of life if immediate action is not taken. <br /> The current failure of the Anacortes Senior Center roof and the injury risk to the <br /> vulnerable population it serves is an"emergency"as defined by state law. <br /> Page 1 of 2 <br /> Resolution No 2073 <br /> Finding of an Emergency for the Senior Center Roof Replacement <br />
