CITY OF ANACORTES
RESOLUTION NO. 2073
A RESOLUTION of the City of Anacortes, Washington, accepting the findings that an
emergency exists which justifies the City entering into an emergency contract for the
removal of the existing roof and installation of a new roofing system on the Anacortes
Senior Activity Center building, without solicitation of bids.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANACORTES,
WASHINGTON, AS FOLLOWS:
Section 1. Recitals and Findings. The City Council of the City of Anacortes
hereby makes the following findings:
1.1 The Anacortes Senior Activity Center serves as a physical location for the senior
population to gather and attend specialized programs.
1.2 The roof on the Anacortes Senior Activity Center is a composite roof and over
twenty-four years old.
1.3 The roof has deteriorated due to age and is currently leaking water in multiple
places throughout the building.
1.4 Rain is frequent this time of year and it is imperative the roof is replaced
immediately to prevent further damage to the building and protect the vulnerable
population served by the Anacortes Senior Center from falls and mold exposure.
1.5 Replacement of the roof is"public work"as defined by RCW 39.04.010(4).
1.6 RCW 39.04.280 provides that the City, by resolution, may waive competitive
bidding requirements for public works in the event of an emergency. For purposes
of RCW 39.04.280, an "emergency" is any unforeseen circumstance beyond the
control of the municipality that either (a) presents a real, immediate threat to the
proper performance of essential functions; or (b) will likely result in material loss
or damage to property, bodily injury,or loss of life if immediate action is not taken.
The current failure of the Anacortes Senior Center roof and the injury risk to the
vulnerable population it serves is an"emergency"as defined by state law.
Resolution No 2073
Finding of an Emergency for the Senior Center Roof Replacement
