HomeMy WebLinkAboutResolution 1959RESOLUTION NO. 1959 A RESOLUTION AUTHORIZING EXECUTION OF TOURISM PROMOTION FUND CONTRACT/COMMITMENT BY AND BETWEEN THE CITY OF ANACORTES AND RECIPIENT AGENCIES WHEREAS, the below listed agencie s have been selected by the City through a competitive selection process to undertake projects designed to advertise, publicize, or distribute information or undertake other activities specifically authorized by RCW 67 .28.180 for the purpose of attracting visitors to the City of Anacortes; and WHEREAS , the City of Anacortes wishes to contract with these agencies for the provision of these services and is willing to provide certain monies to these agencies, which monies have been collected or will be collected as part of the Motel/Hotel Tax; NOW, THEREFORE IT IS HEREBY RESOLVED BY THE ANACORTES CITY COUNCIL to authorize the distribution of tourism promotion funds to the following listed agencies, as the official act and deed of the City of Anacortes: 1. Anacortes Arts Commission 98221 Artists Studio $1,500 Tour 2. Anacortes Yacht Club/Lido Fleet 78. Hoglund, City Clerk APPROVED AS TO FORM: Resolution No. 1959 May 23, 2016 CITY OF ANACORTES: ~~~e~re_,_M_a_y_o_r~~~~~ CONTRACT Contract by and between the CITY OF ANACORTES, a municipal corporation, and the Anacortes Arts Commission (hereinafter Grant Recipient) for the 98221 Artists Studio Tour. WITNESSETH: WHEREAS, the City of Anacortes has levied and continues to levy a special excise tax on charges made for the furnishing of lodging in motels, hotels, etc.; and WHEREAS, RCW 67 .28.180 authorizes the expenditure of such funds, or a portion thereof, to pay for advertising, publicizing or otherwise distributing information and to pay for other specified activities for the purpose of attracting visitors and encouraging tourism; and WHEREAS, the Grant Recipient engages in activities designed to advertise, publicize, or distribute information or other activities specifically authorized by RCW 67.28.180 for the purpose of attracting visitors to our community: WHEREAS, the Grant Recipient must expend the funds for such advertisement, publication and distribution of tourist promotion information or other activities specifically authorized by RCW 67.28.180 prior to December 31, 2016; NOW, THEREFORE, IT IS HEREBY AGREED by the parties hereto as follows: 1. The City of Anacortes shall pay directly to the Grant Recipient the sum of $1,500 during the calendar year 2016 upon documented performance of the work set-out in Attachment A to this contract, provided that the Grant Recipient must document a contribution to the project equal to one half (Y:z) match of the amount requested at the time of each invoice. 2. The Grant Recipient agrees to request payment from the City of Anacortes only for activities designed to advertise, publicize, or distribute information to attract visitors to the City of Anacortes and other such purposes as are permitted by RCW 67.28.180 and as set out in Attachment A to this contract. 3. The Grant Recipient shall make available to the City or the Washington State Auditor or their duly authorized representatives at any time during normal operating hours, all records, books, or pertinent information which the Grant Recipient shall have in conjunction with this agreement and which the City may be required by law to include or make part of auditing procedures or audit trail and which may be required for the purposes of funding the service contracted for herein. In addition, the Grant Recipient shall provide the Council a report with each reimbursement request describing how project funds were spent since the last reimbursement was submitted with a summary report being submitted with the final reimbursement request. 4. The Legal Department is authorized to approve the Grant Recipient's requests to reprogram a maximum of 20% of approved funds within expenditure categories enumerated in the original contract; provided that authorization shall not be construed as permitting: ( 1) assignment of new funds to a project in excess of the amount originally approved by Council, or (2) funding of expenditure categories not cited in the original governing contract. 5. The term ofthis contract shall be for the cal endaryear2016. 6 . All services which are to be rendered or performed under this agreement will be rendered or performed entirely at the Grant Recipient's own risk and the Grant Recipient expressively agrees to indemnify and hold harmless the City and all its officers, agents, employees or otherwise, from any and all liability, loss or damage that they may suffer as a result of claims, demands, actions, damages or injuries of every kind or nature whatsoever by or to any and all persons or property and of judgment against them which result from, arise out of, or in any way connected with the services to be rendered or performed by the Grant Recipient under the terms of thi s agreement. Saturday/Sunday, 10:00-5:00 p.m. This program will also Include the utilization of our Depot for those artists who do not have a working studio but would like to participate ... giving tourists an opportunity to see 5-10 artists in one location. As noted above, the Anacortes Yacht Club and Lido Fleet 78 have been selected from a highly com etive selection rocess to host the National Youth and Women's Lido Re atta on Au 2 and 28 . We anticipate that we will have a significant turn-out from our local high school sailors-with all Anacortes Parks and Recreation boats already spoken-for, and arrangements are being made for additional boats to be chartered. We will also have youth from Oak Harbor and many other neighboring communities. In addition, there will be a group of sailors from all over the county that will come to race in this prestigious regatta for a national title. Lido 14 sailboats are one of the most competitive and popular smaller racing sailboats in the nation and draw high.- level competitors. This is the first time that Anacortes has hosted the Youth and Women's -National Regatta, and organizers and the national governing body have already expressed excitement in the level of early interest the regatta is attracting. In addition to racers, there will also be a significant contigent of support boats, race committee boats, mark boats and the youth will be required to have a parent present, increasing the number of attendees that this event will draw. The national Lido organization will be flying in Principal Race Officers to score and oversee racing. Success will be measured in the number of attendees that compete. As noted previously, there has already been significant interest expressed -due in large part to the beauty and charm of our town, and national awareness of the outstanding sailing in Anacortes. Signfi.cant marketing will go into registering competitors and we have already received firm commitments from our Northwest High School Sailing Association teams (our association covers Portland to Bellingham). 8
