Public Hearing: 2005/2006 Comprehensive Plan and Development Regulations/Proposed Amendments If reasonable accommodation due to a disability is needed, Contact Cherri!Calms at 299-1950 48 hours prior to the meeting date L Planning Commission Minutes — September 13, 2006 Members Present: Commissioners Laurie Gere, Marty Laumbattus, Betty Kuehn, Clay Leming, Lin Folsom and Burtis Rasco Staff Present: Michelle Deaton, Secretary; Ian Munce, Planning Director; Don Measamer, Assistant Director of Planning; Fred Buckenmeyer, Assistant City Engineer The Chair, Ms. Laurie Gere, called the meeting to order at 7:30 p.m. in the Municipal Building Council Chambers. The minutes of August 9, 2006 were approved as written. Correspondence There was no correspondence other than correspondence related to items on the agenda. Parking Variance: Soroptimist Mr. Ian Munce introduced the proposed parking variance for the Soroptimist's shop located at 1107 3`d Street. Commissioner Leming announced that he is friends with Shirley Bowlin, who is representing the Soroptimists; there were no objections from the audience. Commissioner Kuehn stepped down because she is a member of the Soroptmists. Mr. Don Measamer, Assistant Planning Director, presented overhead drawings and gaye an overview of the proposed parking variance. He explained that the applicant is asking relief from providing 11-off street parking spaces required for their proposed addition. The addition will consist of 1,800 retail space and 900 warehouse space. Ms. Shirely Bowlin, representing Soroptimists, explained that after further review they would be able to provide one off-street parking stall along the alley adjacent to the new hospital equipment room. In answering a question from Commissioner Folsom, Ms. Bowlin explained that additional diagonal on-street parking would be provided, if approved by the City, along 3`d Street. Ms. Bowlin pointed out that diagonal parking has already been added in front of the existing building, which added a few more spaces. With that, the Chair opened the public hearing. Ms. Paulie Fisher, 1106 4`n Street, referred to concerns mentioned in the letter that she submitted relative to traffic issues that exist in the alley. Ms. Shirely Bowlin, representing the Soropomists, addressed the issues raised in Ms. Fisher's letter. Ms. Bowlin explained that there is a delivery truck that comes once a week,which parks in the alley for about hour, although there is room for cars to go around the truck. (_.0 In answering a question from Commissioner Leming, Ms. Bowlin explained that on Tuesdays and Fridays there are approximately 10-14 people present during the day until 2:30 p.m., and when the retail shop is open there are three shifts with approximately three people each shift,with the shop closing at 8:30 p.m.; this amounts to 17 hours a week when the shop is open. In addressing another concern from Commissioner Leming, Ms. Bowlin explained that the loading door will be relocated so that the delivery trucks will be able to park off the alley. The Chair, Ms. Laurie Gere encouraged the Soropomists to do what they can to improve their relationship in the neighborhood. With that, the Chair closed the public hearing. After discussion, the Planning Commission approved the parking variance with the following two conditions: "This variance applies only to the Soroptmists"; and"Business hours shall be limited to 17 hours per week". This action was taken on a motion by Commissioner Laumbattus, seconded by Commissioner Folsom. The vote: Ayes; Laumbattus,Folsom,Leming, and Gere:Nays; Rasco. Motion carried. New Business Public Hearing: Shoreline Master Program Update (Public Comment will be received through September 20, 2006) Mr. Ian Munce, Planning Director briefed the Commission on the process of updating the Shoreline Master Plan. Mr.Munce pointed out that the City has been working with the Department of Ecology. A letter was submitted by Stowe Land LLC dated September 14, 2006. With that, the Chair opened the public hearing. Mr. Gene Derig, 1302"K" Avenue, spoke against the Shoreline Master Plan as presented. Mr. Tom Glade,representing Evergreen Islands, 2306 17th Street, spoke to the importance of this document, which will govern development for the City for years to come. He asked that all the comments from the Department of Wildlife be adopted. Mr. Ross Barnes, 1004 7`h Street, on behalf of Evergreen Islands, discussed his concerns relative to the Shoreline Master Plan updates. Gene Derig, 1302 "K"Avenue, mentioned that he did not receive a memo that was referenced in a letter of August 18, 2006 from Bob Fritzen. Dr. Paul Dinell, 1519 13th Street, stated that he had found the draft document to be well written. He suggested that the City incorporate principles of low impact development(LID). He further encouraged the Commission to incorporate LID into new projects. Dr. Dinell then suggested that storm water runoff and use of treated woods within shoreline areas be strictly controlled. Public Hearing: "J" Avenue Cottages Remand The Chair, Ms. Laurie Gere, introduced the"I"Avenue cottage remand back from City Council for further review by the Commission. Mr.Ian Munce, Planning Director gave an overview of the project. He explained that the applicant Mr. Gregg Wilson has resubmitted his application with a public street rather than a private street. With that, the Chair opened the public hearing. 2 ' 1 Gregg Wilson,Wilmoor Development, applicant, explained that he did appeal to City Council the Commission's decision to reduce his project from 10 lots to 8 lots. Mr. Wilson noted the changes to the application include a 20 foot wide public right-of-way and utilities. In answering a question from Commissioner Kuehn, Mr. Wilson pointed out that side yard setbacks will be 5 feet on each side. Jerald Watson, 2702 "J"Avenue, spoke against the project, and increased traffic concerns. Pat Robinson, 1304"I"Avenue, submitted photos showing traffic issues that arise during school hours. Mr. Robinson spoke in objection to the proposed development. Ms.Jeane Thomson, 1605 24th Place, explained that she is not concerned about increased traffic. She spoke in support of the proposed project, and feels that it would accommodate many people in our community. Mr.Ross Barnes, 1004 7th Street, expressed concerns relative to setbacks. He then recommended that duplexes be constructed. With that,the Chair closed the public hearing. After discussion, the Commission recommended to Council approval of the proposed application as submitted with the following changes: Delete Condition No. 25; and revise "private"to read"public". This action was taken on a motion by Commissioner Kuehn, seconded by Commissioner Laumbattus. The vote: Ayes; Ms. Gere,Ms. Folsom, Mr. Laumbattus, Ms. Kuehn: Nays; Mr. Leming, and Mr. Rasco 2005/2006 Comprehensive Plan and Development Regulations/Proposed Amendments After review and discussion the Commission made the following recommendations to Council regarding the 2005/2006 Comprehensive Plan and Development Regulations/Proposed Amendments. 1. Adding language regulating van mounted signs on property other than the site of the business advertised. The Commission supports this language. 2. Adding a definition of temporary structure. The Commission supports this with an exception for construction equipment-during construction with proper permits. 3. Correcting a 2003 drafting error and leaving R4 side yard minimum setbacks at 5 feet. The Commission supports this change. 4. Update code references to"manufactured home" from mobile home." Commission supports the correction. 5. Update the redevelopment definitions (triggering off-site public improvement requirements) to include all zoning designations currently in place. The Commission supports this correction. 3 6. Addition language to the Landscaping Maintenance section that the use of ivy be strictly prohibited. The Commission recommends this item. 7. Designating a Fish and Wildlife Habitat Conservation area on Cap Sante. The Commission supports this item. 8. (Historic Preservation Goals and Policies are set forth in the 2006 Draft Comprehensive Plan). The Commission accepts this language. 9. Adding public and private recreational facilities as a permitted use in the LM1 zone at March Point. The Commission recommends this item be added as a conditional use. 10. Add a Comprehensive Plan Policy requiring that"new home construction of property with aviation easements shall be constructed to achieve noise compatibility." The Commission supports this item. 11. Expanding zoning for retail is being addressed as part of the 2006 Comprehensive Plan Update. City Council is holding a public hearing October 8, 2006. 12. Work program items included under this item will be addressed as part of the 2007 Zoning Ordinance update. Deferred until 2007 13. Adding a specific reasonable use exemption to stream regulations. The Commission supports this addition. 14. Deleting the requirement that wetlands only be delineated by a Professional Wetland Scientist. The Commission recommends not deleting this item. 15. Delisting Anaco Bourne. Commissioner Laumbattus made a motion that the listing of the Anaco Bourne as a stream remain intact with its associated buffers, seconded by Commissioner Leming. The vote: Ayes; Ms. Gere, Ms. Folsom, Ms. Kuehn,Mr. Leming, and Mr. Laumbattus:Nay; Mr. Rasco The Commission then recommended to City Council the 2005/2006 Comprehensive Plan and Development Regulations as amended. The requirements are based on the site plan, dated March 12, 2008. Frontage: - Remove and replace approximately 20-feet of undulated sidewalk panels along the 0 Avenue frontage. The new panels shall have the same score marking as the original to match existing. - The existing wheelchair ramp at the corner of 3rd and 0 Avenue does not meet ADA requirements. The ramp will need to be replaced to match the current design standard within the Central Business District and meet ADA requirements. - The detectable warning device shall be an Armorcast inset, or similar, and white in color. - All concrete work shall have 4 lbs of lamp black added to each cubic yard of concrete to darken the sidewalk and match the surrounding sidewalks in the area. - All work shall conform to the current version of the WSDOT Specifications for Roads, Bridges and Municipal Construction and the current version of the City of Anacortes EDS Standards. Title 40 Code of Federal Regulations(40 CFR), subpart M, section 61.141, established the allowable limit of asbestos in building materials at 1%by weight.Materials containing more than 1%asbestos are regulated and must be handled in accordance with Federal.
